The regular meeting of the Planning and Zoning Commission was called to order by the acting chairman, Mr. ~ene Welborn at 7:30 P,M. Glenann Addition - Replat Mr. Don Gill - Cameo Enterprises presented this request. Mr. Gill stated the contractor built a house too close to property line on lot 10. A replat of lots 10 thru 15 was approved November 20, 1973 but was not filed and recorded. Homes were built on lots 14 & 15 after the rep1at; therefore they had to chanqe lot sizes on said lots. Lots llR, l2R ~ l3R are 25 square feet smaller than ordinance requirements. Mr. Mills moved, seconded by Mr. Staples to approve PS 75-4 subject to engineers letter. Motion carried 3-0. Request of Doyle K. Fincher to rezone lot ñ, block 2, ~ollie B. Collins Addition from the present classification of Agriculture to a proposed classi- _ ficat;on of Local Retail. This property is located on Smithfield Road & Odell Street. Mr. Doyle Fincher - 7225 Little Ranch Road present- ed this request statinq he would like the property for retail ·purposes. ,. Request of Bill Lightfoot to rezone 1.766 acres of the S. Richardson Survey from the present classification of Agriculture to a proposed classification of Commercial. This property is located on Davis Blvd. approximately 1848 feet north of Rumfield Road. Mr. Bill Lightfoot - 1033 Harrison Lane, Hurst presented this request. Mr. Mills asked Mr. Lightfoot if he had been told the building would not conform to the zoning ordinance in its present state. He replied yes. ~~r. Staples moved, seconded by ~~r. r·~ills to approve PZ 75-8 with the stipulation that the building on the property will be brought up to conform to standards of the zoning ordinance with the walls and roof 90% fireproof. Motion carried 3-n. PZ 75-9 DENIED Request of Somerset National Corporation to rezone lot 1, block 1, Somerset Addition from its present classification of Commercial to a proposed classification of Specific Use-Private Club. This property is located at 7920 Bedford Euless Road, La Quinta ~~otor Inn. Mr. Clay Blakeway, Jr. presented this reouest. Mr. Blakeway stated the motel needs a private club to accomodate our customers. Without a private club we can not compete with other motels in this area. We have set aside an area to seat 36 people. . Mr. Kent Lacey-Manager of La Ouinta It is essential to us to have a private club. Competition demands it. One out of two customers asks if v.¡e have a private club. r'~any leave for another motel. AGAINST - Alice Rodgers - 4805 Grove St. This zoning would cause more trouble. I am against a private club. AGAINST - B. Niell 4804 ~rove St. I have lived in this area 16 years. It was zoned one family d\-Jelling, then cOMmercial. Private Club is just a nice name for a Cocktail Lounge. I believe if this is rezoned it will bring inthings we don't want. . AGAINST - poy Gifford 7908 Bedford Euless Road ~~y property joins this property on the tÞ!est. I believe this zonina would deteriorate the morals of the nei ghborhood and be more dangerous for our children. I feel it would be a step down and not up. ., . FOR - Vivian Haynes 7517 Deville I work for La Quinta and would like to see a private club in the motel as they need it. I am a taxpayer in this city and I feel it would be a help to the city, tax wise, if this zoning was granted. As for Mr. ~iffords property, it is more valuable since the motel \A/a's built. AGAINST - Mr. Jim Wolverton 4ROO Colorado You are going to dump the people riqht out in our neighborhood. The private club in the Bowling Alley dumps them onto the Highway. Alcohol is the biggest problem in the world today.. Mr. Mills moved, seconded by ~'r. Staples to deny PZ 75-9. fr1otion carried 3-0. ',1r. Mills stated, "In the opposition we have heard it is obvious a great deal of dama~e has been done by co~- mercial zonin~. For us to approve a Private Club we are extending damage further. I, in good concience, can not vote for it. II PZ 75-12 APPROVED Request of Quickway Shopping, Inc. to rezone lot 2, block 1, SMithfield ^ddition from its present classification of Commercial to a pro- posed classification of Commercial S.U.-Sale of Beer for off Premises Consumption. This property is located on Davis Blvd. at East t1ain Street in Smithfield. Mr. Bill ~umfor - Owner of Quickwa Sho in r'~r. Gumfory s owed ra~Jings of t e u; ding. He owns ten other stores, four sells qaso1ine. His beer sales are 15% and 9rocery sales 85%. . PZ 75-13 APPROVED Mr. ~1ills moved, seconded by Mr. Staples to approve PZ 75-12. ~r. Mills moved to amend the motion by adding the stipulation that if sale of groceries stops the zoning would revert to Commercial only. Motion carried 3-0. Request of Joe V. Henry to rezone Tracts 4Ql & 4HH of Abstract 1630 from its present c1assifi- eation of Multiple Family to a proposed classi- fication of Commercial. This property is located on ffarmonson Road and Flory Street. ~,1r. Joe Henry - 125 Cooper Ori ve - Hurst Mr. Henry was asked his reason for this zoninq. He stated, wholesale parts & supplies. r~r. E.R. Taft, Hurst Mr. Taft stated he was not opposed to this zoning but \~/anted to tell the COMmission they were unlawfully rezoning property. Mr. Mills asked Mr. Henry if he would be will- ing to dedicate to the City a five foot right- of-way for street improvements on Flory and Harmonson. Mr. Henry said "yes". * Mr. Mills moved, seconded by Mr. Staples to ap- prove PZ 75-13 with the stipulation that an ad- ditional 5 feet of right-of-way be granted to the City on Flory St. and Harmonson Rd. and the house be brought into conformance with building code. Motion carried 3-0. PZ 75-14 DENIED Request of Farrington & Associates to rezone 8.05 acres of the W.W. Wallace Survey from its present classification of IF-12 One Family Dwell- ing to a proposed classification of IF-9-l5. This property is contiguous to Block 19, Snow Heights Addition and Blocks 1, 2 & 3 of Skyline Homes Addition. PZ 75-15 DENIED Request of Farrington & Associates to rezone 2.73 acres of the W.W. Wallace Survey from its present classification of IF-12 One Family Dwell- ing to a proposed classification of Multiple Family. This property is West of proposed IF-9- 15. . PZ 75-16 DENIED Request of Farrington & Associates to rezone 8.71 acres of the W.W. Wallace Survey from its present classification of 1F-12 One Family Dwell- ing to a proposed classification of Local Retail. This property is located on Rúfe Snow Drive between Shauna Drive and Victoria Ave., West of proposed Multiple Family. Mr. David Farrington - Farrington Associates We propose to develop IF-9 around the entire area. Riveria Drive would be open to Rufe Snow Drive, Oliver Dr. & Georgia Ave. would open into a new street. There would be town houses facing IF-9 One Family Dwellings. Local Retail would""'be set back from Rufe Snow so interior court would be focal point. This is a proposal; no firm buyers. Parking space does conform to ordinance. Mr. Mills asked, You are asking for zoning and if granted, the entire plan could change? Mr. Farrington agreed. . AGAINST - Mr. N.W. Clinger 6701 Victoria Mr. Clinger stated the petition included all but four people within 200 feet of said property. We are against this zoning, we feel it will 'down grade our property. If the local retail did go through, apartments could be built. Apartments are not needed. If all property zoned Multiple Family were developed the population could double. Also, we don't need more retail area. Richland Plaza is begging. We should patronize what we have rather than build more. Water is a problem * AMENDED . . . PZ 75-14 PZ 75-15 PZ 75-16 v. APPOINTMENT FOR COUNCIL MEETING APRIL 28 VI. OLD BUSINESS VI I ADJOURNMENT now, this would make it worse. There is a time limit for every thing. Time for this piece of property to be developed has long passed. It should have been developed as IF-12 the same time the area was developed. We have been living here 15 years. The developers wanted to develop this property at that time but Mr. Weaver would not sell. MARY JO SHAUNTY CAME IN AT 8:50 P.M. AGAINST - Mr. Ben Shilcutt - Rufe Snow Drive Mr. Mills moved, seconded by Mr. Staples to deny PZ 75-14. Motion carried 4-0. Mr. Staples moved, seconded by Mr. Mills to deny PZ 75-15. Motion carried 4-0. Mrs. Shaunty moved, seconded by Mr. Mills to deny PZ 75-16. Motion carried 4-0. Mr. Mills stated, "This area is zoned for single family residences. The application for zoning local retail is so vague I feel we would be open- ing pandoras box to grant this request. I can not sit up here and go against 54 property owners" .
