E. Loop 820, THURSDAY, JANUARY 27, 1977 The regular meeting of the Planning and Zoning Commission was called to order by the Chairman, Mary Jo Shaunty at 7:30 P.M. Britton Pauline Spain Barbara Sells Mr. Biard moved, seconded by Mr. Wood to approve the minutes as written. Motion carried 4-0. Mr. Range commended the City Staff on the thoroughness and detail of the minutes. Request of Smithfield Properties to rezone Block 1, Lot 1, and the East 186 feet of Lot 2, Block K in Smithfield Addition from its present classific- tion of Commercial to a proposed classification of Industrial. This property is located at 6608 Davis Blvd. Mr. J. E. Box, one of the four owners of the pro- perty, presented this request. Mr. Box introduced Mr. Jody Williams of the Chromalloy Chemical Company. Mr. Box stated they have one tenant other than Chromalloy and anticipate more. This will provide more tax revenue to the City of North Richland Hills. Mr. Box stated the company planned to bring the chemical in by rail for packaging and storing at this location. We feel this is a good potential for the 13,000 square foot building. Mr. Britton asked Mr. Box if they planned to use hopper cars to silos ~r unloading. Mr. Box answered, p~bably so. Mr. Britton then sa i d II it wi 11 be packaged out- sidell. Mr. Wood asked IIwhat is dry soda ash, what is it used for, will it cause dust, pollution, etc. II? Mr. Box answered he did not know. The gentlemen who would know had another meeting he had to attend this evening. Mr. Wood stated lIif I were a resident in this area I would want to know more about it. What is stored in them? Mr. Box answered, liquid chemical but I don It know anything about it. It is not manufactured at this location. Mr. L. L. Hill - 3108 Dreeben I would like to know the type of filtering to be used and the possibility of explosives. Mr. Box nor Mr. Williams could answer. Mr. H. T. Worthington - 6701 Davis Blvd. Since the business is presently at this location why the change in zoning? Mr. Britton explained the reason is the hair- line difference between commercial and industrial zoning for this type of business. Mr. Worthington then stated "Since I live across the street, I object". . A property owner in the audience said "I would like to see the commission investigate this further before making a recommendation to the council II. Other property owners in the audience were interested in the odor, polution and chance of explosives. Mr. Wood moved, seconded by Mr. Biard to table this request until the February 24 meeting for further investigation. Motion carried 4-0. Mrs. Shaunty told the property owners in the audience they would not receive another letter. PZ 77-2 APPROVED Request of Tomanet Corp. to rezone 33.05 acres out of the W. W. Wallace Survey, Abstract 1606, from its present classification of Agriculture to a proposed classification of 1F-8 One Family Dwelling. This property is contiguous to Emerald Hills Addition and south of La Casita Mobile Home Pa rk . . Mr. Emil C. Friewald - Farrington & Assoc. Mr. R. N. Horton is the potential buyer of this property, contingent on zoning. We have prepared a preliminary sketch of the area. The lots may vary 2 or 3 either way. We have discussed the sewer with Mr. Bill Harvey and he will grant a utility easement. Mrs. Shaunty asked the square footage of the houses? The minimum in 1F-8 zoning is 1200 square feet. Mr. Friewald said Mr. Horton has been building houses in Bedford and he felt the houses would be from 1200 to 1400 square feet. We Page 3 P & Z Minutes January 27, 1977 . Mr. Britton informed Mr. Friewald the city would have to have a dedicated right of way between the TESCO ease- ment and Mockingbird Lane. There was much discussion about the type of houses to be built and current drainage problems; however all pro- perty owners felt this would be better than the current situation. Mr. Range moved, seconded by Mr. Biard to approve PZ 77-2. Motion carried 4-0. Request of Thomas A. Jones for preliminary and final plat of Lot 13 & 14, Block 11, Smithfield Acres, 3rd filing. Mr. George Staples-Attorney Mr. Jones purchased this property in April of 1974. He later moved to Houston and tried to sell this property. A client came in last year for a building permit and it was denied as the property had to be platted and he felt it would be too expensive. Mr. Jones came from Houston. He said the improvements on the property were more than the price of the lots. He understands the pro rata cost of water and sewer facilities but he would like the monies for the future development of Turner Drive to be waived. Mr. Biard and Mrs. Shaunty stated they could not understand this escrow for the street when the street is already there. After much discussion by the commission members Mr. Range moved, seconded by Mr. Biard to approve PS 77-1 subject to engineers letter with the pro- vision item #1 be waived. Motion carried 4-0. Request of Richland Enterprises, Inc. for final plat of Richland Terrace, 6th filing. J. B. Sandlin - Richland Enterprises We have no particular plans at this time. We have owned the property for a number of years and decided to develop the property for commercial use. We may speculate and build a few buildings. Our office building is near and we have built an office building on Davis Blvd. Mrs. Shaunty asked if a fence would be installed. Mr. Sandlin stated a fence would be built in accordance with the zoning ordinance. Mr. Biard said it will be good to get this eye sore fix- ed up. It has been used as a dump ground for some time. Mr. Long told the commission his clients knew they must have the approval from the state highway department for ingress and egress to Davis Blvd. Our ~ Page 4 P & Z Minutes January 27, 1977 . PS 77-2 APPROVED main concern is the pro-rata charge for sewer and water lines across the property. Mr. Macatee developed this property a number of years ago and paid the water and sewer charges at that time. Allan Hamm purchased the property from Mr. Macatee and we feel these charges were included in the selling price. If we are charged again we feel like we would be paying twice. Since these lines are running across our property we feel like they belong to us. We cannot possibly develop this property with the added $7,000 for water and sewer on Commercial Drive. Mrs. Shaunty asked Mr. Britton if the Commission could act on this type of request. Mr. Britton said the Commission would be receiving letters from him and Mr. Bronstad pertaining to the engineer's letter with each final plat. The Commission can approve subject to the engineer's letter. PS 77-3 APPROVED Mr. Wood moved to approve PS 77-2 subject to the engineers letter. Mr. Range moved, seconded by Mr. Biard to approve PS 77-2 subject to engineer's letter with the provision that the charge for existing water and sewer line be waived. Mr. Wood withdrew his original motion. The motion as presented by Mr. Range carried 3-0 with Mr. Wood abstaining. Request of the Browning Co. for replat of Lots 21 & 22, Block 1, Diamond Loch Addition. . Mr. Robert Browning told the Commission he wanted to replat these two lots into one in order to build a $150,000 home. There was no objection from any utility company. Mr. Biard moved, seconded by Mr. Range to approve PS 77-3. Motion carried 4-0. PS 73-20 APPROVED Request of Owen D. Long for time extension on the final plat of Fox Hollow Addition. . Mr. Long told the Commission Ray is trying to update the zoning map and he called and asked if I wanted to record Fox Hollow Addition final plat. I platted this IF-7 in 1973 and placed monies in escrow to the St. Louis Southwestern Railroad for improvements across the railroad tracks at Fox Hollow Drive. The crossties are already put in. I later decided this would be good industrial property and had it rezoned in 1974. I want to record this plat before another developer comes through and changes the crossing at ~ Page 5 P & Z Minutes January 27, 1977 . PS 73-20 APPROVED the railroad. If this should happen I may have to meet their crossing and lose my escrow monies. Fox & Jacobs may want to develop this area rather than have industrial zoning so near their property. At the present time there is no market for large industrial tracts. I could sell 1/2 acre tracts but this would not be good. I feel before we can use this property we will be back for rezoning or re- platting. Mr. Britton asked Mr. Long, lIyou will not attempt to use final plat construction plans as industrial usell? Mr. Long said with modification. After discussion by the Commission members Mr. Range moved, seconded by Mr. Wood to grant time extension on Plat PS 73-20 with the stipulation that the construction plans for residential develop- ment not be used in industrial zoning area. Motion carried 4-0. APPOINTMENT TO FEBRUARY 14 & 28 COUNCIL MEETINGS ADJOURNMENT Mr. Range will attend the February 14th meeting. Mr. Wood will attend the February 28th meeting.
