The regular Iœeting of the Plarming and Zoning
Cœmission was called to order by the Chairrran,
Mary Jo Shaunty at 7: 33 P.M.

The Chairman stated they were unable to approve
the m±nutes because there was not enough present
that was present at the June 22 meeting for a
quorum.
The Chairman appointed Claude ~rrison to act
as Secretary.
The Chairman swore in the new members, Warren
Eckhardt & Arthur Murnan.
Request of John McNary to rezone approximately
8.48 acres of land out of the S. Richardson
Survey, Abstract 1266, Tract llA, from the
present classification of Agriculture to a pro-
posed classification of IF-8 with a stipulation
that the mini.rm.mL living area shall be 1500 sq.
feet. This property is located approximately
556 ft. south of Oak Ridge Lane on Davis Blvd.
Mr. John McNary, 1105 Overhill, Bedford, Tex.,
presented this request to the Conmission. He
stated he proposed to put a street dovvn the
middle of the property and have lots on both
sides; the lots being approximately 200 X 85 ft.
Mrs. Shaunty asked where did the dead-end street
go.
Mr. McNary stated it went into the park.
The Chairrran asked if there was anyone who wished
to speak for this request.

The Chairrran asked if there was anyone who
wished to speak in opposition of this request.
Mr. John Byarly, 8537 Oak Ridge Lane, East of
the property in question, stated he and a
neighbor, Mr. Rowman, were opposed to the dead-
end street. He stated it would give another
entrance to the park and make ItDre traffic. Mr.
Byarly stated he would not object to the plan if
they would put a cul-de-sac in and have 3/4 acre
lots and build hoIœs that are 2000 sq. ft. floor
space.
Mr. Ted Park, Surveyor, stated they could make
the necessary changes to have a cul-de-sac.
Mr. McNary stated that Oak Ridge Lane is a part
of this tract of land, but since the street is not
up to standards, the City doesn't want it. He
stated they need to knarl what to do about the
street; whether to make it a street or a part of
this developrrent. He said - if they didn't put a
street down the middle of the property, the lots
would be 400 ft. deep and would not be practical.

Mr. C.W. Rowman stated wehen he purchased the
land, he was told by the Realtor that the land
would be developed into 2 acre tracts and be left
"Country" . Mr. Rowman stated since North Richland
has a water shortage, we don't need 16 m:>re houses.
He said he bought and built his house at the back -
of his property so as to be secluded. He stated
he was also told there would be only one - entrance
into the park. Mr. Rowman stated he would have no
objection if Mr. McNary would have one acre tracts
and build 2000 sq. ft. homes. He also stated there
was no way this land would hold the percolation
test.
Mr. McNary stated he plans to put in the sewer,
himself.
Mr. Bri tton stated that Oak Ridge Lane is not a
designated street, but it has been in use for
years and has had public funds used on it, so
this might make it become public property.
Mr. Rowman stated this is the only entrance to his
property .

Mrs Shaunty asked Mr. Rowman if he checked with
the City to see about future plans for property
and streets in this area before he bought his
property.
Mr. Rowman stated he only talked to the Realtor.

Mrs. Byarly stated they did check with the City
before they bought. She stated the reason they
bought there was so they could have privacy.
She said wi th 5 children, they wanted out where
there wouldn't be a lot of traffic. She stated
they did not want a thoroughfare. She said she
was told it was only built for construction
pur¡;oses.
Mr. Britton stated the park will not be developed
until the subdivision on Rumfield Road is developed.
Mrs. Byarly stated they would not have bought out
there if she had known they would put these houses
and streets in.
Mr. McNary stated he would like to give Oak Ridge
Lane to the Byarlys if they want "it. and that he
would consider changing his plan to include a
cul-de-sac.
Mr. Murnan asked if the state would allow another
entrance on to Davis Blvd.

Mr. Britton stated the highway depa.rtIœnt would
allow another street entrance on Davis. He told
the Byarlys that if Mr. McNary gives them this
street, it would be theirs forever to ma.intain.
He stated he would not like to be saddled with a
private road when he could get a city street and
have it maintained free of charge.
Mr. Rowman stated he had problems last surrmer
when he was building his house, trying to get in
and out of his property. He stated people coming
to ball practice at the park would park and
block his entrance to his property. He stated
he would have to ask them to Irove so he could
get out.
Mr. Park stated he was not sure the street could
be deeded to anyone person.
The chairrran stated all this discussion has
nothing to do with the rezoning of this property.
It pertains to the platting of it.

Mr. Austin Yeates with Kimbell, Inc. presented
this request for replat. He stated the pur¡;ose
for the replat is to rem::xìel the existing
building and build across the building line.

the Engineer's comments.
Mr. Yeates stated he was, and that· there was no
problem.

Mr. John Levitt with Levitt engineers presented
these requests. He stated they would extend the
water mains down Bedford-Euless Road and the
sewer to the rear. He also stated they would
agree to changing the subdivision naItE.
Mr. Murnan asked if the required fire hydrants
would be installed.

Mr. Levitt stated they would be installed to
Cornnercial standards.

this request. He stated this was previously Ma
and Pa' s Grocery. He stated after they ItDved
down the street, the owners wished to lease the
property again, but found they needed to get it
platted before this could be done.
Mrs. Shaunty asked Mr. Levi tt if they agreed
wi th all the engineer's comnents.
Mr. Levitt stated he could seé no problem.

Mr. o. D. '" IDng, Consul ting Engineer, represented
Tarrant Real Estate Developrœnt Corp. He stated
he had talked to the engineer regarding #5 of
the engineer's letter regarding using cast iron
sewer pipe. He said they wish to use PVC pipe
to keep the continui ty of the line and the
engineer agreed. Mr. lDng stated. he is working
on chanel location item #7. He stated he went
to Austin last week in regard to this. Mr .
IDng stated they do not take issue to the
engineer's letter.

Mr. Bri tton asked Mr. IDng if he was aware that
this could not go before the Ci ty Council until
all this is cleared up.
Mr. Long stated he felt eve:rything would be
cleared up by MJnday.

Plat Records, be abandoned.

Mr. Barney Ballard represented Sabine Valley in
their requests. He stated they had relocated.

Mr. Ballard stated they would like to request
they not be required to enter the elevations on
the plat since the foundations are already poured..
He said if they put the elevations on the plat,
they are afraid the Irortgage cœ1pany might want
proof and would hinder the sale of the property.

Mr. Gary Neisler presented this request to the
Cœmission. He stated he needs to make two
lots into one so he can build a house on it.
Mrs. Shaunty asked Mr. Neisler if all the
engineer's comœnts were Iœt.
Mr. Neisler stated they had been.
The chairman asked if there was anyone who
wished to speak for or against this request.
Mr. Murnan IOOved, seconded by Mr. Eckhardt, to
approve PS 78-57. Motion carried 4-0.

Request of Dr. Charles Rush for preliminary plat
of Lots 4 & 5, Block A, Callarlay Fanns Addition.
Request of Dr. Charles Rush for final plat of
Lot 4, Block A, Calloway Farms Addition.
Mr. Wal ter Elliott with Elliott & Hughes Eng.
represented Dr. Rush in his requests. He
stated they are in concurrence with all the
i terns mentioned in the engineer's letter and
therefore request approval.

to approve PS 78-59 subject tò the engineer's
letter. Motion carried 4-0.
PS 78-60
APPROVED
Request of Northeast Construction Co. for final
plat of Holiday West Addition, Section II.
Mr. O.D. Long represented Northeast Construction
Co. He stated in regard to the engineer's
conment about drainage - it can go down the street
right-of-way. He also stated they wish to open-
cut Holiday Lane for the 36' stonn drain and the
12" water pipe.
Mr. Eckhardt asked how long they \\Ould have to
have the street closed.
Mr. IDng stated 3 or 4 hours. He stated Holiday
Lane was improved before they had stonn savers
and this system will take the flow of water off
it.
Mr. Britton stated the City could work with them
on the street cut.

Mr. Long stated the developer will pay the pro-
rata. He said about #9-there is a fence row
that has fonned a bunn and the owners are con-
cerned that we not create anyrrore problems for
than. He said they feel they will be able to
-work this out. Mr. IDng stated they do not
take issue with the other items in the engineer's
letter. He read a letter from Mr. Alan Harnn to
Mr. Britton: "Dear Ray, Mr. Doug IDng, Consult-
ing engineer, has recently submitted the final
plat & Construction plans for Holiday West,
Section 2 & they are currently under consider-
ation by you & your staff. In accordance with
established ordinance & developer policy, we
respectfully request city participation in the
following street & utility improverrents: 1.
WATER: Difference in 6" & 12" line, Meadow Pk.
Blvd., Sect. 1, to Trinidad Dr. in Section 2
(along Holiday Lane & Jamaca Circle) app:roximately
2,067 linear feet. 2. WATER: Difference in 6" & 8"
line in Trinidad from Holiday Lane to Mobil Pipe-
line, approximately 705 linear ft. 3. SEWER:

of Blocks 2, 3 & 4, Northridge Addition.
Request of Sandlin HOIœs, Inc. to abandon the
existing street Right-of-Ways and Easerœnts in the
Northridge Mdition.
Mr. Gordon Swift , Consulting Engineer, presented
these requests. He stated the preliminary was "
app:roved in April regarding 1. pro-rata, 2.
extension of water to Davis, 3. cleanouts, 4. pro
rata charge, & 5. location of fire hydrants. He
said since all these were approved on the pre-
liminary, they request you strike out #lO of
the engineer's letter of July 8. He stated all
the other corrrnents can be taken care of.
Mr. Murnan asked if they were in agreement with
#5. "The mini.rm.mL recornœnded curve for a sewer
line is 100 ft. Therefore, we would reconmend
a change in the design of the sewer line at the
intersection of Lynda Lane & Colorado Bl vd. "
Mr. Swift stated they would get with the engineer
and see what he reccmœnds and do likewise.
Mr. Britton asked if they can get all the corrments
corrected by the time it goes to the City Council
rreeting August 14.
Mr. Swift stated he felt they could.

Request of William F. Farha for preliminary plat
of IDt 1, Block 1, North Edgley Addition, 2nd
filing.
Mr. John Levitt, Levitt Engineers, presented
this request. He stated they have received a
copy of the engineer's letter and do take issue
on #3 regarding an additional fire hydrant at the
northwest corner of this property. He stated
they will place fire hydrants 300 ft. which is the
State requirerrent. He said the fire hydrant he is
requesting is at the back of the property.

Mr. Gary Teague represented Pioneer Oil Co. in
their request. He stated they received the
engineer's letter and they do take issue. He
said this particular piece of p:roperty has an
existing service station on it. The station
was closed down & the utili ties were turned off.
When the property was leased again, we found in
order to get the utili ties turned on agàin, we
had to cartply with City regualtions to plat the
property. He stated #1. We will agree to
change the subdivision name; 2. Wedo not
feel we should have to pay the pro-rata since
nothing will be changed. # . Mr Teague showed
the Cœmission where the fire hydrants are
located. He stated they are slightly short of
the City regulations, but it does cartply with
the State regulations.
Mr. Murnan asked how far off it was.
Mr. Teague stated it was 80 feet short. Mr.
Teague stated that they did not feel they should
have to have a percolation test run since there
have been no problems with the septic tank. Mr.
Teague stated there is no problem with #5 or #6.
Mr. Teague stated his client does not feel he
should have to sign a covenant to agree
to pay for curb & gutter & drainage facilities.
He said if in later years, the land developes,
then they would pay.
Mr. Britton stated that if the City Council
wishes to deviate f:rom the engineer's letter

Lots lR, 2, 3, 4, 5, 6, & 7.
Mr. Stephen Rice Civil Engineer for Herrran Blum
Engineers, represented Federated Stores in their
request for a replat. He stated the reason for this
is the property is being subdivided for different
CMnership. He said they want to add a Mall. There
will be four CMners.
Mr. Bri tton stated Block A would have to be
changed to Block C as there is already a Block A
recorded.
The chai:rman asked if there was anyone who wished
to speak for or against this request.
Mr. Eckhardt ItDved, seconded by Mr. Murnan, to
approve PS 78-67. Þbtion carried 4-0.
Request of Federated Stores for preliminary plat
of Calloway Fanns Addi tion.
Request of Federated Stores for final plat of
Calloway Fanns Addition., Block B.
Mr. Stephen Rice represented Federated Stores
in thèse requests. He stated they received two
letters fran the engineer, one on July 12, and
one on July 14. He asked if they would be
required to put this ItDney in escrow nCM.
Mr. Britton stated there is a requirement on
Grapevine Highway to Rufe Snow.
Mr. Jan Porter stated he was not in a position
to answer, but if this is a City Council policy,
then they would have to pay it.
Mr. Britton stated he would get with them and
work this out later.

Mr. Rice stated they would take exception to #2
regarding concrete headwalls. Since this is a
temporary deal, we should not be required to
construct this.
Mr. Britton stated he felt the engineer would
agree to this.
Mr. Rice stated #3 is the same and #2, only on
the other end and that #4 has already been
changed.
The chairrran asked if there was anyone who wished
to speak for or against these requests.
Mr. Morrison IIDved, seconded by Mr. Murnan, to
approve PS 78-65 subject to the engineers
letter. Motion carried 4-0.
