MINUTES OF THE REGUlAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RIæIAND HILLS, TEXAS OCTOBER 20, 1977 The meeting was called to order by the Chairman, H. B . Helton, at 7: 30 P. M. PRESENT: H.B. Helton Jo Ann Williams Dr. E.K. Halm Jack Roseberry ABSENT : Jesse Range CITY STAFF: DIRECTOR OF P. W . CLERK Ray H. Britton Wanda Calvert Jo Ann Williams moved to accept the minutes as read with the addition to page 4, stating "This fence is to be an open Ranch type slat fence." Dr. Halm seconded the motion. Motion carried 3-0 with Mr. Roseberry abstain- ing since he was not present at the September meeting. Request of E.M. Dickerson to vary from the Zoning Ordinance #179 on Lot 10, Edgley Addition, to erect a metal building in Local Retail Zoning. This property is located at 4170 Willman. Mr. Dickerson stated that the reason he wanted to put up a metal building on his property was because it would be faster buil t . He stated that when Sanger Harris bought the property he was occupying, he was under the impression that he would have about 6 months to vacate this location. Mr. Dickerson had the Kandi Kane Day Nursery. He was in- formed that he had to vacate as soon as poss- ible. He said the City was kind enough to let him use the old City Hall Building. He stated he had a lease for 4 months. So in order to get a building built in 4 months, he said he decided to erect a metal building. Mr . Helton, Chairman, acknowledged Mr. Range. Mr. Dickerson stated he went ahead and ordered the metal building and started the building process before trying to obtain a building permit from the City. Page 2 B of A Minutes October 20, 1977 . Mr. Helton asked how far along he was now. Mr. Dickerson stated he had only leveled the lot and put up the forms. He also stated he would have to move the forms back to 40 feet from the sidewalk as he had misunder- stood the Mayor. He said he thought the Mayor told him he could build 25 feet from the curb, but Mr. Dickerson said he had forgotten he would need more area so he could have a circular drive so his patrons could dri ve under the canopy and drop their children out so there would be· less traffic problems. Mr. Range asked Mr. Dickerson how long it was before he knew he couldn't put up a metal building. Mr. Dickerson stated 3 days after he moved into the old City Hall. J 0 Ann Williams asked him if he was aware of the Zoning Ordinance. He said he had a Zoning Ordinance book, but had had it packed away for a year. Mrs. Williams read page 67 from the Zoning Ordinance. Mr. Britton stated that Mr. Dickerson had called him approximately 3~ months ago asking what his property was zoned. Since he did not know the Legal description of his property, Mr. Britton said he was unable to help him. Mr. Britton told Mr. Dickerson to find out the Legal description of his property and to come to his office and he would help him find out what it was zoned. Mr. Britton stated that he never tells a person over the phone how any property is zoned. Mr . Britton stated he did not see or hear from Mr. Dickerson till recently. Mr. Hel ton asked about the Zoning Ordinance. Mr. Britton stated that the Ordinance was not only for fire purposes, but also for looks. He stated that the City would like to keep the City of North Richland Hills as nice as they can. Jo Ann Williams asked Mr. Dickerson if he had considered a concrete tilt wall building. He stated that he had, but there was this problem of not being able to get the trusses. He said he talked with a Mr. Freeman and he said he could get the steel trusses sooner. Mr. Roseberry stated that the Ordinance in Local Retail will allow a wood structure with brick vaneer, but in Corrnnercial , it will allow all steel structure. He asked Mr. Dickerson why didn't he request a zoning change. Mr. Britton stated he gave Mr. Dickerson two routes to go: To ask for a variance or to ask for a zoning change. It would take approximately 15 days for a variance request and approximately 30 days for a zoning change. So Mr. Dickerson chose the Variance Request since it would take less time. . . Page 3 B of A Minutes October 20, 1977 . Mr. Roseberry stated that the all-metal would be less danger for fire than the wood with brick. Mr. Range asked how the outside walls would be finished. Mr. Dickerson stated that it was baked-on finish, yeallowish gold color with whì te trim. Mr. D.A. Jordan, living at 4158 Willman, asked to speak. He asked why should we give in for a metal building to be erected on this property, when all the other buildings in the area are masonery. He stated when he erected his house, the city checked several times making sure he would put brick on it. He asked why should we all suffer just to please one man. Mr . Helton asked Mr . Jordan how would he suffer. Mr. Jordan stated the looks and the property value would go down. Mr. Britton stated that the property in that area was zoned Residential, Local Retail, and Corrnnercial. Mr. Range asked Mr. Dickerson, if its the appearance that was bothering the neighbors, would he be willing to dress the front of the building up with brick or stone. Mr. Dickerson stated he would consider it. Mr. Helton asked how long he had the old City Hall leased. Mr. Dickerson stated 4 months. He said Mr. Riddle , City Manager, knew he had plarmed to build a metal building on this pro- perty.. Mr. Dickerson said he thought he had plenty of time to get things worked out, but he found out he didn't. He said he lost a lot of his clientele when he had to move. He said he had to do something right away or he would go under financially. Terry Haney, General Contractor with Aquarian Construction Company, stated that the brick VEneer would be added expence for Mr. Dickerson as he had already ordered the metal panels and would have to pay for them anyway. He stated that the exterior finish on the metal building was guaranteed for 10 years, rnainten·ance free, no chipping or peeling. He said he could get with his archi tee t and have him draw up a pretty trim of brick for this structure. June Bryson, living on Willman, asked if she could see a picture of the structure. Mr. Haney presented a brochure of the type of structure Mr. Dickerson has ordered. She said she wasn't against him putting up a metal building, but she wanted it to look nice in the neighborhood. . . Page 4 B of A Minutes October 20, 1977 . She said it looked too close to the road. Mr. Dickerson stated that he had made a mistake, and would move it back to 40 feet from the sidewalk. Dr. Halm asked why he started anything before he got a building permit. Mr. Dickerson stated he didn't feel he would have a problem. He said he had made a lot of mistakes and was working day and night to correct them and to get into a building where he could handle his quota of children. Ray Cottinger with Aquarian Construction Co. stated there would be no problem in putting brick trim on the front of the building if they could find the brick. Mr. Jordan said he would be willing for the Board to give Mr. Dickerson 6 months or 1 year to put the brick trim on. Mr. Britton stated he had a good suspence file and if Mr. Dickerson didn't get the brick on in the alloted time, he would contact him and give him a citation if he didn't do as he was instructed by the Board of Adjustment to do. Mr. Hel ton asked how many parking spaces Mr. Dickerson would have. He said he would have 11. There would be a circular drive with two 20 foot approaches. He said the employees would park in the back. Mr. Britton stated he didn't feel that there would be any problem with parking,. Mr. Britton asked if they had ever seen the blown-on finish. He said he had a sample in his office. He said it really looked nice. Mr. Roseberry suggested Mr. Dickerson pour a brick ledge and put the brick trim on later. Mr. Helton asked if Mr. Dickerson thought he could afford this brick trim. Mr. Dickerson said he would do what he had to do. Mr. Roseberry said the Board could grant a Variance with 30% brick trim on the front and Mr. Dickerson could design it to suit himself. Mr. Dickerson said to add "or stone" to the varlance. Mr. Roseberry made a motion to approve the variance request with a minimun of 30 square feet of front elevation to be brick or stone masonery. Dr. Hahn seconded the motion. The motion carried 5-0. . Mr. Helton called a 5 minute recess. . Mr . Helton called the meeting back to order. He had Jo Ann Williams read the letter Mr. Range had agreed to write to the Mayor and City . . . Page 5 B of A Minutes October 20, 1977 ADJOURNMENT Council in the last meeting. This letter pertained to informing the new residents of the various zoning ordinances of the City of North Richland Hills. Jo Ann Williams moved to accept the letter in its entirety-underlining "particularly fencing." She further moved that this be sent to the City Secretary to be acted on by the City Council at the earliest time. The motion was seconded by :Mr. Range. Motion carried 5 - 0 . The meeting adj ourned at 9: 12 P. M.
