MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, MARCH 23, 1978 CALL TO ORDER The regular meeting of the Planning and Zoning Commission was called to order by the Vice Chairman, Darrell Wood, at 7:07 P.M. NEW BUSINESS PZ 78-8 APPROVED Request of Federated Dept. Stores to rezone approximately 91.6501 acres of land out of the W.W. Wallace Survey, Abstract 1606, from its present classification of Local Retail to a proposed classification of Commercial. This property is located South of Kircher Pontiac and East of Grapevine Highway. Mr. John Bromberg, attorney, represented the Federated Dept. Stores. He stated they were requesting this zoning change to be able to have a T.B.A. store(Tires, Batteries, & Acces- sa r i e s ) . Mr. Wood asked if there was anyone who wished to speak for or against this request. Mr. Waldrop moved, seconded by Mr. Grubb, to approve. Motion carried 3-0. Request of Foster Village Joint Venture to rezone approximately 18.01 acres of land out of the John Condra Survey, Abstract 311, from its present classification of 1F-9 to a pro- posed classification of 1F-8 One Family Dwelling. PZ 78-11 APPROVED Request of Foster Village Joint Venture to rezone approximately 4.49 acres of land out of the John Condra Survey, Abstract 311, from its present classification of Multiple Family to a proposed classification of 1F-8 One Family Dwelling. This property is located in Foster Village, South of Fair Meadows Drive. PZ 78-12 APPROVED Request of Foster Village Joint Venture to rezone approximately 4.02 acres of land out of the John Condra Survey, Abstract 311, from its present classification of 1F-9 to a pro- posed classification of 2F-9 Two Family Dwelling. This property is located in Foster Village, South of Fair Meadows Drive. PZ 78-13 APPROVED Request of Foster Village Joint Venture to rezone approximately 3.78 acres of land out of the John Condra Survey, Abstract 311, from its present classification of Multiple Family to a proposed calssification of 2F-9 Two Family Dwelling. This property is located in Foster Village, from Hightower at East end of Multiple Family zoning. . Mr. Jim Harris with Foster Village Joint Venture presented their requests to the Commission. He stated he would rather take all these requests together and speak on them as a whole. He passed out some plans to the Commission showing the proposed development. Mr. Wood asked what his reason was for rezoning. Mr. Harris stated the IF-9 came under the old zoning which required 9000 sq. ft. of lot while now IF-9 requires 9500 sq. ft. He said they needed smaller lots. He said that last year in Watauga they rezoned some land from Commercial to single family. The size of the lots being 6500 to 7000 sq. ft. . Mr. Harris stated the duplex zoning is real good across from the school. He said this makes a good bumper. He said their plan shows a walkway to school. He said that in rezoning, this actually decreases the density. He said 18 units per acre is normaì, but rezoning to IF-8, we get 19 units per acre. With multiple family to 2F-9 would decrease from 68 units to 42 units; 1F-9 to 1F-8 eighteen units to 26 units; 1F-9 to 1F-8 sixty units to 72 units. He said when its all added up, there is a decrease of 84 units. ~ Page 3 p & Z Minutes March 23, 1978 . Mr. Harris stated the 1F-9 came under the old zoning requiring 1500 sq. ft. floor space. He stated that if you grant the rezoning to IF-8, we would want a restriction put on it to re- quire 1500 sq. ft. floor space. He said the lots will sell for approximately $8000, the houses selling for $45,000 to $50,000. He said for a person to qualify for a loan of this amount, he would have to have an income of $25,000 per year. He said these houses will be considerably higher than in Phase I. Mr. Wood asked if there was anyone who wished to speak for or against these requests. Mr. Sam Brackett, a property owner in Foster Village stated he and other property owners would like to talk to Mr. Harris. He said they wanted to make sure there would be no tract houses. He asked Mr. Harris if he planned to honor the deed restrictions. . Mr. Harris said he was. He said they had some 400 additional acres there and they would not want to jeopardi~e its value by putting up tract houses. Mr. Wood stated that if the Commission approves this, they would make a stipulation requiring a minimum of 1500 sq. ft. floor space. Mr. Brackett stated the neighbors were interested in keeping their property from depreciating. Mr. Harris showed Mr. Brackett and the other property owners the plans, and explained that there is a demand for smaller lots, but that they would continue to build large houses. Mr. Waldrop moved, seconded by Mr. Grubb, to approve PZ 78-10 subject to the restriction of not less than 1500 sq. ft. floor space. Motion carried 3-0. PZ 78-14 APPROVED Mr. Grubb moved, seconded by Mr. Waldrop, to approve PZ 78-13. Motion carried 3-0. Request of Ramm Development Corporation to rezone Lot 1, Block 2, Carder Addition, 2nd filing, from its present classification of Commercial to a proposed classification of Commercial Special Use-Mixed Drinks. This property is located between the Bank of North Texas and Airport Freeway. Mr. Andrew Kulaga presented this request to the Commission. He stated they had already lost one restaurant because of not being able to sell mixed drinks. He said he was speaking of a three-quarters of a million dollar business. Mr. Wood asked if he was obligated to any certain restaurant. . Mr. Kulaga stated he was not, but that he has several who are interested in the property providing he can get this zoning change. Mr. Wood stated he was concerned as to the type of notice that was sent out to the property owners, since there was no mention of mixed drinks. Mr. Britton stated that there were only Steak & Ale, Furrs Cafeteria , and Bank of North Texas notified. He said that as long as it was in the Notice of Public Hearing, that was all that mattered. Mr. Britton also stated that if this rezoning is approved, any or all the businesses in this block could sell mixed drinks. Mr. Grubb stated he did not understand. . Mr. Britton showed Mr. Grubb a picture of the shopping center in question. He said there will be several businesses in the shopping center, but only one pertains to this zoning change. PZ 78-15 DENIED Request of Cambridge Companies Development Corporation to rezone approximately 3.137 acres of land out of the John C. Yates Survey, Abstract 1753, from its present classification of Industrial to a proposed classification of IF-8 One Family Dwelling. This property is located East of Rufe Snow and South of St. Louis & Southwestern Railroad Tract. PZ 78-16 DENIED Request of Cambridge Co. Dev. Corp. to rezone approximately 74.079 acres of land out of the John C. Yates Survey, Abstract 1753, from its present classification of Industrial to a proposed classification of 1F-8 One Family Dwelling. This property is located approxi- mately 3216 feet East of Rufe Snow Drive, South of the St. Louis and Southwestern Railroad. PZ 78-17 DENIED Request of Cambridge Co. Dev. Corp. to rezone approximately 24.551 acres of land out of the John C. Yates Survey, Abstract 1753, from its present classification of Agriculture to a proposed classification of IF-8 One Family Dwelling. This property is located between Yarmouth Ave. & Buckingham Trail, on Watauga- Smithfield Rd., South to the Railroad. . PZ 78-18 DENIED Request of Cambridge Co. Dev. Corp. to rezone approximately 22.291 acres of land out of the John C. Yates Survey, Abstract 1753, from its present classification of Industrial to a pro- posed classification of IF-8 One Family Dwelling. This property is located East of Rufe Snow Dr. approximately 1324 feet South of Watauga Road. PZ 78-19 DENIED Request of Cambridge Co. Dev. Corp. to rezone approximately 49.616 acres of land out of the John C. Yates Survey, Abstract 1753, from its present classification of Multiple Family to a proposed classification of IF-8 One Family Dwelling. This property is located at Watauga Rd. approximately 500 ft. East of Rufe Snow. . Mr. Bill Parsons with Cambridge Co. Dev. Corp. presented their requests to the Commission. He stated he wished to discuss these five requests as a group. He stated that Fox & Jacobs and Spies-Roberts would be doing the building. He said their IITodayll home had gone over so big ~ Page 6 P & Z Minutes March 23, 1978 . that they will want to build more of them. He said to consider the problem of the land owners. He said since there is a railroad dividing the land, the need for Industrial zoning is small. Motorola & Mark IV have approximately 60 to 70 acres. Mr. Parsons stated there is just no demand for Industrial property. Mr. Grubb stated he does not agree with him. He said he knows several Industrial businesses that are interested in the North Richland Hills area. He stated he thinks NRH is getting an abundance of small houses. Mr. Grubb stated these plans are for a lot of small houses for the City to have problems with. He asked Mr. Parsons if they would be willing to have a restriction of not less than 1500 sq. ft. floor space. . Mr. Parsons stated he did not feel they could agree with this. He said the owners are not seeking alternative ways to use this land. They feel that this planning is the best for this area. They feel there is a demand for the ItTodaylt home. He said Fox & Jacobs have proved to be cooperative and willing to meet all the standards of the City. They started on the North side of Smithfield-Watauga Road which was nothing but a weed patch. They built homes from 1232 to 1460 sq. ft. floor space, planted trees, etc. Fox & Jacobs would like to continue in NRH to build the "Today" with the addition of the larger ItFlair" & IIAccentll homes. He said the IIToday" homes are from 1232-1460 sq. ft. with a price range of $31,500 to $33,500, and the ItAccentll homes are from 1402 to 1698, with a price range of $34,950 to $38,950. So over all the houses will be from 1232 to 1698. Mr. Parsons stated he knew the Commission & the City were reluctant to have homes smaller than 1500 sq. ft. He said Fox & Jacobs will definitely build some larger IIAccentll homes, but don It know many. He said he would like to agree to the 1500 sq. ft. minimum, but this would not be advisable since there is such a demand for the "Today" home. . Mr. Grubb asked if they would agree to a 1400 sq. ft. minimum floor space. Mr. Parsons was unable to agree to this either. He said in this case you are dealing with a firm that sells in great volume. He said he ~ Page 7 P & Z Minutes March 23, 1978 . doesnlt feel there will be very many homes built under 1400 sq. ft., but he does not want them to be pinned down to the 1400 sq. ft. minimum. He said he feels that Fox & Jacobs must be allowed to have the IITodayll homes. Mr. Wood asked if there was anyone who wished to speak for or against these requests. Mr. Grubb asked if they would agree to leaving the property along the railroad Industrial. Mr. Parsons stated he did not know what they would do. He said they look at this as being a good site for residential homes. He said he would like to ask the Commission to make some form of an affirmative motion. . Mr. Wood stated he felt this area was perfect for Industrial and that since NRH has so few sites for Industrial, he thinks this should stay Industrial. Mr. Parsons stated they had done a lot of study on this project and feel this area is ideal for single family dwellings. Mr. Grubb moved, seconded by Mr. Waldrop, to deny PZ 78-15. PS 78-22 APPROVED Request of Cambridge Co. Dev. Corp. for preliminary plat of North Park Plaza. Request of Cambridge Co. Dev. Corp. for final plat of North Park Plaza. PS 78-23 APPROVED . Mr. Bill Parsons again represented Cambridge Co. Dev. Corp. in these requests. He said the preliminary is on the entire shopping center, but the final is only on a portion öf it. He ~ Page 8 P & Z Minutes March 23, 1978 . showed a plan for 55,000 sq. ft. floor space, including a Winn-Dixie and Eckard Drug in it. He said that because of financing, a portion of the land is being withheld at this time. He said the plan will be in five portions. There will be access on Watauga-Smithfield and Rufe Snow. Mr. Grubb asked Mr. Parsons if they were in agreement with the Engineer's letter. Mr. Parsons stated they were. Mr. Grubb moved, seconded by Mr. Waldrop, to approve PS 78-22 subject to the Engineer's letter. Motion carried 3-0. Mr. Waldrop moved, seconded by Mr. Grubb, to approve PS 78-23 subject to the Engineer's letter. Motion carried 3-0. PS 78-24 APPROVED Request of J. Ardis Bell of Northeast Medical Clinic for preliminary plat of Lot 2, Block A, Calloway Farms Addition. . PS 78-25 APPROVED Request of J. Ardis Bell of Northeast Medical Clinic for final plat of Lot 2, Block A, Calloway Farms Addition. Mr. David Hughes with Elliott & Hughes represented Northeast Medical Clinic. He stated they had complied with the Engineerls letter to change the name of the plat from Northeast Medical Clinic to Lot 2, Block A, Calloway Farms Addition. He said they had a clean letter from the Engineer except for the pro rata. Mr. Grubb asked if this includes the drug store and Doctor's building. Mr. Hughes stated it did not. He said this is across the street. Mr. Britton stated that Cagle Street was not a dedicated street. It is considered a private street. . Mr. Hughes stated he understood this street was included in the Federated Dept. Store tract, and have heard they were going to build this private street. ~ Page 9 p & Z Minutes March 23, 1978 . Mr. Wood asked if there was anyone who wished to speak for or against these requests. Mr. Grubb moved, seconded by Mr. Waldrop, to approve PS 78-24 subject to the Engineer1s letter. Motion carried 3-0. Mr. Grubb moved, seconded by Mr. Waldrop, to approve PS 78-25 subject to the Engineer's letter. Motion carried 3-0. PS 78-26 APPROVED Request of Vorelco Corp. for final plat of Lot 1, Block 10, Richland Heights Addition. Mr. Jim Martin with Carter and Burgess pre- sented this request to the Commission. He stated they have been working on the plat and utilities for Vorelco for some time. . Mr. Britton stated the preliminary was pre- sented last year. Mr. Wood stated he was not familiar with Vorelco Corp. Mr. Martin stated it is a Volkswagon Dealer- ship, sales and repair of Volkswagons. Mr. Britton stated there was one item that was not listed in the Engineer1s letter. It was pertaining to the escrow for future construction of Lynn Terrace. Mr. Britton asked Mr. Martin if they were in agreement with the Engineer1s letter. Mr. Martin stated they could furnish all the Engineer1s requests. Mr. Britton stated he would need these before this request goes before the City Council. Mr. Wood asked if there was anyone who wished to speak for or against this request. Mr. Grubb moved seconded by Mr. Waldrop, to approve subject to the Engineer's letter, and to include. the escrow for future construction of Lynn Terrace. Motion carried 3-0. . Page 10 P & Z Minutes March 23, 1978 . PS 78-27 APPROVED Request of Engleman, Baker, and Hamm for preliminary plat of Lots 2 & 3, Block 1, Carder Addition. PS 78-28 APPROVED Request of Engleman, Baker, and Hamm for final plat of Lots 2 & 3, Block 1, Carder Add. . Mr. O.D. Long, Engineer, presented these requests to the Commission. He said he wasn1t aware of it at first, but in checking, there is a sewer line and man hole already there. He said they would put an easement between lots 2 & 3. He stated they first started to have this as 4 lots. There would have been 30 feet of unusable land. So after talking with the City, they decided to put it in 2 lots giving lot 2 the right to use this strip(Mr. Long pointed out on the plat) for one year with the stipulation they improve it. But if they do not, they will not get to use it. They need this to have access to their lot from the back. They feel that in time Deseree Street will become One-way. In other words, they will be buying the right to go across this lot. Mr. Long stated since there is already a sewer, there will not have to be a sewer line pro rata if they use their own. The bank shared in the improvement of Deseree. The bank ran this water line up to the back of this tract, and also the sewer stub-outs. Mr. Long stated he would get with Mr. Bronstad about this. Mr. Waldrop moved, seconded by Mr. Grubb, to approve PS 78-27 subject to the Engineer1s letter. Motion carried 3-0. Mr. Grubb moved, seconded by Mr. Waldrop, to approve PS 78-28 subject to the Engineer1s letter. Motion carried 3-0. ADJOURNMENT Mr. Grubb moved, seconded by Mr. Waldrop, to adjourn at 9:00 P.M.
