MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS MARCH 18, 1977 CALL TO ORDER The regular meeting of the Board of Adjustments was called to order by the Chairman, H. B. Helton at 8:10 P.M. ROLL CALL PRESENT: CHAIRMAN VICE CHAIRMAN SECRETARY H. B. Helton L. A. Trotter Dr. E. K. Hahn Jack Roseberry ABSENT: Jay Jones CITY STAFF: DIR. OF PUBLIC WORKS Ray H. Britton CLERK Barbara Sells CONSIDERATION OF THE MINUTES OF JANUARY 20, 1977 Mr. Helton moved, seconded by Jack Roseberry to approve the minutes as written. Motion carried 4-0. BA 77-3 APPROVED Request of Joe V. Henry to vary from the zoning ordinance #179 on a portion of Lot 1, Block 1, Henry Addition to use non-conforming building. . Mr. James Dee Parks is the potential buyer of this property contingent on obtaining a variance to use non-conforming building. There was much discussion among the board about the property having to be re- platted before they could grant a variance. Mr. Parks wishes to operate an air-conditioning service com- pany at this location and plans to build a commercial building within six years. Mr. Helton asked Mr. Henry if he was aware of the fact the property would have to be replatted and a six foot sight barring fence would have to be erected and main- tained along the rear of the property abutting the residential zoned property. Mr. Henry replied he was not aware of these require- ments, but he would have the property replatted. Mr. Parks stated he would be responsible for erecting and maintaining the required fence along the rear of the property he was purchasing. . Mr. Britton stated that a certificate of occupancy could not be issued for utilization of this property until such time as the replatting is completed and the required fence is erected. ~ Page 2 ZBA Minutes March 17, 1977 . BA 77-3 APPROVED Mary Jo Shaunty - 4917 Cummings Mrs. Shaunty stated as Chairman of the Planning and Zoning Commission that she was opposed, as Mr. Henry had not brought the building up to com- mercial standards as he said he would when he was granted commercial zoning. However; speaking as a private citizen, Mrs. Shaunty said she was in favor of the variance. Mr. Trotter moved, seconded by Mr. Roseberry to grant a variance to Mr. Parks to operate Park's Air-Conditioning Service on said property for (6) six years with the condition he construct a (6) six foot sight barring fence along or within (1) one foot of the property line. Mr. Trotter requested the letter from the anonymous concerned citizen go on record in the minutes. OLD BUSINESS ADJOURNMENT NONE .
