CALL TO ORDER The regular meeting of the Board of Adjustment was called to order by the Chairman, H. B. Helton at 7:30 P.M. PRESENT: Chairman Secretary H. B. Helton Dr. E. K. Hahn Jack Roseberry Jo Ann Williams ROLL CALL CONSIDERATION OF THE MINUTES OF MAY 19, 1977 CITY STAFF: Director of Pub. Works Ray H. Britton Planning and Zoning Pauline Spain Clerk Jo Ann Williams moved, seconded by Jack Roseberry to approve the Minutes as corrected; Page 6, Paragraph 4, May 19, 1977. NEvJ BUSINESS BA 77-4 Request of Weldon H. Snow to continue use of non- conforming building for 12 to 15 months. This property is located at 6871 B. Grapevine Highway. . Mr. Raymond Foote represented Mr. Snow. Mr. Foote stated the building is metal with wood structure. It does not face the street. The building was built as a warehouse to store Mr. Snow's business equipment. Mr. Foote maintained there are a lot worse than this one. Mr. Snow came forward and stated he asked permission to build a place to store equipment. After it was built the inspector told him it did not conform to the building code. Mr. Snow wrote a letter August 8, 1972, informing the inspector he was using Romex wire instead of Conduit wire. Mr. Snow-referred to the building as a temporary building and stated the building would be removed within 54 months of this date. Mr. Snow expressed his need of the building, not only for the protection of his equipment but it would look better under cover. . Mr. Britton stated it appears the building was built without a permit. He read the letter from Mr. Snow to the Board members. Mr. Foote asked why they did not turn the building down at the time of the electrical inspection. Mr. Roseberry asked Mr. snow how much time he wanted to extend the non- conforming use. Mr. snow answered 1112 monthsll. Mrs. Williams asked Mr. Snow if he didn't sell in 12 or 15 months would he be back for another extension. r~r. Snow answered "yes II . 1 . June 16, 1977 Page 2 Mr. Britton stated if the Board voted favorably to the request they should take into consideration the building should be removed before it is sold. Mrs. Williams asked if the property is zoned for storing supplies. The property is zoned commercial; therefore a warehouse is permissable. Mr. Roseberry asked Mr. Snow if he would give his word he would remove the building at time of sale. Mr. Snow answered tlyesll. Dr. Hahn moved, seconded by Jack Roseberry to grant this request to Mr. Snow for use as a warehouse for a period of five years or until the property is sold, which ever comes first. Motion carried 4-0. BA 77-14 Request of Danny Campbell to use a house in Local Retail area as residential rent property. This property located at the Southwest corner of Odell Street and Davis Blvd. . Mr. Campbell stated he had the property zoned Local Retail last year with the intention of using it for a beauty shop and dress shop. ~1y wi fe and I did not realize the cost of conforming to Local Retail and since we do not have the money at this time, we would like to rent the property. Mr. Britton stated he told the Campbell's what it would cost to bring the property up to standard. He told Mrs. Campbell the best way would be to run a bull- dozer over the property. After the building inspector spoke to them they realized it would be too expensive. Mr'. Sri tton sa id as it now stands the property can- not be used for anything. Even if they had gone before the Planning and Zoning Commission the building would be non-conforming. Jack Roseberry commented, it isn't a bad little house; however it does need some repair. Mr. Rose- berry asked how long a period they wanted. Mr. Campbell answered "three to five years". Mr. Helton asked if they planned to use the property themselves. . Mrs. Campbell said "yes, I have a beauty shop and would like to move it to this locationll. 1 . June 16, 1977 Page 3 Mr. Roseberry stated the Board is giving variances to the people and he feels they should be given on the property. Mr. Britton stated as long as you grant the variance to people, the City has a closer jurisdiction over the property. Jack Roseberry moved, seconded by Dr. Hahn to grant this request for a period of five years. Motion carried 4-0. BA 77-15 Request of the First National Bank of Euless to vary from the 1500 square foot minimum house to 1300 square feet. This property located at 8601 Hightower Drive. Request of the First National Bank of Euless to vary from the 1500 square foot minimum house to 1300 square feet. This property located at 8813 Hightower Drive. Mr. Glen Buckner represented the Bank. Mr. Buckner stated he was an innocent bystander. The bank had to foreclose of these properties. I was asked to finish them. A building permit was issued for a 1500 square foot house; however they are only 1320 1325 square feet. These two plans are such that one cannot add 200 square feet to bring it up to standards due to the location of the fireplace and the hip roof. The Planning and Zoning Commission and the Council approved the zoning as IF-9 with the stipulation that the property in this area should be a minimum of 1500 square feet. Mr. Wayne Waters, 2700 Willow Park_ Mr. and Mrs Waters were interested in how this would effect them. They own property a few hundred feet away. Mr. Britton told Mr. Waters it would not effect his property but we had to send him a letter as he was within 200 feet of the property in question. Mrs. Williams asked if there was any way the builder could be stopped from building in this city. SA 77-1~ . Mr. Britton said no, not as long as he can get a bond. . Mr. Buckner stated the Building Association police their own people but unfortunately we cannot police outsiders. Mr. Roseberry said there is really nothing the board can do about original builder and since the houses are built the request should be granted. ~ . June 16, 1977 Page 4 BA 77-15 Jack Roseberry moved seconded by Dr. Hahn to grant this variance. Motion carried 4-0. BA 77-16 Mrs. Williams moved, seconded by Jack Roseberry to grant this variance. Motion carried 4-0. OLD BUSINESS The Board would like a letter written to Mr. J. JOnes and L. Trotter thanking them for their service to the ZBA and the City of North Richland Hills.
