ZONING BOARD OF ADJUSTMENTS OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS,
DECEMBER 13, 1979
Dr. Hahn called the meeting to order in
the absence of the Chairman, H.B. Helton,

Mrs. Williams moved, seconded by Mr. Range,
to approve the minutes as read. Motion
carried 4-0.
Request of Barfield & Hoover Builders to
vary from the Zoning Ordinance #179 to be
allowed to build house 10 inches over the
front building line.
This property is located at 7320 Forrest Ct.
Mr. Bob Hoover with Barfield & Hoover Builders
presented their request to the Board. He
stated their concrete men made an error in
setting the foundation of this house. Mr.
Hoover stated the foundation was layed in
May of 1977, but did not realize they had a
problem until they sold it in October, 1979.
He stated the house is owned and occupied -
now.
Mr. Range stated he sees no problem with
granting this variance.
The Chairman asked if there was anyone who
wished to speak in favor of or in opposition
to this request.
Mr. Range moved, seconded by Mrs. Williams,
to approve SA 79-18 as requested. Motion
carried 4-0.

SA 79-19
Approved
Request of Westcliff Company to vary from
the Zoning Ordinance #179 to be allowed to
build house approximately 1 ft. 6 inches
over the side building line.
This property is located at 6801 Starnes Rd.
Mary Jo Clark represented Westcliff Co. in
their request. She stated the foundation
was set up on a 10 ft. building line
instead of the 12 feet.
The Chairman asked if there was anyone
who wished to speak in favor of or in
opposition to this request.
Mr. Range moved, seconded by Mrs. Williams,
to approve BA 79-19 as requested. Motion
carried 4-0.
BA 79-20
Approved
Request of Cambridge Co. Dev. Corp. to vary
from the Zoning Ordinance #179 to be allowed
to have a dry cleaning plant in Local Retail
zoning instead of the required Commercial
zoning. This property is located on the
north side of Watauga Road at Rufe Snow Drive.

Mr. Neil Cukerbaum represented Cambridge
Co. Dev. Corp. in their request. He stated
it was an error on their part because they
signed a contract with Comet Cleaners to
have a dry cleaning plant in their shopping
center without realizing that a dry cleaners
required Commercial zoning, and their shopping
center is Local Retail. Mr. Cukerbaum stated
that the cleaners will have 1200 ft. of area
for the plant and they will only clean clothes
that is brought in at that location only.
Mrs. Williams asked Mr. Caldwell if there was
a way they could grant this to Comet Cleaners
only so if they ceased to be there, the
variance would be void.
Mr. Caldwell stated they could.
Mrs. Williams asked Mr. Cukerbaum if
Cambridge would object to this.

Mr. Cukerbaum stated it would be fine with
them because if Comet Cleaners could not
make a go of it, no one could.
Dr. Hahn asked how they worked this.
Mr. Cukerbaum stated this would be vented
through the roof. He stated Mr. Caldwell
could explain the structure of the building
better than he could.
Mr. Caldwell stated Cambridge had built their
building to commercial specifications such
as the 90% fire exterior which is required
in commercial zoning but not required in
Local Retail zoning.
Mrs. Williams asked what the difference
was in the washateria that has a dry cleaning
machine and this dry cleaners.
Mr. Caldwell stated the only difference
is our lIordinancell. He stated that at the
washateria the public would be doing their
own cleaning in this machine and the other
way would be done in the back room for you.
The Chairman asked if there was anyone who
wished to speak in favor of or in opposition
to this request.
Mrs. Williams moved, seconded by Mr. Range,
to approve BA 79-20 to allow Comet Cleaners
to have a dry cleaning plant in Local Retail
zoning as shown in Exhibit A. Motion carried
4-0.
BA 79-21
Approved
Request of N. G. Chesser to vary from the
Zoning Ordinance #179 to be allowed to build
a car port over the front building line.
This property is located at 7920 Odell Street.
Mr. Chesser presented his request to the Board.
He stated he had lived here 24 years.
He stated he called a firm in Arlington to
build him a car port but they said he would
have to get a permit first. He stated he
then tried to get a permit and was told he
would have to go before the Zoning Board of
Adjustment for a variance. Mr. Chesser stated
the house was built in 1950 before there was
a curb. He stated the curb was put in about
3 years ago. He said there is approximately
12 ft. on one side and approximately 4\ or

5 ft. on the other side. Mr. Chesser stated
the car port would be approximately 16 ft.
from the curb.
Mrs. Williams asked if it would come out
as far as the tree on the side of the yard.
Mr. Chesser stated he was not sure which
tree she was speaking of. He said the car
port would be 18 ft. x 23 ft.
Mr. Roseberry asked if this drawing was
to scale.
Mr. Chesser stated that it was not, that a
man at his work drew it and it was only
approximate.
Mr. Range stated he was out there today and
the house was not built according to any
ordinances or regulations, it was built
befa~e the ordinances were established. He
stated that he did not feel that Mr. Chesser
should be restricted.

Mr. Roseberry asked Mr. Chesser what the car
port would look like.
Mr. Chesser stated it would be put up by
Lane and it would be all metal.
Mrs. Williams asked if it was going to
look like the one down the street.
Mr. Chesser state it would not look like
the one down the street. He said it would
look real nice.
The Chairman asked if there was anyone who
wished to speak in favor of or in opposition
to this request.
Mr. Roseberry asked Gary if they would allow
Mr. Chesser have it 16 ft. from the curb.
Mr. Caldwell stated it would be ok.

Mr. Roseberry moved, seconded by Mr. Range,
to approve BA 79-21 with the stipulation
that it would not extend more than 16 ft.
from the curb. Motion carried 4-0.

BA 79-22
Request of David Sauerwein to vary from the
Zoning Ordinance #179 to be allowed to build
on property with only 13 ft. road frontage
in Agricultural zoning.
This property is located approximately 200 ft.
west of Crane Road and approximately 800 ft.
north of Main Street.

Mr. Albert W. Sauerwein, father of David
Sauerwein, presented David1s request to
the Board. He stated that his son wishes
to build a 2000 sq. ft. single family home
on approximately 2 acres. He stated this
property only provides a 13 ft. entrance
into it. Mr. Sauerwein stated they understand
that the Board is concerned with being able
to get the utilities in and able to get fire
equipment in there should there ever be a
fire. Mr. Sauerwein stated that David had
talked to North Richland Hills Fire Marshall
Jack Long and he stated 13 ft. would be
enough. He talked to North Richland Hills
Director of Utilities Allen Bronstad and
he stated that he would only need 10 ft.
apart for water and sewer and the water
meter is already set, so there would be
no problem. Mr. Sauerwein stated that
David then talked to a representative of
Lone Star Gas, Mark Spivey, and he said
there would be no problem with only 13 ft.
Then he called TESCO and spoke with R. L. Fain
and Mr. Fain stated there would be no
problem. Mr. Sauerwein stated David then
called W. R. Rossard with Southwestern Bell
Telephone Co. and he stated there would be
no problem with only 13 ft. road frontage.
Mr. Sauerwein stated he did not feel this
would devalue the surrounding property,
but would enhance the value and would increase
the tax revenue. He stated this would in
no way add any cost to North Richland Hills.
Mr. Sauerwein stated his son has offered
one neighbor $15,000 for 17 ft. of land.
He stated he may be able to purchase more
frontage, but has not been able to at this
time to do so. Mr. Sauerwein stated that
David has been in business in North Richland
Hills for several years and they both live
in North Richland Hills. He stated if David

is granted this variance he will move out
of his home and into his own home. He stated
David has been in his home for 28 years and its
time he IS moving out.
The Chairman asked if there was anyone who
wished to speak in favor or in opposition
to this request.
Mrs. Williams asked where this property was
located. She said she went out and thinks
she found it.
Mr. David Sauerwein told her what it was
close to.
Mr. Roseberry stated this request is not
valid because it is less than 2 acres.

Mr. Caldwell stated that he and Mr. Anderson
had discussed this and they request that if
the Board grants this variance, they also
grant that Mr. Sauerwein be allowed to
build on this 1.96 acres since it is so near
the 2 acres requlation. Mr. Caldwell stated
the staff should have told Mr. Sauerwein
that he could ask for both requests at this
time.
Mrs. Williams asked Mr. Sauerwein if he had
tried to buy enough property from adjoining
property owners so he would have more road
frontage.
David Sauerwein stated he had talked to
Mr. Hobbs and Mr. McCormick both. He stated
Mr. McCormick is here tonight. David stated
that neither Mr. Hobbs nor Mr. McCormick said
they would sell, but Mr. McCormick is concerned
about what type of house will be going in
there as he has plans to build a 3000 sq. ft.
home.
Mr. Range stated he went out to look this
property over and he could not drive his car
down that road.
Mr. Sauerwein stated that it would have to
be leveled first.

Dr. Hahn asked if the road would be permanent
covered.
Mr. Sauerwein stated he understands that if
there is a problem, it would have to be dug up.

Mr. Caldwell stated the drive way would
have to be 12 ft. He stated he will probably
have a septic tank, but the water and sewer
can go in the same ditch with the water on
top. Mr. Caldwell stated this would be
private lines and Mr. Sauerwein would have
to bear the expense.
Mrs. Williams asked if it was allowed to
have the lines under the driveway.
Mr. Caldwell stated that since these would
be private lines, he can do this because
it would be put in and maintained at his
expense.
Mr. Roseberry asked David if he was aware
that he would probably not be able to get
financing for this piece of property.
David stated he already has it.
Dr. Hahn asked if he plans to have a septic
tank or sewer.
David stated œ would probably have a septic
tank because he fèels the sewer will not
be put in that area for several years.
Mr. Range asked David if he had exhausted
every means to acquire enough land for a
30 ft. fronta ,e.
David stated he had discussed this with
Mr. McCormick and they might could work
out a trade since Mr. McCormick needs some
for his septic tank.
Mrs. Williams asked why they would leave a
piece of land with only a 13 ft. ingress.
Mr. Caldwell stated this was done a long time
ago. He stated they keep selling off pieces
of land until they almost had a dead piece
of land so they left this gravel road for
ingress into the property.
Dr. Hahn asked Mr. Caldwell if he sees any
problems with this.

Mr. Caldwell stated he did not see any problem
but would request that if the Board grants
this to also grant the variance so he
can build on the 1.96 acres.
Mr. Range moved, seconded by r~r. Roseberry'
to approve BA 79-22 and also stipulate that
Mr. Sauerwein be allowed to build on the
1 . 96 acre tract.
Mrs. Williams asked if this request could
be postponed to give him time to try to
purchase more frontage.
Mr. David Sauerwein stated he has to close the
deal before January 1.
Mr. Sauerwein stated the property meets the
state law, but it just doesnlt meet
North Richland Hills zoning ordinance.
The motion carried 4-0. With all members
voting afirmative.
OLD BUSINESS
Mr. Range stated he saw lots of fences that
have recently been built illegally - in
these new neighborhoods.
Mrs. Williams stated there are lots of
additions built without a building permit.
Mr. Caldwell stated that this is the time of
year we pull the cards on fences, pools,
etc. that have not been finalized. When we
catch someone not having a permit, we double
the price of the permit. Mr. Caldwell stated
that during the slow winter months they check
all this. He stated that he would assure
the Board that the violations will be corrected.
Mr. Roseberry asked Mr. Caldwell if you are
replacing an existing fence do you need a
permit.
Mr. Caldwell stated you do not.
