MINUTES OF THE REGUlAR MEETING OF THE PlANNING
AND ZONING COMMISSION OF THE CITY OF NORTH
RICHLAND HILLS, TEXAS OCTOBER 27, 1977, 7:30 P.M.
The regular meeting of the Planning and Zoning
Corrrnission was called to order at 7:50 P.M. by
the Vice Chainman, Darrell Woods.

Mr. Grubb moved, seconded by Mr. Waldrop to
approve the minutes as read. Motion carried
2-0 with Darrell Woods abstaining since he was
not present at the September meeting.
Request of E.F. Abbott to rezone Tract 9B1, 9BlA,
and 9B2, Abstract 130, J .H. Barlough Survey, from
its present classification of Local Retail to a
proposed classification of Cormnercial. This
triangular tract of land is located at Ross Road,
Davis Blvd., and College Circle.
Mr. E.F. Abbott presented his request to the
Corrrnission.
Mr. Grubb told Mr. Abbott that the change of the
Zoning Ordinance that was discussed at our last
Planning and Zoning meeting has not as yet been
approved by the City Council. He said he would
suggest whoever purchases the property be requested
to get a special use permit as might be required.
Mr. Abbott stated he would cooperate any way he
could.
Mr. Waldrop moved, seconded by Mr. Grubb to approve.
Motion carried 3-0.
Request of Stanley Tatarevich to rezone approximately
0.743 acres of land of the J.M. Crockett Survey,
Tracts 1G1 and 1G2, Abstract 273, from its present
classification of Agriculture to a proposed classi-
fication of Local Retail. This property is located
South of Smithfield Elementary School and West of

Smithfield Cemetery.
Mr. Stanley Tatarevich presented his request to
the Corrrnis s ion . He stated the reason he wants
this rezoning is these 2 tracts of land need to
be put into 1 tract so there would be access to
the back. He said if he sold one tract, there
would be no way to get to the other tract. Also
these tracts have been zoned Agriculture all
along, but have been used as Local Retail for
approximately 27 years.
Mr. Waldrop asked Mr. Tatarevich if he has plans
to build on the property.
Mr. Tatarevich stated he had previously thought
about it, but now he said he probably will try to
sell it.
Mr. Grubb moved, seconded by Mr. Waldrop to approve.
Motion carried 3-0.

Request of J.D. Scott to rezone Lot 1, North Edgley
Addition, and Lot 13A, Block 11, North Richland
Hills Addition from its present classification of
Local Retail to a proposed classification of
Cormnercial.

Tormny Thompson, Cormnercial Realtor, represented
American Petrofina. He stated he had Mr. J.D.
Scott and Mr. J. D. Brown with him tonight. Mr.
Scott is the prospective buyer of the property
in question, and Mr. Brown is Mr. Thompson's
Associate. Mr. Thompson stated that American
Petrofina was selling several pieces of their
unsightly properties over the metroplex, and this
was one that they wern' t too proud of since it is
such an e~"'e-sore. At one time this property was
Cormnercial, but the owner didn't comply with the
regulations so it is now Local Retail. Mr. Thompson
stated that American Petrofina has a contract with
Mr. Scott to sell this property to be used as a
new car air conditioning installation service. Mr.
Scott has a thriving business in Arlington as
Day's Auto Supply, which the name does not correspond
with the business he is in. He has an exclusive
business of installing air conditioners in new
autos. His first business purchase was on East
Abram in 1973. Mr. Thompson stated that Mr. Scott
will refurbish the existing building and add to it.
He will have stalls for the cars and all cars parked
on the property would be on hard surface. They
would have to be kept clean since they are new
cars. Mr. Thompson said this would be Inade a much
nicer piece of property than what it is now. He
said he had had numerous calls from people wanting
to buy this property, but American Petrofina had
turned them down since they had illlderstood that the

Mr. H.L. Hughes stated he was a pioneer of North
Richland Hills and that that piece of property
had always been a rat den. He said he couldn't
understand why they wanted to change the zoning
on this one lot. He said he didn't believe
this type of business would help his area.

Mary Dodson, another neighbor, stated she just
bought her home in June. She said if these
businesses are surposed to put up a 6 foot fence,
why haven't they, and who is responsible to see
that they do.
Mr. Grubb stated that we want to keep our ci tJ
clean and we would like to get that corner cleaned
up. This property has come up for rezoning before,
but it has never passed. We have given the owners
several citations.
Mr. Wood said that the new businesses in our area
are not the ones that give the problem, its the
old ones.
Mr. Grubb stated that there will be a 6 foot fence
put up.
Mr. Wood stated that if the zoning wasn't changed,
you would not have any protection. He read out of
the Zoning Ordinance what all could be in Local
Retail. You would have a nicer business with this
air conditioning service than what goes in with
Local Retail.
Mr. Thompson stated that the noise of traffic would
be there regardless of what kind of business was
there, since Highway 121 is such a busy street. He
said that he thought the neighbors should be more
proud of this nice clean business than an old
greasy, dirty service station. He said he felt the
neighborhood would be helped rather than degraded.
Mr. Waldrop asked Mr. Scott how many bays he would
have.
Mr. Scott said he would only be able to work on 4
cars at a time. There would not be 30 to 50 cars
there at one time, probably 8 to 12. He said an
air conditioner could be installed without very
many tools. Most of our business is small cars and
pickups, those that do not come equipped with air
conditioners.
Mr. Waldrop asked Mr. Scott if the tools they use
were air driven.
Mr. Scott said they use air drills and air wrenches.
Mr. Grubb asked Mr. Scott if he would mind the
Corrrnission stipulating that you have to have enough
hard surface for all the cars you park. Mr. Scott
stated that all the cars will be on concrete.
Mr. Waldrop stated that we recieved a letter from a
Mr. & Mrs. Baker, residents of the ares, stating

they were against this. They did not state why.
Mr. Grubb moved, seconded by Mr. Waldrop to
approve subj ect to the Used Car Ordinance, all
cars being parked on hard service, and a 6 foot
fence to be erected. Motion carried 3-0.

Request of David C. Moak for Replat of Parker's
Subdivision of Lots 1,2, & 3.

Jim Thompson with Diamond Shamrock presented their
request to the Corrrnis s ion . He said they were
wanting to remodel their present location, but
found when they came in to get a building permit,
that the property had never been platted. Diamond
Shamrock has several service stations in the
metroplex that they are remodeling. Mr. Thompson
showed theplan that they want to erect.
Mr. Waldrop asked how many pumps they would have.
Mr. Thompson said they would have 10. They will
be self service.
Mr. Grubb asked if they were planning to refurbish
the existing building. He said they want to build
a new structure.
Mr. Waldrop asked what the property is zoned.
Mr. Wood looked on the map and found that it lS
zoned Commercial.
Mr. Grubb moved, seconded by Mr. Waldrop to approve.
Motion carried 3-0.

Request of P & S Construction for Final plat of
Irish Meadows, Section II.

Mr. O.D. Long presented this request to the Corrrnission
for P & S Construction. Mr. Long stated that the
only thing in the Engineer's letter that he could
not go along with was No.5. He said he would
rather have an underground drainage, but the way
the land is there could not be one. It would not
drain with the angle it would be. Mr. Long said
he talked with Dick Perkins about this and Mr.
Perkins said he was not aware of this low drainage.
Mr. Grubb asked how far apart the fire hydrants
were. Mr. Long said he usually has them 500 feet
apart, but these are 700 feet hose length apart.
Mr. Grubb stated the State law requires 500 foot
umbrella coverage. Mr. Long said that the 700
foot hose length was better than the 500 foot
umbrella coverage. He drew a diagram showing it.
Mr. Long stated that before this goes to the City
Council, they would change the right of way. Mr.
Long said since the adjoining property is the Cities,
and they had changed the sewer, he had to change the
sewer, too.

City did not want used car lots in this area.
Mr. Thompson stated that Mr. Scott would also be
servicing these air conditioners since there
will be a service guarentee.
Mr. Waldrop asked how many cars would there be
at one time. Mr. Scott stated from 35 to 50 per
day. There would never be that many at one time.
Mr. Grubb stated there was a Zoning Ordinance
change to be brought before the City Council on
the 4th Monday night in November to keep used car
lots out of the City of N01~h Richland Hills
without a Special-use permit. Mr. Grubb stated he
felt pretty sure that the City Council would turn
this down without a special use permit.
Mr. Thompson stated this would not be a used car
lot.
Mr. Wood explained in more dëtail the Ordinance
change.
Mr. Grubb asked if the Corrrnission approved this
request, when would Mr. Scott start refurbishing
the building. Mr. Scott stated he would start as
soon as he could get the papers signed.

Mrs. Don Ryan who lives behind the property stated
she knew the City depends on revenue from businesses
but she believes that with this many cars parked
around this place, it would look like a used car lot.
She said that this is a choice location and she
said she believed there could be a better business
than this put in there. She said that since Sanger
Harris is going in close by, we need to keep the
area nice. She said they had a real problem with
Brako. The City can not even find a building permit
for them and doesn't know how Brako got in the area.
She said Brako doesn't have a 6 foot fence behind
it like it is surpose to. We have to pick up trash
all the time. Burger King is also behind us and
there is lots of traffic in this area. Mrs. Ryan
stated that she hated to see the property in this
area degraded anYJIDre than it already is.
Mr. WoodS asked Mrs. Ryan if the property the way it
is now would be better than to have a nice new
building there.
Mrs. Ryan said she didn't feel this would help.
Mr. Waldrop asked if she had rather have a service
station than the air conditioner place. She said
they never had any trouble when it was a service
station until the last owner.
Mr. Grubb asked her if it would be better if the
Corrrnission were to state that the new business
IInlst put up a 6 foot fence. She said it would.
Mr. Waldrop stated that if a fence were put up, it
would help with the noise as well as the trash.

approve subject to the Engineer1s letter.
Motion carried 3-0.
Request of the City of North Richland Hills for
preliminary plat of Irish Meadows, Section III.
Mr. Waldrop asked Mr. Long if these lots were
the same size as his. Mr. Long stated they were
a little smaller. He said they are IF-B.
Mr. Waldrop moved, seconded by Mr. Grubb to
approve. Motion carried 3-0.
Request of the City of North Richland Hills for
final plat of Irish Meadows, Section III.
Mr. Grubb moved, seconded by Mr. Waldrop to
approve. Motion carried 3-0.
All members studied the map.
