JANUARY 26, 1978
The regular meeting of the Plarming and
Zoning Corrnnission was called to order.'at
7 : 33 P. M. by the Chairman, Mary J 0 Shaunty.

Approval of the minutes of November 29, 1977
was postponed until the February meeting
since there was not enough members present
who were present at the November meeting.
M'r. Grubb moved, seconded by M'r. Wood to
approve the minutes of December 29, 1977
as read. Motion carried 4-0.
Request of Claude & Alice Nunley to rezone
Lot 1R, Block 4, Richland Oaks Addition,
from its present classification of 1F-12
One Family Dwelling to a proposed Classi-
fication of 2F-9 Two Family Dwelling.
This property is located at 5149 Jermings Dr.
Alice Nunley presented her request to the
Corrnnission. She stated they built their
home over 20 years ago. At that time, the
property was in Smithfield. She said she
was one of the residents who asked North
Richland Hills to take in Smithfield. There
were only about 3 houses in this area when
we moved here and they were all on Jerri
Jo. This duplex will be a lovely asset to
the neighborhood. The lot where ARA Rental
is, is very noisy and then we have Parker
Stone Company. They are also noisy. This
business is on the side of the house where
our bedrooms are and M"rs. Nunley stated she
works nights and sleeps days. She also

said there was a Chiropractic Clinic at
Strwmner and Grapevine Hwy. There are
other businesses around. There is Sanger
Harris being buil t and Stop and Go. She
said she believed a nice duplex would be
much better than these businesses. A
request for rezoning for duplex of a lot
here was denied a few years ago. The
property owner behind this lot was in
favor of the duplex rather than get
something worse. She said he got something
worse. She said this duplex will be fenced
and will give the appearance of a single
family dwelling. A vacant lot takes a lot
of time and expense to keep up. She said
her taxes have doubled since she bought the
lot. Mrs. Nunley stated she received a
letter as did all the Commission members
from Mrs. Cleta Teehee stating she would
sue if the Deed Restrictions are not kept.
Mrs. Nunley stated these Deed Restrictions
were made 23 years ago and she does not feel
they would be right for this property now.
Mrs. Nunley said she had checked with a
Realtor to see how this would affect the
value of property in this area. She said the
Realtor stated it should increase the value.
Vacant lots tend to decrease the value of
surTounding property.
Mrs. Nunley said she had pictures and plans
of a duplex in Ridglea that she plans to
copy. She said only one neighbor came to see
these plans and pictures to see if they were
in favor of building a duplex on this property.
Mrs. Nunley then showed the pictures and plans
to the Commission.

Mr. Wood asked Mrs. Nunley what the price
range and square footage of this duplex she
plans to build was.
Mrs. Nunley stated the 2 bedroom, 2 bath,
would be approximately 950 square feet, and
the 3 bedroom, 2 bath would be approximately
1750 square feet, and would rent for approximately
$350.00 monthly.
Mrs. Shaunty asked if there was anyone who
wished to speak in favor of this request.

Mr. Robert Evans stated he lives in Haltom
City but owns the lot directly behind the
lot in question. He said when the land that
ARA is on came up for rezoning, the property
owners that were afar off were not concerned.

The problem with this business-they did
not build according to specifications~
This has been pointed out to them. And
M'r. Evans said they also keep a gate open
on one side of the business. M'r Evans said
there is lots of noise when they st~ the
tractors and saws. He said the vacant lots
are hard to keep up. He said they have
trouble getting the ba.r ditches cleaned out.
He said he believed this duplex would be kept
better since it will cater to the upperclass
people. These duplexes usually rent for
arolli1d $350.00. This would rule out the lower
class people.
M'rs. Shaunty asked if there were any who wished
to speak against this request.

M'rs. Doyne Byrd, living at 8320 Dude Court,
said she had known M'r. & M'rs. N11nley for
several years and was a friend of theirs.
She said she told M'rs~ Nunley that she would
corne to this meeting with an open mind and
listen to the pros and cons of this request
and look at the pictures and plans . She
said that in the first place, Mrs. N'unley
would be going against the deed restriction
unless she received 60% of the property
oV.Jl1ers' signat"ures in agreement with her.
She said that motorists think you are going
to turn on Harwood instead of Jennings, and
they almost cause an accident. Mrs. Byrd
stated she used to live on Hardisty behind
Red Rooster Lumber Company. She said she
did not realize that businesses would cause
your property to depreciate until she tried
to sell it. She said the only way she was
able to dispose of her property on Hardisty
was the builder took it in on trade.
M'rs. Byrd started reading the deed restrictions.
M'r. Grubb told M'rs. Byrd that the Plarming and
Zoning Commission was not interested in the
deed restrictions since they had nothing to
do with it.

M'rs. Byrd stated she was representing several
neight:ors who were unable to corne: Homer Cozby,
the Wrights' on Jennings, the Bezners' on
Jennings, the Wayne Mashburns'. She

said they were all against this request.
Mrs. Cleta Teehee, living at 5122 Pearl,
stated she had not noticed the noise from
the Grapevine Highway. She stated that she
feels Mrs. Nunley should abide by the deed
restrictions. She stated that Mrs. Nunley
only bought the lot two years ago.
Mrs. Teehee stated she has 2 small sons, one
14 months, and one 5 years old, and she is
interested in their environment. She said
there are approximately 58 lots in this area
and does not feel this zoning should be
changed.
Mrs. Shaunty asked if any of the names Mrs.
Byrd mentioned were within 200 feet of this
property.
Wanda Calvert stated they were not.
Mr. Grubb asked how many vacant lots there
were.

Mrs. Teehee stated there were several. She
stated the Bezners' bought one for a tennis
court, and the Jacobsons' have one and keep
it very nice.
Mrs. Nunley stated that most of the names Mrs.
Byrd gave had told her they were not opposed
to the zoning change. She said she had talked

opposed to it. Mrs. Nunley stated the reason
they bought the extra lot was to keep businesses
such as "Stop & Go" from being put there.
Mr. J.J. Kurtin stated he had not discussed
this with his wife, Frances, and was not aware
she had talked to Mrs. Nunley stating they were
not opposed to this zoning change. He said
the only thing he was concerned about was if
it would devaluate his property.

husband had tried to contact the 60% of the
property owners. He also asked if she had
canvassed this area for all opinions. He said
even if the Planning and Zoning Commission
approves this request, Mrs. Nunley might have
a law suit over this.

nor received 60% of the area residents. She
said she wasn't sure which she should do
first-get the 60% or get the approval of the
Planning and Zoning Commission.

Mr. Grubb stated the Commission might have
used bad judgement in people's eyes, but

Mrs. Irene Kidwell presented her request to
the Commission. She stated she wanted to build
a building on her property for her daughter,
who is a nurse, to have a day care for children.
Mr . Britton asked if she was plarming to
build another building on this property.
Mrs. Kidwell stated she was.
Mr. Britton stated Agriculture with Specific
Use does allow a day care center, but Mrs.
Kidwell does not have 2 acres of land. Also
if she builds another building on that pro-
perty, she would by law have to have the land
platted.
Mrs. Kidwell asked Mr. Britton if she could
just build onto her existing house.

Mr. Britton stated she could not be able to
build it to State requirements, because the
State requires you to have a kitchen, and our
ordinance will not allow you to build another
kitchen onto an existing house.
Mr. Britton stated she could ask for residential
zoning and have the property platted, then she
could build her day care center.

Methodist Church. He said they want to sell
this property to the Powells" who have a day
care center across' the street.
Mr. Ray Bates, Trustee for the United Methodisf
Church, stated they had put the old Santuary -
on the market for sale~ He said the Realtor
stated he had a b'uyer if we would have the
property rezoned for a day care center.
Mr. Jack Roseberry with First Mark Realtors'
stated they had had this property listed with
them for approximately 18 months. He said
they had had several people interested in this
property. He said t'hat they feel this day care
center would put the old building to
good use. He said he believed this would be a
very nice addition to the community when the
Powells remodel it. Mr. Roseberry stated he
had had the building checked out and it was' a
very good structure and with the new wiring
and remodeling, it would meet with specification.

requested a 5 foot easement on the South and
West Sides. He stated these were needed to

Mr. Long stated that he believed that if the
creek were cleaned out down stream, it would
not flood. He said that on #5 & 6, Mr. Davis
wants to discuss this with the City. He
said he paid a tap when he bought this

property sets way above. Only one little
corner down close to the creek and they will
never put a building there. Mr. Long said
there is some question as to whether this
property is in Haltom City or North Richland
Hills. He stated they would work this problem
out with the city. He stated that on #S-they
believe they paid this when the existing
building was built. On #6, Mr. Long stated
they need to get back with Mr. Bronstad and
will correct.

Mr. Elliott said they were in agreement with
all the points in the Engineer's letter except
#2. They have talked with Mr. Bronstad about
this. They said they will not be using the
sewer on airport freeway. They will use the
one on Bedford Euless Road.
Mr. Elliott stated that if these requests
are approved by the Planning and Zoning
Commission and the City Council, that Mr.
Vincent will be in March 1st for a building
permit.
Mr. Wood moved, seconded by Mr. Grubb, to
approve PS 78-12 subject to the Engineer's
letter. Motion carried 4-0.
Mr. Wood moved, seconded by Mr. Grubb, to

Mr. Britton asked the Commission if it would
be ok with them to have the Planning and
