CALL TO ORDER The regular meeting of the Planning and Zoning Commission was called to order by the Chairman, Mary Jo Shaunty, at 7:30 P. M. Britton Pauline Spain CONSIDERATION OF THE MINUTES OF AUGUST 26, 1976 Mr. Range moved, seconded by Mr. Biard to approve the minutes as written. Motion carried 5-0. . NEW BUSINESS PS 76-18 APPROVED Request of Mr. Van Hubbard, President, of Precept, Inc. for prelinimary plan of Industrial Park Addition. . Mr. David Hughes, Consulting Engineer, Elliott & Hughes, Inc., Euless, Texas presented this request. This property is west of Rufe Snow Drive and south and adjacent to the South- western Railroad tracks. It is zoned for an industrial park. It contains some 11.2 acres of land and we are platting it as Lot 1, Block 2, of Industrial Park Addition. Precept, Inc. is now located in Euless and they wish to move to this location because of the railroad and the interstate highway. Their business is surgical products and their raw materials are shipped by rail and the finished product is shipped out by truck. They have dedicated 2.9 acres for street which they will construct. They plan to construct a 120,000 square foot building to house their manufacturing plant, factory warehouse and office building. We will come in at a later date for the final plat. In the mean time we will discuss with the city staff the utilities and sewer. Mr. Hubbard will explain their operations, number of employees and building plans at that time. Mr. Range pointed out a discrepancy in point of beginning on metes and bounds description. 1 . Page 2 p & Z Minutes September 23, 1976 PS 76-12 APPROVED After discussion by the commission members, Mr. Biard moved, seconded by Mr. Grubb to approve PS 76-18. Motion carried 5-0. Request of Chester Wheeless for a replat of Lots 8, 9; 10, 11 and 12, Block 8 of Fossil Creek Trails. Chester Wheele$s, Jr. presented this request stating they purchased 5 lots but found the lots were not large enough for the houses they wished to build; therefore they wished to replat into 4 lots. Mr. Britton asked that the letter from Mr. Bronstad be a matter of record. Mr. Biard asked Mr. Wheeless if he understood Mr. Bronstad's letter. Mr. Wheeless stated the taps are seldom in the place they are supposed to be; however, we will take care of the cost to make a new tap if need be. . Mr. Grubb moved, seconded by Mr. Biard to approve PS 76-12 subject to Mr. Bronstad's letter of August 19, 1976. Motion carried 5-0. PS 76-13 APPROVED Request of Hamm & Sandlin for a -preliminary pl~n of Richland Terrace, 5th filing. Request of Hamm & Sandlin for a final plat of Lot A, Block 14, Richland Terrace Addition 5th filing. This property is located West of Davis Blvd. approximately 250 feet north of Maplewood. PS 76-14 APPROVED . Mr. O. D. Long Consulting Engineer, represented Messieurs Sandlin & Hamm on PS 76-13 & 76-14. PS 76-13 is preliminary plan of entire tract. I had word today to go ahead with the final plat. The final plat of Lot A, Block 14 is the primary interest at this time. Mr. Range questioned the N. E. corner of said tract according to the metes and bounds. Mr. Long said he was sorry but he could not speak for the surveyor but he would check it out and see if there is a problem. The surveyor and I work hand in glove, however I p~imarily.do th~ water, sewer and streets. Mrs. Shaunty asked about the small area belonging to the city. Mr. Long stated this is not in preliminary plan. 1 . Page 3 P & Z Minutes September 23, 1976 He said he believed there was some negotia- tions with the city to trade this property; I am not sure. There is some concern about a potential drainage problem. There appears to be some flooding in the area. My client may want to have an option of running an 811 water line rather than pay $7.50 pro rata. If he gets a good bid on the job he may be able to do better than $7.50. Ray Britton asked about highway approval of ingress and egress. Mr. Long said he hated to be so mis- informed, but Mr. Butler has handled -tÞe .dtive- way approaches. I don't get involved with driveway as such unless it is a part of my streets. I will be glad to check into this for you. I got into the tail end of this to expedite proceedings. Mr. Long was asked what the building on the final plat was for. He said he thought it was to be an office build- ing. Mr. Range asked if the highway approval had any bearing on the final plat. Mr. Britton said no. . After much discussion Mr. Range moved, seconded by Mr. Biard to approve PS 76-13. Motion carried 5-0. Mr. Range moved, seconded by Mr. Biard to approve PS 76-14 as presented. Motion carried 5-0. PZ 76-18 APPROVED Request of Joe W. Coulson to rezone 0.517 acre out of the T. K. Martin Survey, Abstract 1055 from it's present classification of Agriculture to a proposed classification of IF-9. This property is contiguous to the recently platted Coulson Addition. PS 76-15 APPROVED Request of Joe W. Coulson for preliminary and final plat of Coulson Addition 2nd filing. Mr. O. D. Long represented Mr. Coulson. Mr. Coulson has recently purchased another 1/2 acre. He wants to erase property line as he wants to move the house back so it will be on top of the hill. Escrow money from last platting will still be in effect. . After discussion r'1r. Wood moved, seconded by Mr. Grubb to approve PZ 76-18. Motion carried 5-0. 1 . Page 4 P & Z Minutes September 23, 1976 Mr. Grubb moved, seconded by Mr. Wood to approve PS 76-15. Motion carried 5-0. PS 76-16 APPROVED Request of Steak and Ale, Inc. for a pre- lininary and final plat of Carder Addition. This property is located at 8605 Airport Freeway. Mr. Long presented this request stating it is being platted as Carder Addition as it is in Carder Survey and as other property is platted, we hope it will be platted as Carder Addition. As for the engineers letter: Item #1. Mr. Bronstad said no pro rata share will be due. Item #2. Permit will be obtained from the highway department. Item #3. Mr. Bronstad said it will not be nece~sary for my client to extend water line North and West as the bank agreed to do so years ago. . After discussion by the commission members, Mr. Biard moved, seconded by Mr. Grubbs to approve PS 76-16. Motion carried 5-0. PS 76-17 APPROVED Request of John Barfield to replat Crestwood Addition. Mr. Long presented this request stating the replat basically backs up our plans that we submitted on the construction plans for Crestwood Estates. This tract is zoned Local Retail I believe, but we have some easements we want to get changed prior to the power company and telephone company coming in there. In order to get these in proper location we had to replat. Water and sewer is already there. We didn't go to the zoning commission first because the power compnay is ready to go in, so we are going in the back door and doing the platting first then later come in and rezone to residential. We have all letters from the utility companies~ Mr. Range moved, seconded by Mr. Wood to approve PS 76-17. Motion carried 5-0e PS 76-20 TABLED Request of Oscar Deaton for preliminary and final plat of Brentwood Addition - 2nd filing. Mr. O. D. Long presented this request stating this was formerly Petticoat Junction. Referring . 1 . Page 5 P & Z Minutes September 23, 1976 . to the engineer's letter; #1. The existing 2411 culvert he is referring to is on the south side and not the north. This culvert is part of the existing driveway. He is asking that we check out existing pipe on Hwy. 1938. I am sure my client is not going to dig out what is there and put in something larger. #2. I have tried to get with Mr. Bronstad to discuss the pro-rata share of the existing 611 water line. My client already has tap and meter set on that line. #3. I discussed this with my client and he doesn't want to do this. I tried to get this cleared before the meeting. I will discuss this with Mr. Bronstad and have it cleared up before the council meeting. #4. Presently has septic tank. #5. My client feels this property has been existing as Petticoat Junction and real estate office for some time and he doesn't feel he should pay for future paving of Davis Blvd. at this time. Mr. Long asked the commission to approve this request subject to engineer's letter. Mr. Britton said "I would like to suggest that this request be tabled until the next meeting". ~1r. Range added III was going to make same suggestion". Mr. Range moved, seconded by Mr. Wood to table PS 76-20 until the next meeting. Motion carried 5-0. PS 76-19 APPROVED Request for preliminary and final plat of lot 2, Kip's Big Boy Addition, 2nd filing. Mr. Long presented this request. This will be a Captain Dee's Fish 'N Chips. Referring to the engineer's letter; Item #1. We have not applied for permits, but will after your approval. #2. We will be working for desir- able locations of driveways. Mr. Wood asked Mr. Britton if Item #2 should be worked out previous to approval. Mr. Britton said no, he has plans in his office. Mr. Grubb moved, seconded by Mr. Range to approve PS 76-19. Motion carried 5-0. PZ76-15 APPROVED Request of Janis Campbell to rezone a portion of lots 24 & 25, Block 2, W. E. Odell Addition from it's present classification of IF-9 One Family Dwelling to a proposed classification of Local Retail. This property is located at the West side of Davis Blvd. and Odell St. . 1 . Page 6 P & Z Minutes September 23, 1976 Mr. Danny Campbell presented this request. Mr. Campbell said they planned to remodel the house, brick it and put in new windows. We plan to put in a beauty shop and dress shop. My wife has had a beauthy shop next to the Post Office in Smithfield for five years. Mr. Wood asked why he picked this area. Mr. Campbell said it seemed to be a good place for a dress shop and beauty shop. Mr. Biard said it fits the zoning ordinance. Mr. Campbell said we were told we had to brick the building. I would like to know why as I know of two on Davis Blvd. that have not been bricked but have aluminum siding. After much discussion by the commission Mr. Biard moved, seconded by Mr. Grubb to approve PZ 76-15. Motion carried 4-0 with Mr. Wood abstaining. PZ 76-16 DENIED Request of John McNary to rezone 2.9338 acres of Oak Leaf Park Addition from it's present classification of Agriculture to a proposed classification of Commercial. This property is located approximately 1775.74 feet north of Kirk Lane on Precinct Line Road. . Mr. John McNary present this request. Mr. McNary said he wished to have a rodeo, barrel jumping; outdooor recreation. I own 14 acres behind this property which I can use for stables. Mr. Britton asked if he was aware of asphalt paving, parking facilities and rest rooms. Mr. McNary said he would meet all requirements. Mrs. Shaunty asked "Ubat..is your capacity"? Mr. r~cNary said he had no idea. Mr. Grubbs asked Ills this for riding clubs, etc. II? ~1r. McNary said yes, it is an excellant location for outdoor recreation. People will bring their own horses and ride them in the back. . Mr. Abel D. Lajoie - adjoing property owner. We oppose this rezoning. We built a home and we want our property to stay agriculture. What assurance do we have that you will not sell this property once it is rezoned to commercial? We have no idea why you wanted to rezone this property. Mr. McNary told Mr. Jajoie he called the city hall and asked if he could have a rodeo, barrel racing and play area. He was 1 . Page 7 P & Z Minutes September 23, 1976 told the property would have to be zoned commercial. Mrs. Lajoie said if Mr. McNary constructed an asphalt street their property would be flooded out. Mr. Range asked Mr. Lajoie if he had stables. Mr. Lajoie said yes, he has a barn with 12 stables. Mr. Biard asked Mr. McNary how many acres he had. I have 30 acres; they would be together except for property Mr. Lajoie owns. Mr. Wood asked Mr. Lajoie if he and Mr. McNary could get together and relocate the arena. Mr. McNary stated it wouldn't be satisfactory too far back. He had rather drop the request than have his neighbors unhappy. Mary Jo Shaunty stated she understood Mr. McNary owned the land and shoulq be able to use the land but if it was rezoned to commercial it would be left wide open. . Mr. Carl Lampkin - adjoing property owner. Mr. Lampkin stated he opposed the commercial zoning. After much discussion by the commission members, Mr. Wood moved, seconded by Mr. Grubb to deny PZ 76-16. Motion carried 4-0 with Mr. Biard abstaining. Mr. Wood recommended someone with the city check adjoing property to see if there could be a zoning violation. PZ 76-17 DENIED Request of Calvin Stewart to rezone approxi- mately 13,000 square feet of the W. W. Wallace Survey, Abstract 1606, from it's present classi- fication of Local Retail-Specific Use-Sale of Beer for off Premises Consumption to a proposed classification of Local Retail-Specific Use- Mixed Beverages. This property is located at Ross Road and Davis Blvd. . Mr. Calvin Steward-4913 Katherine - NRH. Mr. Stewart asked for this S. U. permit to sell beer on premises. Mr. Wood asked Mr. Stewart how long he has owned this property. Mr. Stewart purchased this property in 1970. What kind of retail establishment do you have now? Mr. Stewart said barbecue, beer and groceries. How do you expect to handle any change? Do you expect to sell alcoholic beverages other than beer? How many tables do you have? I do . APPOINTMENT OF P & Z MEMBER TO COUNCIL FOR OCT. 11 APPOINTMENT OF P & Z MEMBER TO COUNCIL FOR OCT. 25 OLD BUSINESS ADJOURNMENT . 1 Dot plan to sell any alcoholic beverages other than beer; I plan to remodel and have 16 tables. Mr. Grubb asked if he realized he had to have a mixed beverage permit? Mr. Stewart answered yes. You don't 'have very much parking space. Have you had any com- plaints? Mr. Stewart said the highway depart- ment has not commented about the 'parking ,but have asked that signs be moved. Mr. Grubb asked what amount of food is consumed. Mr. Stewart said about 20%. Mr. Wood asked how much beer he sold now. Mr. Stewart did not know. What percent of beer do you sell with barbecue? Mr. Stewart did not know: Mr. Gary Stewart I manage a Dairy Queen. I plan to operate this business. Our business is food. We want the beer to accent the barbecue and not the reverse. After much discussion by the commission members Mr. Grubb moved, seconded by Mr. Wood to deny PZ 76-17 as there is not enough evidence to approve. Motion carried 3-2 with Messieurs Range and Biard voting against. Mr. Grubb will attend this meeting. Mr. Wood will attend this meeting. NONE The meeting adjourned at 10:15 P. M.
