MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, FEBRUARY 16, 1978 CALL TO ORDER The regular meeting of the Zoning Board of Adjustment was called to order by the Chairman, H.B. Helton, at 7:30 P.M. ROLL CALL PRESENT: H.B. Helton Jack Roseberry Jesse Range Jo Ann Williams ABSENT: CITY STAFF: Dr. E.K. Hahn CITY INSPECTOR Gary Caldwell CLERK Wanda Calvert CONSIDERATION OF THE MINUTES OF DECEMBER 15, 1977 Jo Ann Williams moved, seconded by Jack Roseberry, to approve the minutes as read. Motion carried 4-0. . NEW BUSINESS BA 78-1 DENIED Request of Arthur Barnes of Folsom Investments, Inc. to vary from the Zoning Ordinance #179 on Blocks 6 & 7, University Plaza Addition, for reduction in parking spaces requirement. This property is located South of Harwood, North of Airport Freeway, at Weyland Drive. Mr. Larry Mullins and Mr. Mark Serold came to represent Folsom Investments, Inc. in this variance request. Mr. Mullins stated they felt these plans before the Board were very nice plans and they believe the parking spaces are adequate for the amount of units to be built. He said the Zoning Ordinance· states we should have 2~ spaces per unit, and out plan calls for 2~. He said in developing this concept, they are unable to furnish the required amount. He said they feel the amount they are making is sufficient. Mr. Roseberry asked Mr. Mullins if the architect was aware of the 2~ space per unit requirement. . Mr. Mullins stated he was and that having the open concept of lots of green & recreational Page 2 B of A Minutes February 16, 1978 . space, they could not furnish the 2~ spaces per unit. Mr. Mullins stated they wanted to bring their problem before the Board before they started building. Mr. Range stated the Board appreciated them coming in for this variance request first rather than starting the building and then coming in for the variance. Mr. Roseberry stated he remembered them coming in for a variance on the adjoining project now being erected. He said he remembered that they wanted to build smaller efficiency apartments than required. Mr. Helton asked Mr. Roseberry if the Board stated at that time that they would grant the variance, but in the future, make sure their architect knew that North Richland Hills requires 2~ spaces per unit. . Mr. Roseberry stated he did not remember about that, only of the reduction of floor space in the efficiency apartments. Mrs. Williams stated she felt the Board could not act on this request without having the minutes of that meeting. Mr. Mullins stated he felt their plans were adequate. He said for the amount of land they had, they could build 183 units, but they want the open concept with plenty of green area for their tenants so they would not have to cross over so much asphalt. He said that if the street IIThousand Oaksll did not run through the complex, tenant could walk the entire distance of the complex without having to cross much concrete area. Mrs. Williams stated she was no architect, but why couldn't they move the laundry room over some and make more spaces there. Mr. Mullins stated that that could be done, but they still feel their plan is better. He said their architect draws perimeter parking-creating an open court-yard, recreation area, circulating within an area. . Mr. Range stated this plan looks like some of the parking spaces are far from the units. Page 3 B of A Minutes February 16, 1978 . Mr. Mullins stated when you create this open court-yard effect, it does throw some parking on the side. He said the only other way would be to have the parking area right down the middle. He said he knew that some parking spaces were far removed, but they still feel this is a very good living atmosphere. Mr. Range stated they could move some of the units down and up and have enough land for the needed parking spaces. Mr. Mullins stated that they could, but the view from the units would be the balcony of the other units. Mr. Range asked Mr. Mullins what one place was on the plan. Mr. Mullins stated it was a storm drain. Mr. Range stated it looked like around this area was where the most parking spaces were needed. . Mr. Mullins stated it figures approximately 1~ spaces per 1 bedroom unit. Mr. Roseberry stated that Folsom Investments knew what the North Richland Hills Zoning Ordinance requirement was. He said that at most apartments, you have to park on the street or down the block. He stated that Folsom Inv- estments were asking the Board to change the Ordinance. He said that since they had adequate land, he felt they should comply with the Ordinance requirement. Mr. Roseberry asked Mr. Mullins how many more spaces they need in this area. Mr. Mullins stated 40. Mr. Roseberry asked how much more land would be needed for these. Mr. Mullins stated they would have to cut down the floor space in order to have more parking spaces. He said this would be a great loss in income to them. Mr. Mark Serold, Engineer, stated that they would have too much density and small courts. . Mr. Roseberry stated they could omit one of the buildings. Page 4 B of A Minutes February 16, 1978 . Mrs. Williams asked if they were having any parking problems at their complex that is finished in the Hurst area. Mr. Mullins stated he believes they have 2 parking spaces per 1 bedroom unit. He said he feel there is no problem or they would have less tenants. Mr. Range stated he could see where they could get the required spaces needed. He showed Mr. Mullins and Mr. Serold on the plans. Mr. Mullins stated that they did. not want it to look like a super market parking lot. He said, too, that lots of times when they lay this out on the land, they find they need more room and that is why they like to have extra open space. . Mr. Roseberry stated that they could leave off one building (8 units) and be able to get the spaces needed to comply. He said the Ordinance states 2~ per unit and he feels this should be abided by. Mr. Mullins stated that any ordinance or rule should be interpeted in different ways. He said they had tried very hard to comply with all the other requirements pertaining to apartments in North Richland Hills. Mrs. Williams stated that so many people have boats, campers, vans, etc. that the parking space requirement should be increased rather than decreased. Mr. Mullins stated he feels 2~ spaces for an efficiency 1 bedroom is a lot. Mr. Helton called a recess at 8:15 P.M. and asked Mrs. Calvert to try to find the minutes of the meeting when Folsom Investments, Inc. came in for a variance. CALL TO ORDER The Chairman Called the meeting to order again at 8:45 P.M. . Mr. Helton stated Mrs. Calvert was unable to locate the minutes requested since they did not know when the variance was heard. He said it wasnlt necessary to have them anyway. Page 5 B of A Minutes February 16, 1978 . Mr. Range moved, seconded by Mrs. Williams to deny. Motion carried 4-0. Mr. Helton asked Mrs. Calvert if she would contact all the surounding cities in this area to see what their parking space requirements are, to see if North Richland Hills is about average. Mr. Helton asked all the Board members if they would be in favor of starting the meetings at 7:00 instead of 7:30. All members were in favor of this. Therefore, from now on the Zoning Board of Adjustment will be heard at 7:00 P.M. ADJOURNMENT Mr. Roseberry moved, seconded by Mr. Range to adjourn at 9:10 P.M.
