MINUTES OF THE MEETING OF THE PLANNING
AND ZONING COMMISSION OF THE CITY OF
NORTH RICHLAND HILLS, 7301 N.E. LOOP
820, THURSDAY, JULY 22, 1976
CALL TO ORDER
The meeting was called to order at 7:30
P.M. by the Vice Chairman, Mary Jo Shaunty.
OATH OF OFFICE
Messieurs Darrell W. Wood and Forrest G.
Grubb were sworn in as new commission
members by Mr. Ray Britton.

seconded by Mr. Grubb. Motion carried 4-0.
MR. Biard moved, seconded by Mr. Range to
approve the minutes as written. Motion
carried 3-0.

CONSIDERATION OF THE MINUTES
OF JUNE 24, 1976
NEW BUSINESS
PZ 76-10
APPROVED
Request of C.O. Powell to rezone 1.157 acres
of the J.C. McComas Survey, Abstract 1040
from its present classification of Agriculture
to a proposed classification of Agriculture-
Specific Use-Day Nursery. This property is
located at Smithfield Road and Chapman Drive.
Mr. C.O. Powell-6613 Smithfield Road stated
he wished to rezone the property to use as
a day care center. There is a residence and
small barn on property. We plan to use the
residence as the nursery and later build a
home on adjoining property. Mr. Range asked
about a fence. Mr. Powell stated before
they installed a fence they wanted the zon-
ing approved. The county and welfare board
will come out and discuss with us and the
fire marshall the requirements of the State.
Mrs. Shaunty asked the number of property
owners notified. There were five letters
mailed. No one opposed. Mr. Grubb asked

if there were adjoining residences. Mr.
Powell said one was behind and south of
the garage next door to him.

APPROVED
Mr. Biard moved, seconded by Mr. Wood to
approve PZ 76-10. Motion carried 5-0.
Request of James A. Rust to replat lots 10,
11, 12 and 13, Block 6, Hillview Addition.
This property is located at Glenview Drive
and Rufe Snow Drive.
Mr. Bill Lewis - 109 Oakhurst - Hurst

We want to replat four lots into one lot.
Mr. Britton told the commission the replat
was brought about by building 7-11 store.
According to the subdivision ordinance a
building may not cross building lines;
therefore to construct this building the
property had to be replated into one lot.
Mr. Range asked if the aerial easement was
going to be a problem. Mr. Lewis said no.
Mr. Biard moved, seconded by Mr. Wood to
approve PS 76-8. Motion carried 4-0. Mr.
Wood asked to abstain as he has not seen
the property.

TABLED
Request of United Enterp(ises, Inc. for a
preliminary and final plat of Green Valley
Addition. This property is located at
east side of Smithfield Road approximately
5671 from the curve of Smithfield Road
north of Green Valley Dr.
Mr. Bill Hielscher - 8241 Green Valley Dr.
Mr. Hielscher asked that this request be
tabled as his plans are not complete. He
has an engineer working on plans and hopes
to have them completed soon. Mr. Range
asked about the name, Green Valley Addition.
Mr. Hielscher stated he would change the
name as requested.
Mr. Range moved, seconded by Mr. Biard to
table this request until this plat is
completed. Motion carried 5-0.

SPECIAL HEARING
PS 75-15
APPROVED
Request of Mr. O.D. Long for extension
of time for recording of final plat of
North 820 Commercial Addition, PS 75-15.
Mr. 0.0. Long - Hurst
Mr. Long reviewed the past hearings for the
two new members. He stated on the original
plat Lariat Trail went through to Roaring
Creek Drive. It was his understanding they

could cul-da-sac at Lariat Trail. After he
was told Lariat Trail had to be closed his
client was not satisfied. He did not want
me to fil for recording. He decided to sell.
After a while he decided to plat according
to the city IS recommendations. We have
dropped block 3 and changed number of lots
in block 2 from 9 to 12. We have also curved
Corona at Lariat Trail. Mr. Biard stated he
felt the street should have gone through.
The trucks can It be too large since they
service 1001 commercial lots; too it will put
more traffic on Rufe Snow Drive rather than
take away traffic. The comments on the
engineer's letter of July 16, 1976 have been
or will be met.
Mr. Biard moved, seconded by Mr. Grubb to
grant an extension on this plat. Motion
carried 4-0 with Mr. Wood abstaining.
SPECIAL HEARING
PS 74-24
APPROVED
Request of Mr. 0.0. Long for extension of
time for the recording of final plat of
Briarwood Estates 3rd filing, PS 74-24.
Mr. 0.0. Long - Hurst
Mr. Long stated this was not filed for re-
cording because of procrastanating, building
slow down and he and the city had problems
getting together. Mr. Long explained each
item on the engineerls letter.

#1 I have given a check for $3000.00 in
escrow for this 6- water line.
#2 It is not a requirement of subdivision
ordinance to place water lines in the street.
I personally feel it is better behind the
curb and it is less expensive. I do not
feel I should comply with this since it is
not a requirement for all developers by
ordinance.
#3 This too, is not a requirement of the
subdivision ordinance. I donlt feel I should
be responsible for same. I have agreed to
furnish flanged connectors for fire hydrant
valves, Mr. Bronstad will furnish the valves,
and I will have them installed. I am
competing with other people and can It afford
to run up the cost of my lots.

#4 My partner owned the property to the
west of this subdivision. When he sold
his property an easement was obtained by
dedication.
#5 I do not feel this problem is completely
the cause of Briarwood #3.. Other developers
have contributed to this problem. I am the
only developer in this city or any city as
far as I know that has agreed to pay
#3,000.00 to help eleviate a drainage problem
that is not all mine. Smithfield Road im-
provement and the development of other areas
caused part of this problem. I cannot be
responsible for-every drop of water that
goes into Hewitt St.
Mr. Britton recommended that this request
be denied.
Mr. Grubb moved, seconded by Mr. Biard to
grant this extension. Motion carried 4-0
with Mr. Wood abstaining.

TO COUNCIL MEETING FOR 8-23.
OLD BUSINESS
Mr. Wood & Mrs. Shaunty will attend.
Mr. Range had nothing to report from the
previous council meeting.
