CALL TO ORDER ROLL CALL CONSIDERATION OF MINUTES OF May 26, 1977 NEW BUSINESS PZ 77-19 DENIED ~ MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, JUNE 23, 1977, 7:30 p.m. The regular meeting of the Planning and Zoning Commission was called to order by the Vice Chairman Darrell Wood at 7:37 P.M. PRESENT: Vice Chairman Secretary Members Darrell Wood Lee ~~a 1 drop Forrest Grubb Claude Morrison CITY STAFF: Dir. of Pub. Works P. W. Clerk Ray H. Britton Pauline Spain ABSENT: Mary Jo Shaunty Mr. Grubb moved, seconded by Mr. Waldrop to approve the minutes as written. Motion carried 3-0. Request of Charles D. Reynolds to rezone 1.76 acres of the E. S. Carder Survey, Abstract 308, Tract 3B 2B from a classification of IF-12 to a proposed classification of Local Retail. This property located between the Steak and Ale and Woodcrest Addition fronting the Airport Freeway Access Road. Mr. Charles Reynolds of Dallas presented this request. Mr. Reynolds stated he had changed the acreage from 4.13 acres to 1.76 acres. Mr. Reynolds assured the board if the request was granted nothing other than a Furr's Restaurant would be built in this area. The building would be white brick, the same as the Bank of Texas. The dumpster would be completely enclosed by white brick. There would be no parking on the east side of the building. There would be a screening fence along the east of the property. If this request is approved and the building is not started in six months the zoning will revert to IF-12. The lights in the parking lot will not effect the residential area as they will light only the parking area. Mr. Wood asked if there was any opposition. Mr. David Cates 4900 Wondol Court Mr. Reynolds came in two months ago for zoning change. Mr. Reynolds at that time agreed to meet with the property owners with a Planned Development Plan. He has failed to do so and now he is back again with the same zoning. It can effect the value of our 1 . June 23, 1977 Page 2 property and be a nuisance. We are opposed; we totally object. r~r. L. F. Cumbie, 4825 Weyland Drive I would like to ask Mr. Reynolds specifically what he has done with this opposition. Mr. Cumbie and Mr. Reynolds said he would come back with a Planned Development and now he is back with the same thing. . Mr. Reynolds stated he would like to clear the situation up. I havn't promised anyone anything. It is basically, totally nonfeasable to come in with Planned Development. I cannot tell you what will be in the balance of the property at a later date. You have more control over the property the way it is being handled tonight. Each time a new business is desired, you will be notified as you were at this time and you will have the same opportunity to oppose. Mr. Reynolds told the commission he had met with Mr. Massey explaining the non-feasability of Planned Development and his plans for zoning for the Furr's restaurant only. Hr. Reynolds said Mr. Massey understood. Mr. Wood requested a recess at 7:50 in order for the minutes of April 28, to be brought to the meeting. The meeting was called to order at 7:55 p.m. Mr. Wood read the minutes of April 28, concerning the Planned Development. Mr. Gates, Mr. Cumbie, and several people in the audience said Mr. Massey did not represent the home- owners. . Mr. John Erskine, 4812 Weyland Drive Mr. Erskine said he was not notified of this meeting. The Board explained it was because he was not within 200 feet of the property in question. How can Mr. Reynolds ask for Local Retail? Is a Cafeteria in Local Retail Zoning? I hate to see it zoned Local Retail. It could be used for most anything. Mr. Grubb told Mr. Erskine that Local Retail is about the most restrictive zoning. Mr. Erskine asserted his opposition to this zoning request. ~ . June 23, 1977 Page 3 Mr. Sonny Hussey, 4901 Weyland I recently moved to this area and have been briefed on the subject. I think if Mr. Reynolds would meet with the property owners so we could ask and clear up questions it would be a great help. Mr. Wood informed Mr. Hussey that was the reason for this hearing. . Mr. Vernon With, 4816 Weyland I would like to ask Mr. Reynolds what he would like on the balance of the property. He has come back with more restricted plan but we are interested in the whole piece of property. We would hate to see anything go in there that would depreciate his property as well as ours. We were told he would put in doctors offices and a boutique. He has done nothing. Mr. Wood· reminded Mr. With, before anything could be done with the balance of the property Mr. Reynolds would have to come before the Board again. Mr. Wood asked if he opposed this proposed zoning request and if so why. Mr. With answered the traffic pattern, pattern of development and besides we were assured it would be developed as residential. . Mr. C. R. French, 4801 Weyland In 1966 the City Master Plan proposed IF-12 zoning for this area. Why can't houses be built? Why consider zoning change? The City Council said it would never change. If you approve this request Mr. Reynolds could come back and ask for more Local Retail. Anyone in their right mind would not deny it. Mr. Grubb took offense to this. He assured Mr. French the Board Members were in their right mind and before they approved more zoning change there would be much thought and consideration given. Mr. Wood asked Mr. Gates to come forward. Mr. Grubb asked him if he was appointed to represent the property owners. Mr. Gates replied, yes. He ask the property owners the same. Their reply was yes. Mr. Grubb ask Mr. Gates if he felt this area would sooner or later become Local Retail. Mr. Gates replied yes, but! Mr. Grubb asked if the plan brought before them was not the same as the Planned Development. Mr. Gates answered we are not interested in anything other than a Planned Development of the entire area. "1 . June 23, 1977 Page 4 Mr. Wood asked Mr. Reynolds if he would like to answer any questions. Mr. Reynolds stated he purchased this tract of land and intended to ask for rezoning of the entire tract. After much thought and study decided to develop only the area for Furr's Cafeteria and small retail. This did not please the people so after much study and expense I came back with this proposal. What I have planned is really Planned Development in separate stages. I will sign a document that this area in question is for Furr1s Cafeteria only and it will be started within six months or the tract of land will revert to IF-12. . Diane M. Bradford, 4921 Weyland I spoke to Mr. Reynolds after the previous hearing. I was opposed to this at that time. I live at the corner of Weyland and the access road. When we moved there nine years ago we tried to buy a small piece of land out of this tract. It was priced so high at that time we could not afford it. One could see what they had in mind even at that time. One purpose and one purpose only, to develop as commercial property. We paid $3,500.00 for our lot at that time and that was cheap considering our house is valued at $70,000.00 on todays market. Mr. Wood closed the hearing and the Board discussed the request. After much discussion, Mr. Wood asked Mr. Gayles to come forward. Mr. Gayles, Mr. Reynolds and the Board discussed the traffic problem. Mr. Reynolds stated the property behind the bank will soon be developed. When the area is developed I will dedicate a street for their use, the Banks use and the use of Furr1s Cafeteria. This will take traffic to Bedford Euless Road. *every property owner Mr. Marion Massey, 4916 Weyland Mr. Massey came in late and started giving his opposition. Mr. Grubb explained to Mr. r~assey it would be zoned and developed one plan at a time. Mr. Massey replied, we want it as a package so we can fight it as a package. Mr. Wood told Mr. Massey*every one felt the same as he did and the Board was ready to act. Mr. Grubb moved to grant this request with the stipulation the document regarding Furr's occupancy only and the six month building time limit be signed by Mr. Reynolds before sending PZ 77-19 to the Council. Due to no second Mr. Grubb withdrew his motion. Mr. Morrison moved, seconded by Mr. Waldrop to deny PZ 77-19. Motion carried 2-1 Mr. Grubb voting against. . ~ June 23, 1977 Page 5 . t-1r. Grubb explained to the property owners why he voted for this request. Mr. Grubb felt that the way Mr. Reynolds was asking for this rezoning was as near Planned Development as possible. He also felt Mr. Reynolds should be allowed to be heard by the City Council. PS 77-18 APPROVED Request of O. N. Mitchell, Jr. for a preliminary and final plat of Bryan Plaza. Mr. O.D.Long, Consulting Engineer, presented this request. Mr. Long stated there were no problems with the engineer·s letter. Items Number 1,2 and 4 have been completed and the developer has a contractor lined up to complete item Number 3. PS 77-19 APPROVED Mr. Grubb moved, seconded by Mr. Morrison to approve PS 77-18. Motion carried 3-0 Request of Foster Village Joint Venture for final plat of Foster Village, Section 8. Mr. 0.0. Long and Mr. Harris, Foster Finance presented this request. . Mr. Long referred to the engineer·s letter. #1. No Problem. #2. The property to the east will be developed soon. We will get a letter of permission from the developers and work together with them on this problem as they will pick up later. #3. ~1y cl i ent and I understand there will be no change. #4. I failed to put the size on the plat: however, it will be an 811 line. #5. Have put on construction plans. #6. We feel Windcrest Addition will be developed soon. We are extending the storm drain 10· into this addition. It will be less expensive and easier for them to tie on to the drain without a headwall. A headwall will be built if the property is not developed within 5 or 6 months. . #7. This was overlooked on the map. #8. My client objects to this. I talked him into 8· wide gutters, now the engineer wants 10· qutters. There is no ordinance stating it shoul d be 10·. . PS 77-20 APPROVED . . ~ June 23, 1977 Page 6 After discussion by the Commission, Mr. Waldrop moved, seconded by Mr. Grubb to approve PS 77-19. Motion carried 3-0. Request of Northeast Construction Company for a final plat of Holiday West Addition. This property is located north of Texas Electric right-of-way. Mr. Long and Mr. Sandlin presented this request. Mr. Long commented on the engineer's letter. #1. I did not handle the zoning of this property and I did not know minimum square footage was required on the final plat. #2. My client is aware of the escrow fee. #3. We have no objections to Item #3. #4. Building line of Lot 1, Block 11, will be added to the plat. Mr. Sandlin objected to the 25' side building line on Lot 5, Block 10. Mr. Britton stated they would have to face opposite directions. #5. Metes and bonds have been added to the original. #6. Added to the original. #7. Sunny Meadow has been change to Spring Meadow. #8. Is reminded to the Council to look into this matter. #9. Should note 10' apart. #10. Valve is at either side of of Meadow Crest. #11. We intend to bore under the street. #12. Will put another manhole in if Mr. Bronstad doesn't waive 595 linear feet. #14. Mr. Sandlin asked the zoning of the property to the North. Mr. Britton said IIIndustrial" Mr. Sandlin asked if it would be wise to have three streets going into an industrial tract. I would like to close 2 streets. Mr. Long stated they could come back with a replat or go before the City Council to waive the streets therefore eliminating need for box culvert. #15. Mr. Long explained the possibility of a bad erosion problem by adhering to item #15. . . . PS 77-21 APPROVED ADJOURNMENT (, 1 June 23, 1977 Page 7 After discussion by the Commission Members Mr. Morrison moved, seconded by Mr. Waldrop to approve PS 77-20. Motion carried 3-0. Request of P & S Construction Company for a preliminary plat of Irish Meadows Addition. This property is located east of Emerald Hills Addition. Mr. O. D. Long and John Parish presented this request. Mr. Long referred to engineer1s letter. #1 and #2. Not needed on the preliminary plat in the past. #3. There are four owners involved in this drainage plan. Emerald Hills 2nd Addition, City, School and P & S Construction Company. I am representing the School and P and S. Construction. #4. My client has no objections to this item. #5. No problem. #6. Will Cover. #7. Master Plan shows Emerald Hills Way as a thoroughfare. Mr. Parish stated as a past school administrator, I hate to see two thoroughfares on two sides of a school. I take exception to the 60' street. It is residential and not going anywhere. Mr. Britton stated the Master Plan showed it to go into Newman off Harwood Road. After discussion by the Commission members, Mr. Grubb moved, seconded by Mr. Morrison to approve PS 77-21. Motion carried 3-0.
