MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, FEBRUARY 23, 1978 CALL TO ORDER The regular meeting of the Planning and Zoning Commission was called to order at 7:05 P.M. by the Chairman, Mary Jo Shaunty. ROLL CALL PRESENT: CHAIRMAN MEMBERS Mary Jo Shaunty Darrell Wood Forrest Grubb ABSENT: SECRETARY Lee Waldrop MEMBER Claude Morrison CITY STAFF PRESENT: CITY INSPECTOR Gary Caldwell CLERK Wanda Calvert APPOINTMENT OF ACTING SECRETARY The Chairman appointed Forrest Grubb to act as Secretary in the absence of Mr. Lee Waldrop. . CONSIDERATION OF THE MINUTES OF FEBRUARY 2, 1978 The approval of the minutes of February 2, 1978 had to be postponed due to not enough members present for a Quoram that were present at the February 2 meeting. NEW BUSINESS The Chairman requested that the people who wish to speak tonight, limit their speaches to five minutes. PZ 78-5 Since no one was here to present this request, the Chairman moved it to the end of the Agenda. PS 78-14 Since no one was here to present this request, the Chairman moved it to the end of the Agenda. PZ 78-6 APPROVED Request of J.H. Williams & Associates to rezone approximately 16.927 acres of land out of the W.W. Wallace Survey, Abstract 1606, from its present classification of Planned Development to a proposed classification of IF-8 One Family Dwelling. This property is located on Maple- wood Avenue and West of Cloyce Drive. PS 78-15 APPROVED Request of J.H. Williams & Associates for preliminary plat of Holiday Park Addition. . Mr. J.H. Williams came to present his request. He stated the houses to be built in this area Page 2 P & Z Minutes February 23, 1978 . would be not less than 1500 sq. ft. of floor space. He also stated that all points of the Engineer's letter had been met. Mr. Grubb asked Mr. Williams about #7: liThe building lines at Lots 4 & 5 and 10 & 11, Block 3, should not be staggered. Twenty- five foot building lines should be shown on each lot. II Mr. Williams stated they could meet these re- quirements. The Chairman asked if there was anyone who wished to speak for or against this request. . Mr. Barkholtz, 7513 Jade, asked what type of houses will be built and what price range. Mr. Williams stated they would be at least 1500 sq. ft. floor space, but as to the total price, he could not say. He said they figure approximately $30 per sq. ft. now. Mr. Barkholtz stated that what the property owners are concerned about is if they will be FHA 235 houses. Mr. Williams stated they definitely will not be FHA 235. He said they will not even be run through FHA. Mr. Wood moved, seconded by Mr. Grubb to approve PZ 78-6 with the requirement of a minimum of 1500 sq. ft. of floor space, and also subject to the Engineer1s letter. Motion carried 3-0. Mr. Wood moved, seconded by Mr. Grubb, to approve PS 78~15. Motion carried 3-0. PZ 78-7 APPROVED Request of J.B. Sandlin & Alan W. Hamm to re- zone approximately 85.56 acres of land out of the W.W. Wallace Survey, Abstract 1606, from its present classification of Agriculture to a proposed classification of IF-8 One Family Dwelling. This property is located West of Holiday Lane & North of existing Holiday West Addition. . Mr. J.B. Sandlin & O.D. Long were present to present this request. Mr. Sandlin stated that this is a continuation of the zoning of the property that was before Page 3 p & Z Minutes February 23, 1978 . the Commission last meeting. He said his reasons were the same and he did not feel it necessary to go back over it again. He did say that this is a long range program of around 4 to 5 years development. He said that if the Commission puts a restriction on this request, he would like it put in the minutes that he might have to come back in a few years for a variance to build smaller homes. He said they had had an increase of 15 % per year, and 15 % per year on $50,000, it won't be long till it will be $100,000. He said that Mr. Williams had stated he was figur- ing $30 a sq. ft. on houses, but we figure $32 to $35 per sq. ft. . Mrs. Shaunty asked what size houses Mr. Sandlin plans to build. Mr. Sandlin stated the other property has a restriction of not less than 1400 sq. ft. He said their price range for 1500 sq. ft. was approximately $47,000 to'$50,OOO. He said they usually don't build any smaller homes than 1700 sq. ft., but if the cost continues to rise, they would not be able to build this large house. He said people could not afford to buy them. Mr. Wood asked why they are not intending to build immediately. Mr. Sandlin stated it takes so long to plat it and also if you don't plan each addition to coinside with the other, it would not look right. He said that Holiday Heights and Holiday North took around 10 years to complete, but they had a master plan and went by it all the way. Mr. Wood stated he did not feel the Commission could so state that Mr. Sandlin could just come in anytime and be granted a variance. Mr. Long showed the master plan and stated they would start the building right away and as soon as lots are sold, more will be built. . Mr. Sandlin stated that Holiday North was set up for 1300 sq. ft. floor space, but most of the homes are 1500 & 1600 sq. ft., and some are even 1800 sq. ft. Page 4 P & Z Minutes February 23, 1978 . The Chairman asked if anyone wished to speak for or against this request. Mr. Grubb moved, seconded by Mr. Wood to approve with the restriction of not less than 1400 sq. ft. of floor space. Motion carried 3-0. PS 77-56 Since no one was here to present this request, the Chairman moved this case to the end of the Agenda. PS 78-16 APPROVED PS 78-17 APPROVED Request of Pizza Hut for preliminary plat of Lot 1, Block 25, Clearview Addition. Request of Pizza Hut for final plat of Lot 1, Block 25, Clearview Addition. Mr. Joe Bledsoe came to represent the Pizza Hut in their request. . Mr. Grubb asked if Mr. Bledsoe was aware of the Engineer's comments. Mr. Bledsoe stated he was and there were no problems. The Chairman asked if anyone wished to speak for or against this request. Mr. Wood moved, seconded by Mr. Grubb to approve PS 78-16 subject to the Engineer's letter. Motion carried 3-0. Mr. Wood moved, seconded by Mr. Grubb to approve PS 78-17 subject to the Engineer's letter. Motion carried 3-0. PZ 78-5 TABLED . PS 78-14 TABLED Request of John Barfield to rezone approximately 42.1532 acres of land out of the John Barlough Survey, Abstract 130, from its present classi- fication of Industrial to a proposed classifi- cation of IF-8 One Family Dwelling. This pro- perty is located North of La Casita Mobil Home Park and West of Mangham Airport. Request of John Barfield for preliminary plat of Sunny Meadows Addition, Third Filing. Page 5 P & Z Minutes February 23, 1978 . Mr. O.D. Long represented Mr. Barfield in this request. Mr. Wood asked Mr. Long if Newman Drive would be the only through street in the Addition. Mr. Long stated it was, but later Shirley Dr. would be. Mr. Wood asked if they had checked the flight plan of Mangham airport. Mr. Long stated he believed it went over Glen- ann Addition. . Mr. Barfield stated that he had intended to develop the Multi Family & Industrial sites, but they never materialized, so he decided to try Single Family residences. The Chairman asked if there was anyone who wished to speak on this subject. Peggy Penoli stated she would like to know if the property owners would be allowed to buy the adjoining lots to their property. Mr. Barfield stated the lots would be for sale to anyone who wanted to buy them. Mrs. Penoli also asked about the air~ort. She said they had a crash out there not long ago. She said they fly over house when the wind changes. . Mr. George Wakefield, General Manager of the Mangham Airport stated he would like to speak: liThe aforementioned property, subject to rezon- ing to residential purposes, does adjoin Mangham Airport at its west boundary line. Mangham Airport's property is zoned Industrial and Industrial Specific Use for Airport. If this zoning were granted, it would place resid- ential property adjacent to industrial property. Mangham Airport would like to point out to the Commission that this property under consideration for single-family zoning, lies at the West end of Mangham Airport's cross wind runway. The cross wind runway is used less than ten percent of the time, but is used when there are high winds blowing in either an Easterly or Westerly direction, and is also used in the event of emergency. Mangham Airport most respectfully Page 6 P & Z Minutes February 23, 1978 . suggests that homeowners in this locality, on occasion may be subjected to low flying aircraft. Also, if homes were built adjacent to our West property line, thpv would, of course, encumber th~ approach from the west of incoming aircraft using this runway on occasion. Mangham Airport would like to further point out that the cities of North Richland Hills, Hurst, and Keller are currently involved in pursuing a federally funded study pertaining to airports in Northeast Tarrant County and Mangham Airport is one of the sites that shall be studied. The results of these studies shall probably be known in late 1978 or early 1979 and, of course, shall have a significant bearing on the future of Mangham Airport and its expansion possibilities and limitations. One of the more significant factors in this study will be an environmental impact study, pertaining to the surroundings of all of the proposed sites. Mangham Airport points these factors out as considerations in the granting of single family zoning and, further, the approval of plats in this immediate area. While our studies show and have been validated by the FAA, that in this type of airport, that is an airport with single engine light planes and small twins, residences and the airports can live in harmony. Perhaps it stretching a bit if the residences are built at the immediate end of a runway. Mangham Airport has not been priviledged to see or discuss the plans for this particular area under consideration and therefore cannot be sure exactly what the consequences of the pro- posed zoning might be. We cannot but point out these considerations for your study, as we can see that a residential development, immediately adjacent to Mangham Airport and at the end of its cross wind run- ways, could result in an un-harmonious and unpalatable situation for both Mr. Barfield and Mangham Airport. We ask the Planning and Zoning Commission's consideration of this awkward circumstance and stand ready and available to meet with Mr. Barfield and his engineers to try to reslove a solution which might be amenable to both parties, but, from the suggestions expressed that Tract A shall be developed single family and residential, we must respect- fully oppose the zoning case. II . . Page 7 P & Z Minutes February 23, 1978 . Mr. Grubb stated that Mangham Airport came before the Commission last year requesting to enlarge. They said the Industrial tract would have plenty safety zone and would build Industrial buildings there. Mr. Wakefield stated that things have changed. He said this study will bring about facts no one has ever considered. Mr. Grubb stated there was a covenant made with the city and Mangham. At that time, there was to be no East-West runway and would never be. And furthermore, if you are using this runway, you are in violation of the covenant. Mr. Grubb asked Gary Caldwell, City Inspector, to check into this. . Mr. Wood stated he was on the P & Z Commission at that time and there was no mention of an East-West runway. He stated he insisted on the planes not to exceed 10,000 pounds. Mr. Wakefield stated that on occasion this East-West runway does have to be used. If there is a cross wind or anytime a plane is having difficulty, they can use any runway available. Mr. Grubb stated that the covenant was made then and to last forever-and that means no East-West runway ever. Mrs. Shaunty stated she knew that the owners of Mangham were at a standstill until this study is complete. She asked Mr. Barfield if he would be in favor of getting together with the owners of Mangham and see if something could be worked out. She said she understood that Mr. Pasteur had tried to get in touch with Mr. Barfield. Mr. Barfield stated he would be glad to meet with Mr. Pasteur. He said he needed to dispose of the property someway as his taxes went from $2000 to $10,000. . Mr. Don Collins stated that when Mangham Air- port came before the Commission they said they would not ask for any further expansion ever. Page 8 P & Z Minutes February 23, 1978 . They said to let them expand this time and they would never ask again. Mr. Joe Barnett, 6000 Davis Blvd., stated he would like to speak for he and his father. He said their property joined this and con- tinues West to Davis Blvd. He pointed out their property on the map to the Commission. He stated he would like to go on record as not being for or against this request, but that if the zoning and platting are approved, he would request that they open the streets onto their property. He said their 50 acre tract is zoned Industrial, and they would like Mr. Barfield to design his property where there would be access onto Davis Blvd. He said there needs to be a thoroughfare from Davis to Mangham. Mr. Grubb stated the Commission would be opposed to opening any street into Industrial property. Mr. Barnett stated they would like to develop their property it residential. ' . Mr. Grubb stated if the Barnetts had the zoning changed to Single Family, the streets could be opened up, but not if it stays Industrial. Mr. Grubb moved, seconded by Mr. Wood, to table PZ 78-5. PS 77-56 APPROVED PS 77-57 APPROVED Request of Donald Kerr & Assoc. for preliminary plat of Northland Shopping Center. Request of Donald Kerr & Assoc. for final plat of Northland Shopping Center. . Mr. Donald Kerr came to present his request. He stated that Gene Worrell was correct in hav- ing this request tabled. He said the problems have since been resolved. He said they are in agreement with the buyers that they pay the sewer & pro rata. He said they want to request that the money not have to be paid until the closing of the deal. He said that as soon as the City Council approves, they will finalize the deal. He said the cost was very high, and he understands that it will be deposited in an escrow account. He asked if there was any excess Page 9 P & Z Minutes February 23, 1978 . amount over the cost of the streets and sewer, would it be refunded. Mr. Grubb stated he felt sure that by the time the streets are built, there would be no extra. . Mr. Kerr stated he had also talked with Mr. Riddle about the street cost. He said that at one area, they are being charged twice. He said he told Mr. Riddle this should be re- figured, and Mr. Riddle agreed. Mr. Grubb stated that this should be taken up with Mr. Riddle and Mr. Britton before the City Council meeting. Mr. Wood asked if all the other requirements in the Engineer's letter had been met. Mr. Kerr stated they were in agreement with all except the one just mentioned. Mr. Grubb moved, seconded by Mr. Wood, to approve PS 77-56 subject to the Engineer's letter. Motion carried 3-0. Mr. Grubb moved, seconded by Mr. Wood, to approve PS 77-57 subject to the Engineer's letter. Motion carried 3-0. ADJOURNMENT Mr. Wood moved, seconded by Mr. Grubb, to adjourn at 8:15 P.M.
