CALL TO ORDER ROLL CALL CONSIDERATION OF THE MINUTES OF OCTOBER 23, 1975 CONSIDERATION OF THE MINUTES OF DEC. 4, 1975 OATH OF OFFICE NEW BUSINESS PZ 76-1 APPROVED PZ 76-2 APPROVED MINUTES OF THE MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF NORTH RICHLAND HILLS, 4101 MORGAN CIRCLE THURSDAY, JANUARY 22, 1976 The regular meeting of the Planning and Zoning Commission was called to order by the Vice Chairman, Mary Jo Shaunty at 7:30 P.M. PRESENT: VICE CHAIRMAN SECRETARY Mary Jo Shaunty Wayne Staples Thad Biard Jesse Range ABSENT: CITY STAFF: ADM. ASSISTANT CLERK Gene Welborn R.L. Shade Pauline Spain These minutes could not be approved as there was not a quorum present. Mr. Biard moved, seconded by Mr. Staples to approve the minutes as written. Motion carried 3-0. Mr. Shade swore Mr. Jesse Range in office. Request of J.P. Birdwell to rezone Lot 5B, Block 1 of Jack M. Estes, Jr. Subdivision from its present classification of Local Retail to a pro- posed classification of Commercial. This property is located at 3918 Rufe Snow Drive. Mr. Birdwell presented this request stating this property has been operating under Commercial business for a number of years and requests a change to conform with the zoning ordinance. After consideration by the Commission members Mr. Biard moved, seconded by Mr. Staples to ap- prove PZ 76-1. Motion carried 4-0. Request of Mrs. Juanita Anglin to rezone 4.035 acres of the M. Lynch Survey from its present classification of Planned Development to a pro- posed classification of Commercial. This property is located at 3805 Rufe Snow Drive. ~ . Mrs. Anglin presented this request stating before the planned development was plated and built her husband died. She would like to zone it commercial as it is too expensive to go Planned Development. Mr. Staples asked about the house on this property. Mrs. Anglin said she didn1t want the house zoned as she is renting it at the present; however as the house is included in the metes and bounds of this request she will have to get a variance to use the house as living quarters. Mrs. Anglin agreed. . Mr. Robert Hoover, Attorney, represented Dave Pierson and other residents in the area stating the property owners in this area were opposed to the commercial zoning. Mr. Hoover stated there are approximately 105 types of business under commercial zoning that could be put there. His clients feel they do not want some types of commercial businesses at this location. They feel the value of their property will go down due to this change. Mr. David Pearson, 6627 Onyx Dr. N. spoke in op- position. Mr. Pearson stated after the property owners realized how many things fell under commercial zoning they signed a petition opposing this zoning. Mr. Pearson said he had lived there 12 years. The houses are frame but well kept. Lois Ray, 6615 Onyx Drive N. stated she had lived at this address for 20 years and has nothing against Mrs. Anglin but is afraid of what may go in there. Mrs. Shaunty asked Mrs. Anglin if she would con- sider local retail zoning. Mrs. Anglin said she did not want to do anything the neighbors opposed. She would be willing to go local retail. Mr. Pearson spoke again and asked for time to consider local retail. After considering he said he trusted Mrs. Anglin and would go along with local retail. Mr. Pearson stated there had been businesses at this location in the past the neighbors did not like. One worked all night. . After consideration by the Commission members, Mr. Staples moved, seconded by Mr. Range to change request from commercial to local retail with the stipulation that Mrs. Anglin ask for a variance to live in the house on said property. Motion carried 4-0. . PZ 76-3 Request of Mangham Airport Joint Venture to rezone 9.25 acres of the T. K. Martin Survey from it's present classification of Industrial to a proposed classification of Industrial-Specific Use-Airport. This property is located on Cardinal Lane north of the existing airport. PZ 76-4 Request of Mangham Airport Joint Venture to rezone 99.71 acres of the L. C. Walker Survey and T. K. Martin Survey from it's present classification of Industrial to a proposed classification of Indus- trial-Specific Use-Airport. This property is the existing airport. Mrs. Shaunty asked that the two be discussed at the same time since they are related. . Mr. Walter Elliott, Elliott & Hughes Engineers, presented this request. Mr. Elliott stated that Mangham airport had operated 20 years without Specific Use zoning. The City zoned the property Industrial, but the property owners have to approve the Specific Use-Airport. Mangham Airport Joint Venture purchased this property three years ago and are asking for zoning to conform with the zoning ordinance. Mr. Elliott introduced Mr. Bill Pasteur, Commercial Realtor, one of the owners of Mangham Airport Joint Venture. Mr. Bill Pasteur stated that he would like to out- line the plans formally presented to City Council with a few changes. This airport now serves much of Northeast Tarrant County and many citizens of North Richland Hills have airplanes there. Our purpose is to discuss Specific Use-Airport. We have tried to be cognozant of property owners interest and have given them every consideration we can. According to recent North Central Texas Council study of Governors, it was recommended that Northeast Tarrant County have two general utility airports to service the area. Mangham cannot qualify for that unfortunately, however, it can be an asset to the vicinity and can be a viable air- port. We have now increased from 75-80 planes and hangers to 140. We tell you this because we feel this zoning is needed. We need to have a longer runway. We have limited property to the north to 500 feet, which is an absolute minimum for modern- izing and implementing into an industrial airpark. . Mr. Troy Fuller, joint owner of Mangham Airport, stated he had been asked several times to show development of area if zoning is approved. He showed films of Scottsdale, Arizona Airpark and ~ . Addison, Texas Airpark, with various offices, air- port and residential area. Mr. David Hughes, Elliott & Hughes Consulting Engineer, stated there is a proposed six lane thoroughfare from the west to the east side of the metroplex at Martin Rd. This would cross the northern tract of industrial property owned by Mangham Airport Joint Venture. Cardinal Lane would be closed between the two pieces of pro- perty and we would cul-da-sac western side of Cardinal Lane at existing airport and extend Cardinal Lane at east end to meet said thorough- fare. The runway would extend 370 feet past Cardinal Lane. . Mr. John Scott, Continental Copters Inc., 9025 Cardinal Road, stated he is very much in favor of the zoning. It will be very good for the community. Ms. Martha York, Hurst Aviation Inc., 8650 Cardinal Lane, asked to go on record as being for this re- quest. Bobby Osborn asked to go on record as being for this request. . Bill Ratcliff, 9224 Amundson Rd., stated I am directly under the traffic pattern. I would like for you to answer some questions I might have. Why should this airport be enlarged? I understand from the zoning ordinance that non-conforming use is non transferable. Since this is non-conforming, why hasnlt the City stopped this non-conforming use? By what authority are they operating at the present time? Mangham Airport Joint Venture purchased this property after I built my home. They are asking for this zoning change based on the assumption that Cardinal Lane will be closed. I don It think the City can condemn property for a Specific Use; in other words to condemn property it must be for the good of the people. Consider the number of planes that have fallen in this area in the past ten years. The specific one I had in mind was a kit built in a man IS garage. If I understand the federal rules, one can build a plane from a kit by rules put out by the federal government, then go out to Mangham Airport and test it. This plane had a malfunction in the gas line and crashed and burned. There are brand new schools directly east and north of the traffic pattern. The schools on Rufe Snow are not too far from the traffic pattern and there is Tarrant County Junior College just south. If you don It consider the homes, consider the public ~ . buildings. There is also a flying school at the airport. Sooner or later the pilot will make his first flight right over my house. I would also like to ask at what time the zoning ordinance changes were made to allow a Specific Use-Airport under Industrial zoning? What control would the City have over the airport? The federal government has rules but they would allow experimental planes and solo flights over Mangham airport. David Mormon, 6504 Collard Ct. . Why does the City allow a developer to put in a subdivision with hundreds of houses in it, then nearly turn property into an airport? Airports shown tonight on the films have planes in the garages. They built homes there because they had private planes. No one is for this zoning other than those property owners adjoining the property in question. They have an opportunity to gain, but the property owners in other areas have everything to lose. Another thing you should consider is Meacham Field. They are crying for more and more business. How is an airport as small as Mangham Airport going to compete with Meacham Field? The City Council is considering closing Cardinal Lane for the safety of pilots. Now they are asking to extend the runways another 500 feet. Now we are talking about our safety. We are asking you to protect us. * Correction: Mikel Brown 8401 Main Street *Martha Manley, 401 Eden Rd. I would like all those opposed to this zoning change to stand. Approximately 37 people were opposing this request. If you pass this zoning the airport will continue to grow. By zoning these two tracts to Specific Use-Airport, you will have them in soon asking for more runway. We stand to lose a lot of money on our homes if this airport zoning is granted. We want to ask the P & Z Commission to deny this Industrial Specific Use-Airport zoning. How can this board give these people part of a road to open up the runway to the north? We are a group of hundreds of taxpayers and we are against this zoning. Joint Venture is a group of a few individuals who stand to profit privately. We pay taxes and we feel we have the right to know who the individuals are who make up this Mangham Airport Joint Venture. This zoning will not serve the best interest of the people of this City. Why not let all the people in the City vote on a referendum to decide the outcome of this request. If so, deny this zoning . ~ . and let the people of the City vote on it. Glenn Buckner, Developer of Glen Ann Addition I am against this zoning. Glen Ann is a very nice addition and we still have 120 lots to build on. I have not started a new house in two months. The planes fly over so low and so often I cannot talk to customers. Joe Clature, Realtor I wish you members of the P & Z Commission could have been in Glen Ann Addition Sunday morning. I opened up about 11:30 a.m. and planes were going over approximately every 30 seconds. I was on Main St. at the time and I wrote the number of the planes flying over and turned it over to G. Lavender of the FAA. Some planes came over every 30 seconds and others every nine minutes. I have three customers right now who are interested in houses, but will not buy if this zoning is approved. . Lowery Davidson, Attorney I represent the majority of the home owners here tonight. I don't blame Mr. Pasteur or Mr. Fuller for trying to make money but I do blame them for giving the City Council and you a snow job. And that I believe they have done. The property owners were told they were not going to enlarge the air- port. I understand the Chamber of Commerce was in favor of this airport at one time, but now they are looking for larger area because this small area is not feasable. I feel the routes taken were out of order. The City Council wanted Mr. McIntyre to look into closing Cardinal Lane. Seems to me they should have done this before rezoning. Who is going to put in the road from Cardinal Lane and the new six lane highway mentioned earlier? Will that be for the taxpayer to pay for out of more taxes? This business is not only hurting the home owner, but also the developer. We are asking you to deny all of the requests. Mr. Range asked Mr. Mormon what the compromise was he spose of earlier. Mr. Mormon said 250 feet which we didn't want but were willing to give at the time. . After consideration by the Commission members Mr. Biard moved, seconded by Mr. Range to defer PZ 76-3 pending closing of Cardinal Lane. Motion carried 4-0. Mr. Biard moved, seconded by Mr. Range to approve PZ 76-4. Motion carried 4-0. . . . APPOINTMENT FOR COUNCIL MEETING - FEBRUARY 23, 1976 ADJOURNMENT Mr. Biard will attend the February 22 meeting.
