MINUTES OF THE REGUlAR MEETING OF THE ZONING BOARD OF ADJUSTMENT- OF THE CITY OF NORTH RICHLAND HILLS, TEXAS SEPTEMBER 15, 1977 The meeting was called to order by the Chairman, H. B . Helton, at 7: 32 P. M . PRESENT: H.B. Helton Jo Ann Williams Jesse Range Dr. E.K. Halm ABSENT : Jack Roseberry CITY STAFF: CITY INSPECTOR CLERK Gary Caldwell Wanda Calvert ABSENT : DIRECTOR OF P.W. Ray H. Britton Jesse Range moved, Jo Ann Williams seconded, to approve the minutes as written. Motion carTied 3-0 with Dr. Halm abstaining as he was not at the August 18th meeting. Request of Dr. James R. Roberts to vary from the Zoning Ordinance #179 on wt 4, Block 5, Stonybrook Addition, to install fence outside 25 foot building line. This property is located at 7312 Stonybrook. James R. Roberts presented his variance request to the Board. The northeast corner of the property is the point in question. If the fence followed the building line on Rockdale Drive , it would not be a right angle, and would be very noticable. waking from the patio, the fence would look crooked. To make the fence look right, we need 9~ feet, but I am asking for a 10 foot variance. Jo Ann Williams asked if the fence would block the view of the houses to be built facing Rockdale Dr. Mr. Roberts stated- the property line is 10 feet frDm the curb. If I put it the way I want to, the fence would be 25 feet from the curb. Jo Ann Williams stated that since it is a corner lot the City Ordinance requires 25 feet plus 10 feet. She asked Mr. Roberts if he was not aware of the Ordinance when he started the fence. He stated he got a building permit to put up the fence. He said he was told of the requirements at that time. Also t1r. Caldwell came out and told me where I had to put it. Thats why the fence is not completed. ~ Page 2 B of A Minutes September 15, 1977 . Mr. Range stated he thought the building line was measured from the curb. Mr. Caldwell stated that it is 25 feet from the property line and 9~ feet on to the curb. This is a total of 34~ feet from the curb to the property line. Dr. Halm stated that if there were already houses built on the other property, it would be easier to tell if the fence would block the view. He asked if the City would ever require sidewalks there. Mr. Caldwell stated it would not. Mr. Range stated that the Board approved one simular to this previously. He said he believed it would be within the limitations and in accord wi th the Ordinance to grant the variance. Mr. Helton asked if there was anyone present to speak for or against this request for variance. Dr. Halm moved, seconded by Mr. Range to grant the variance as requested. Motion carried 4-0. BA 77-23 APPROVED Request of Ralph Robinson to vary from the Zoning Ordinance #179 on Lot 16, Block 6, Holiday Hills Addition to build a fence in the front yard. This property is located at 4617 Lariat Trail. Mr. Ralph Robinson presented his request to the Board. He stated that motorcycles, horses, etc. go across his yard. He said he has a 1~ year old son that would soon be playing in the yard, and he did not want him to get hurt. He stated that he had been living there since January and has had this problem ever since. Mr . Helton asked Mr. Robinson to draw the type of fence he wishes to put up. The type of fence is an open type Ranch Style slat fence. The posts are set on 8 foot centers, and will be about 48 inches high. He said he was not aware of the City building code when he put up the posts. He stated his house was total electric and there would not be any worry about digging up the gas line, but if there were ever any problem, he is self employed and could come home at any time and move the fence if necessary. Jo Ann Williams asked Mr. Robinson if he was aware that the posts were set 3 9~ inches from the curb, and that 9~ feet was City property. Mr. Robinson stated that this was the first house he has ever buil t and that he was not aware that it was City property. Mr . Helton asked J 0 Ann Williams to read Article 25, Section 1, of the Zoning Ordinance. "On any corner lot on which front and side yards are required, no obstruction is permitted vertically between 3~ feet and 10 feet above the curb grade and horizonally 50 feet in each direction from the corner." Mr. Range stated the Ordinance did not state he could not have a fence at all in the frDnt yard. . . "1 Page 3 B of A Minutes September 15, 1977 . Mr. Robinson stated he was not up here to obstruct justice. No one hardly abides by the stop sign. Only 2 out of 5 cars stop. The cars rW1 50 miles an hour. Probably if there was a 4-way stop it might help. He said he had 2 neighbors here to verify the need for a fence and also stop signs. Mr. Robinson stated he received 17-20 signatures of neighbors who do not object to him putting up this fence. Jo Ann Williams read a letter from Mr. Gerald Lee Wilson, 4605 Lariat Trail who was unable to attend. He stated he was not against the fence, but thought the 4-way stop signs should be put up. Mr . Helton asked Mr. Robinson if he had thought of makmg the fence lower to 3-3~ feet high. Jo Ann Williams stated that the biggest problem is that regardless if he did build the fence lower, he would still have to move the posts that are on City property. Mr. Caldwell stated that Mr. Robmson would have 25 feet on one side and 15 feet on the other. Mr. Robinson presented to the Board pictures of homes in North Richland Hills that have illegal fences. These homes were located at 6204 Riviera, 4621 Shady lake, and 4629 Lariat Trail. Mr. Range asked Mr. Robinson if he had an al ter- native. He said he didn't. Dr. Halm stated he could make a triangle of rocks. Jo Ann Williams asked the Board if it would be OK for him to build R 24 inch high fence on his property line. Mr. Robinson asked if the Board could act on the back yard fence tonight. Wanda Calvert stated that the other property owners would have to be notified so this would have to be taken up at another date. Mrs. Robinson asked if it would be another $50.00. Mrs. Calvert stated it would be. Jo Ann Williams stated that his house was put on the lot in error-the lot was not platted. This makes the property line 15~ feet. The extra lot was platted making the property line 25 feet. If you build a fence there without a variance, you will have to slant it from the 15 feet to the 25 foot on the other lot. Mr. Robinson asked Mr. Caldwell if he could plant shrubs where the holes will be left when he takes out the posts. Mr. Caldwell stated that it was City property and he could not. Mr. Range asked how far the corner post would be from the corner. Mr. Robinson stated it would be approximately 15 feet. . . Page 4 B of A Minutes September 15, 1977 . BA 77-24 APPROVED . ADJOURNMENT . ~ Jo Ann Williams moved to grant Ralph Robinson, Lot 16, Block 6, Holiday Hills Addition, to build a fence in the front yard not to exceed 3~ feet in height, and to follow the property line on 4617 Lariat Trail and to the Southwest corner of this dwelling on Victoria. This fence is to be an open Ranch style slat fence. Mr. Range seconded the motion. Motion carried 4-0. Mr. I..a.rry Morgan, 4625 Lariat Trail, asked what could be done to help them and who they should see on three problems in their neighborhood: 1. Could we get a 4-way stop. 2 . More patrol of area. 3 . Get streets fixed. Mr. Helton stated he should get a petition with all the neighbor's signatures and send it to the Mayor or Ray Britton. Request of Gene Barrow to vary from the Zoning Ordinance #179 on wt 3A, Block 10, Fossil Creek Trails, Section 1 , Addition for 20% depth of lot for a back yard. This property is located at 6112 Riviera Drive. Mr. Gene Barrow presented his request to the Board. Mr. Range moved, seconded by Jo Ann Williams to approve. Motion carried 4-0. Jo Ann Williams made a recommendation to the Board to compose a memographed sheet stating some of the policies of the City, such as be- fore putting any structure on your property, to please contact the City. This might keep so many people from breaking the City Ordmance. Dr. Halm said they could send a memo to the Mayor stating their recorrnnendation." Mr. Range stated he would draft a letter before the·next Board of Adjustment meeting. The meeting adjourned at 9 :10 P.M.
