MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE CITY
OF NORTH RICHLAND HILLS, TEXAS,
DECEMBER 15, 1977
The regular meeting of the Zoning Board of
Adjustment was called to order by the
Chairman, H.B. Helton, at 7:35 P.M.

Jack Roseberry moved, seconded by Jesse Range,
to approve the minutes as read. Motion carried
3-0 with Jo Ann Williams abstaining since she
was absent at the November meeting.
Request of Larry Wayland with W.W. Construction
to vary from the Zoning Ordinance #179 on Lot
14, Block 8, Briarwood Estates from 6 foot
side yard requirement. This property is located
at 7013 Post Oak Drive.
Mr. Larry Wayland presented his request to the
Board. He stated that he could not explain
how or why the error was made. He said the
house is 15\ inches too close to the side yard
line. He said he depended on his concrete men
to get it right. He said maybe the pins were
pulled up by the dozer when the lot was leveled
and was put back in the wrong place. He said
the back corner of the house was the most off.
He said the house is crooked on the lot. The
front of the house is not more than 4 or 5 inches
off.
Mr. Range asked if he had sold the house. He
said he went by the house and met the people
living in the house.
Mr. Wayland stated he had sold the house pending
the outcome of this variance request.
Mr. Helton asked if there were houses on either
side.

Mr. Wayland said there were not, only vacant
lots.
Mr. Range asked Mr. Wayland if he owned the
lot next door.
Mr. Wayland said that he didn't. He said he
had tried to buy a few feet of it, but they
would not sell a portion of the lot. He said
if he bought the lot, he would have to have
it replated.
Mr. Range asked him if the reason for the
error was to save those 3 nice trees on the
lot.
Mr. Wayland stated it was not. He said he
did not know there was an error made until
the day of closing on selling the house.
Mr. Range asked Mr. Britton if there was anyway
that the house to be built next door could be
required to be 12 feet from this house.

Mr. Britton stated that the only thing he could
require was the 6 foot side yard. He told Mr.
Wayland that he was putting a lot of responsi-
bility on the concrete men. He said it was the
builder who was bonded.
Mr. Wayland stated that he was of the opinion
that the man he used was reputable. He said he
had gone to school with this guy, and his
father had known his father.
Mr. Britton stated that the city is now requiring
the builders put up a string line, but if the
pin has been moved, we wouldn1t know it. He
said that the title companies were getting more
strict about this. They bring out a surveyor
and make sure the measurements match the plat.

Jo Ann Williams stated that in other words-there
is no way to keep this from happening.
Mr. Britton stated that lots of builders are
now having surveyors put up their foundations.
He said that if they don1t do this, the builder
should get out there with a tape measure and
make sure the length and width of the lot are
the same as on the plat.

Mr. Roseberry asked if we could have some
kind of flyer to give the builder when he
comes in to get his building permit, to re-
mind him of the side yard requirement.
Mr. Britton stated that we are requiring string
lines now and that is all we can do. They
know that if its not right, the title company
will find it.
Mrs. Williams asked what are we going to do-
just keep granting these requests because the
houses are already built. She said it would
be bad to make the builder tare down a wall.
Mr. Britton stated that the Board has only
granted 9 of these variances. He said he
believes this is a very good percentage as we
have issued approximately 937 single family
dwelling permits this year.
Mr. Range asked Mr. Wayland if he had built
this house for the people who bought it.
Mr. Wayland said he did not. He said he did
not plan to build in North Richland Hills any-
more as it is too far for him to drive. He
said he had had nothing but problems with this
house. He said kids broke the windows out, and
then someone stole the appliances out of it.
He said this is the first time he has made this
kind of error in his building career, and he
said it would not happen again. He said he
would be more careful as this is a very expensive
mistake.
Mr. Range moved, seconded by Mrs. Williams to
approve. Motion carried 4-0.
ADJOURNMENT
Mr. Roseberry moved, seconded by Mrs. Williams,
to adjourn at 7:55 P.M. Motion carried 4-0.
