Investment - Brian100d Estates Final Plat Motion made by Mary Jo Shalli~ty, seconded by Mr. Mills to move this request to end of agenda as there was no one present to present this request. PS 74-5 APPROVED Request of J. Barfield - Brentwood Estates, Pre- liminary and Final Plat. Mr. John Barfield presented this request stating Bell Telephone Company wanted an easment across property. He requested this change that he might dedicate· the street right-of-~'lay for Sþady Grove Road so that Bell Telephone Company can lay a ne~~ conduit in the par~vay of this proposed street. ~~. Barfield stated he would develop area now if setver and tiater \"1ere available.· .:: After much discussion concerning selling of property after street is dedicated \o¡ithout escrO~T for de--- ve19ping the street Dr. Hager moved, seconded by ~lary Jo Shaunty to grant this request vlith the stip- ulation that any further action of this property must meet all present subdivision ordinances. Motion carried 5-0. ~ PZ 74-4 TABLED Request of Mobile Homes of America to rezone 45.064 acres out of the M. Lynch Survey from its present classification of "Specific Use" (Commercial Recreational) to a proposed classification of "Mul- tiple Family". . Mr. Sterling Steves presented this request, stating he requested the rezoning to obtain the highest and best use of the property. He stated nothing could be built until the flood plane was corrected and it would be very costly, requiring 1/2 million cubic yards of fill; therefore the apartment develop- ment would have to be of the highest caliber. Mr. Q. C. Long spoke for Mobile Homes of America. Mr. Long was hired by Republic National Bank of Dallas earlier to make an engineering study of said property. Mr. Long suggests a new channel be located along west side of property with a new bridge to be located on Onyx Drive at this location. Total right of way needed for Fossil Creek determined to be 250 feet wide along west side of property, approximately 10 acres. Mr. Long suggested the dirt from the new channel be used for fill on the east 15 acres of said property. It would take a total of 620,000 cubic yards of fill for the entire property. The property could be available for dumping dirt, rock or concrete as fill. -. Dr. Hager suggested Planned Development Zoning. Mr. R. L. Bourland spoke for Mr. Charlie Lewis in opposition of this request. Mr. Bourland stated after Buffer screening on east and land used for changing the channel there would be little acreage for Apart- ments, without ~llowing 20 apartment per acre with an average of 3 persons and 2 automobiles per apartment. Mr. Tommy Peters of Diamond Oaks Drive and Mrs. Carol Ridge of Diamond Loche spoke in opposition of this request. Mrs. Dewey May of 6200 Onyx Drive North spoke in opposition stating there is only one exit from the area therefore this would cause much traffic congestion. If developers came in and started preparing property for building and found it too expensive, they could leave it and the adjoining property could be flooded. Two letters of opposition and one in favor were sent to the commission members. . . . . Motion carried 5-0. Request of Stop "N Go Harket to rezone 5g,725 sqllal--e feet out of the ~·l. \'1. lJallace Survey, Abstra.ct 160~ from its present classiîication of I?Cornrnel-'ciål" to a proposed classification of "Commercial S. U.u·Sale of Beer for off premise consumption. Ivlr. Dr:¡ayne 1'lilcox represented Stop uN Go r'larket. Nr. Gary Hutzel of 7713 Jennetta of Davis Nemorial Methodist Church opposes this request due to teen club in same building. He had eleven people in the audience to stand. The Reverand J. D. Hazelwood, pastor of Davis Memorial Methodist Church stated he represented the Church unanimously in opposing this request. Steven McCoween of the Davis Boulevard Baptist Church was in opposition. After discussion by the commission rnembers l:Irs. Shaunty moved, seconded by Dr. Hager to deny this request dûe to teen area in same building and opposition here tonight. Motion carried 4-1. Mr. Mills voting for request. Request of 121 Incorporated to rezone 19,754 square feet-· ·from the \~. ~I. '~¡allace Survey, Abstract 1606 from its present classification of Local Retail to a proposed classification of Local Retail S. U. Sale Of Beer For Ofr Premise Con- sumption. James Leggett III presented this request. Franklin Earney spoke in opposition. Stating the general locale of said property is in bad location due to traffic and congestion. After discussion by the commission Dr. Hager moved, seconded by ~ar~ Jo Shaunty to deny this request due to traffic safety problems ~~d highly congested area. Motion carried 5-0. Request of D. & D. Investment - BriarvTood Estates Final Plat. 11r. O. D. Long presented this request. After discussion by the cO~~lssion members Mr. Welborn moved, seconded by Mary Jo Shaunty to approve this request with the stipulation of compl~·~g with letter from the City Engineer. r..íotion carried 5-0. . ~. .
