MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, AUGUST 17, 1978 The regular meeting of the Zoning Board of Adjustment was called to order by the Chairman, H.B. Helton, at 7:21 P.M. PRESENT: H.B. Helton Dr. E.K. Hahn Jo Ann Williams Jack Roseberry ABSENT: Jesse Range CITY STAFF PRESENT: Ray H. Britton Wanda Calvert Mrs. Williams moved, seconded by Dr. Hahn, to approve the minutes with one correction. Page 2, paragraph 3, should read 4-1. Motion carried 4-0. Request of Juanita Anglin to vary from the Zoning Ordinance #179 on Tracts 13 & 14A, Abstract 953, to continue using the house as a residence and be exempt from install- ing a 6 ft. sight bearing fence on the South side of the property. This property is located at 3805 Rufe Snow Dr. Mrs. Williams moved, seconded by Mr. Roseberry, that the staff be instructed to take SA 78-3 off the agenda until the property owner requests the item be placed on the agenda and that the party involved pay all further expences incurred in order to place this item back on the agenda. Motion carried 4-0. Request of W.J. Herrick and Western 6 Motel to vary from the Zoning Ordinance #179 on Lot 2, Block 1, North Richland Hills Station Addition, to have the framing of perimeter walls to be wood rather than steel or masonry. This property is located on Bedford-Euless Road, East of Greater Richland Area Post Office. Mr. Ron Whitney represented Western 6 Motel in their request. He stated they are asking for a deviation from the Zoning Ordinance. He Page 2 B of A Minutes August 17, 1978 . stated the building is designed to meet the requirements for Universal Building Code and Southern Building Code in that they would have the exterior walls 7/8" exterior plaster and the interior 5/811 chip board. He said their justification for asking for this is this motel could be built in Local Retail with a Specific Use permit with the wood frame, but the Commercial Zoning Has a higher density area where the set-backs are different. He stated they do not want to rezone be- cause of the time it would take and the expense involved. He said they would have to get their plans redrawn and with the time involved, the extra expense would cost them around $50,000.00. Mr. Whitney stated the exterior of their building will consist of 7/8" exterior plaster with a color coating of stucco of a golden color trimed in brown. Mr. Roseberry asked to see a picture of one of their existing motels. . Mr. Helton asked Mr. Britton if they went before the Planning and Zoning Commission and City Council for a zoning change from Commercial to Local Retail-Specific Use, could they build this type of structure. Mr. Britton stated if they were granted a Local Retail zoning with a IISpecific-Use- Motelll permit, this type of building would be permissable. Mr. Britton read from the zoning ordinance the requirements for structures in Local Retail and Commercial zoning. Mr. Roseberry asked Mr. Whitney if they plan to have a restaurant or club on their site. Mr. Whitney stated they would not. He said they would have an office and a place for the manager to live. He also stated that they were not the same as IIMotel 611 which are in this area. . Mr. Roseberry asked if the motel would be two-story. Mr. Whitney stated it would be. ~ Page 3 B of A Minutes August 17, 1978 . Dr. Hahn asked if there were any of their motels in Texas. Mr. Whitney stated they have one under consturction in Irving on Irving Blvd., and they plan to build one close to Red- bird Mall in Dallas, and one in Ft. Worth at the Turnpike and Oakland Blvd. He said they will be using the wood frame building in all these. Mrs. Williams asked wouldn1t the frame be more hazardous than the steel. Mr. Roseberry stated he knew that steel framing would collapse under fire also. Mr. Britton stated he felt sure Mr. Roseberry was talking about some light weight steel if it collapsed. Mr. Britton stated that you cannot build a wood studded wall and meet the 90% require- ment. . Mr. Helton asked Mr. Whitney if he could tell them what the percentage of the exterior walls would be. Mr. Whitney stated that except for the windows and doors, it would be 100% ·plaster. He stated that the UBC(Uniform Building Code) and the Southern Standard Building Code requires the exterior walls to be 1 hour rated. He said they have no interior rooms. All rooms have an exit onto the yard. He said its not having to go through several interior rooms before you could get out. He said they could go directly out into the court yard. Mrs. Williams asked what is meant by a 111 hour rated wall. II . Mr. Whitney stated the National Standard was set up based on if a flame with a specified amount of heat was put to it, how long it would take to burn through. He said if there was a fire in this building, with exits in each room, it would only take 60 seconds to get out of the building. He said the walls would be of 1~1I light weight concrete interior and 7/811 plaster for the exterior. He said the ceiling would have 5/8" fire resisting coating. Page 4 B of A Minutes August 17, 1978 . Mr. Walter Head, Architect for Western 6 Motel, stated he prepared the drawings of this building. He stated he would answer any questions the Board would have. He said he would like to mention that the exterior they are proposing to use is far superior to the 90% the Ordinance requires. He said this is a fire resistant wall having 7/811 plaster stucco outside and the 5/811 interior coating inside. He said they could have met the zoning requirement with a wall that would be only a 1130 minute wall II. He said the wall they are proposing to build is a "one hourll or better. The Chairman asked if there was anyone who wished to speak for or against this request. . Mr. Roseberry asked Mr. Britton if they grant this variance, could this building be used for anything other than a motel. Mr. Britton stated if they grant this, it could be used for anything in Commercial zoning. He said if they come before the Planning and Zoning Commission and City Council and were granted the Local Retail- Specific Use-Motel they could build this type of structure. He said Local Retail does permit stucco structures. Mr. Roseberry moved, seconded by Dr. Hahn, to approve BA 78-9 as requested. The vote was 3-1 with Jo Ann Williams voting against. Since there has to be 4 affirmative votes to grant a request, this request was denied. Dr. Hahn stated he was not sure that he wanted to approve this request until he heard about the safety of the material they were going to use. He asked if it would be permissable to postpone this until all 5 members of the Board are present. Mr. Britton stated he could contact the City Attorney, but he believed that since a vote was taken, the denial would have to stand. He said they could file another request if they wished. . The Chairman asked the representatives of Western 6 Motel to stay until after the next case is heard so there could be more discussion on this matter. . Page 5 B of A Minutes August 17, 1978 BA 78-10 APPROVED Request of Joy Davis to vary from the Zoning Ordinance #179 on Lot North ~-16, Block 2, W.E. Odell Addition to build a car port in front of her house. This property is located at 8024 Odell St. Mrs. Joy Davis presented her request to the Board. She stated she has a driveway in front of her house. She said she wants to build an open car port where she always parks her car. She stated her house has no garage, and never has had. Mrs. Davis said she works nights as a nurse. She said she wishes to protect her car from the snow and ice such as we had last winter. She said she would go out at night to go to work and her car would be covered with ice and snow. Mrs. Williams asked Mrs. Davis what the 3 posts in the middle were for. Mrs. Davis stated they were only there as braces until the car port is finished. . Dr. Hahn asked if the car port would be attached to the house. Mrs. Davis stated it would not be. Mrs. Williams stated the car port is already partially built. She said all they lack is the top. Mr. Roseberry asked what kind of roof they plan to have. Mrs. Davis stated they plan to put plywood on, then use either composition shingles or tin. She stated she did not like the kind you could see through. She stated they plan to paint the car port when they get it all finished. She said they have the posts set in concrete. Mrs. Williams asked what kind of posts she used. . Mrs. Davis stated they were 411 penetrated posts. Dr. Hahn asked Mrs. Davis what was the condition of the area where she parked her car. Page 6 B of A Minutes August 17, 1978 . Mrs. Davis stated it is gravel, but she plans to concrete it later. Mr. Roseberry moved, seconded by Dr. Hahn, to approve BA 78-10 as requested. Motion carried 4-0. The Chairman declared a short recess at 8:10 P.M. The Chairman called the meeting back to order at 8:30 P.M. The Chairman expressed his regret to the representatives of Western 6 Motel that the Board could not reach an affirmative decision in their request. He suggested they either file another request for a variance, hoping that all 5 members are present, or go before the Planning and Zoning Commission and the City Council for a zoning change. ADJOURNMENT The meeting adjourned at 8:35 P.M. . .
