PS 74-7 APPROVED PS 74-8 APPROVED ~ }1INUTES OF THE 1vlEETING OF THE PLANNING AND ZONING CO~1ISSION OF THE CITY OF NORTH RICHLAND HILLS, 4101 MORGAN CIRCLE THURSDAY, MARCH 28, 1974 The regular meeting of the Planning and Zoning Commission was called to order by the Chairman, Mr. Charles Palachek, Jr. at 7:35 B.M. CLERK Mr. Allen Bronstad Mrs. Pauline Spain ABSENT: VICE CHAIRMAN Dr. Charles Hager Mr. Denver Mills Mary J Shaunty moved, seconded by Mr. Welborn to approve the minutes of the February 28, 1974 meeting as written. Motion carried 3-0. Request of Henry Nielson to revise Lots 8, 9 & 10 of Block 3 of Valley Park Estates. As no one came forward to present this request Mrs. Shaunty moved, seconded by Mr. Welborn to transfer this request to the end of the agenda. Motion carried 3-0. Request of Holiday North Joint Venture to revise Lots 3 & 4, Block 13 of Holiday North, Section 4. l1r. Calvin Luper represented Holiday North Joint Venture stating until recently they did not realize there was not enough area on the corner lots to build a house with the 25 ft. setback on both front and side.. They would like to move pr.o.pé,r.t..z line back 10 feet to the North & South common boundry line. After discussion by the commission members Mrs. Shaunty moved, seoonded by Mr. Welborn to approve this replat. Motion carried 3-0. Request of Wayne Richardson - Preliminary Plat of Central Park Addition 2F-9 & Local Retail. Mr. O.D. Long represented Mr. Richa"'dson. If this preliminary plat is approved Mr. tichardson will come back for a zoning change as the preliminary plat doesn't comply with original zoning. ~ . After discussion of the engineers letter by the commission members Mrs. Shaunty moved, seconded by Mr. Welborn to approve this preliminary plat subject to engineers comments. Motion carried 3-0. PZ 74-7 APPROVED Request of Kimbell, Inc. to rezone .39 acres of the J.H. Barlough Survey from its present classification of IF-9 One Family Dwelling to a proposed classification of Local Retail. Mr. J .B. Oujesky of Kimbell, Inc. presented this request asking for zoning change to tie in approximately a four acre tract as the futUre plans are for a Buddies Super Market. After discussion by the commission members Mr. Welborn moved, seconded by Mrs. Shaunty to approve this zoning change. Motion carried 3-0. PZ 74-8 APPROVED Request of John Barfield to rezone 38.97 acres of the W.D. Barnes and Wrn. Cox Surveys from its present classification of Agriculture to a proposed classification of IF-9 One Family Dwelling. '. 11r. Long and Mr. Barfield presented the following three zoning changes. Mr. Welborn asked Mr. Barfield when he planned to develop said property. Mr. Barfield stated he would start immediately following approval of zoning. MR. MILLS CAME IN AT 7:55 AND WAS GIVEN DETAILS ON PZ 74-8 THUS FAR. After discussion by the commission members Mr. ~..ills moved, seconded by Mr. Welborn to approve this request with the stipulation that 30% of the houses have 1600 square feet or more, 35% have 1500 square feet and 35% have 1400 square feet or more. Motion carried 4-0. PZ 74-9 APPROVED Request of John Barfield to rezone 7.55 acres of the W.D. Barnes & Wm. Cox Surveys from its present classification of Agriculture to a proposed classification of Local Retail. After much discussion between the commission members, Mr. Barfield, Mr. Long and Mr. Moak Mr. Welborn moved, seconded by Mr. Mills to approve this zoning. Motion carried 4-0. PZ 74-10 APPROVED Request of John Barfield to rezone 9.85 acres of the W.D. Barnes and Wm. Cox Surveys from its present classification of Agriculture to a proposed classification of 2F-9 Two Family Dwelling. . After discussion by the commission members Mr. . . . ~ Welborn moved, seconded by Mrs. Shaunty to approve this request with the stipulation that each unit has a minimum of 1200 square feet and provides adequate off street parking. Motion carried 4-0. PZ 74-11 APPROVED Request of D ~ D Investment Corp. to rezone l3.69 acres of the John Barlough Survey from its present classification of Multiple Family to a proposed classification of Industrial. PZ 74-12 APPROVED Request of D & D Investment Corp. to rezone 16.71 acres of the John Barlough Survey from its present classification of IF-7 One Family Dwelling to a proposed classification of Industrial. Mr. O.D. Long presented these requests. He stated D & D Corporation has had request for light industry with office in front and ware- house in back. After much discussion by the commission members Mr. Mills moved, seconded by Mrs. Shaunty to grant this rezoning with the stipulation that West l50 feet and North 150 feet be used for nothing other than Commercial, conforming to article 6 of the Zoning Ordinance. Motion carried 4-0. PZ 74-13 APPROVED Request of Richland Plaza Limited Partnership to rezone 42.08 acres of the Mahaley SUrYey from its present classification of Local Retail to a proposed classification of Commercial. Mr. Larry Rice represented Richland Plaza Limited. He stated Mr. Frank Shaffer and Dan Rubin advanced cash, etc. with hope of rebuilding the Plaza. Their plans are to look for new tenants and remodel and bring it up to date with other shopping malls. In the meantime they have the opportunity to lease 101,000 square feet to an electronic Corporation for training personnel. This will require Commercial Zoning. Mr. Filardi representing o"tmers of Multiple Family property North of the Plaza stated they planned to build soon and would not like an offensive business backing up to the apartments. Arter discussion by the commission members Mrs. Shaunty moved, seconded by Mr. Welborn to approve this request. Motion carried 4...IJ. PZ 74-14 . . * A 6 ft. tallscreening fence, stockade or equivalent to be built along property line beginning at Parker Stone Co. and going approximately 100 feet or to some logical point to go across to the building line PZ 74-15 TABLED . ~ Request of Hamm & Sandlin to rezone 0.86 acres out of the London G. Walker Survey from its present classification of Local Retail to a proposed classification of Commercial. Mr. Alan Harnm stated said property is under contract to be sold to A R A Rental. This is the reason for zoning commercial. Mrs. Alice Nunley - Against. :r.'"œs. Nunley stated she must oppose this rezoning. It would create more noise and traffic on Highway 121. She talked to many people about this, one was for it, one undeèided and the balance were against it. Mr. Gary Fox, owner of ARA Rental spoke for this request. He stated their normal hours are 7 A.M. to 6 P.M. six days a week. They have a variety of equipment; the largest is a Ford tractor. They also have one fork lift. Their lease in Hurst is up in May 1975 and they decided to buy rather than lease property. * After much discussion by the commission members Mr. Welborn moved, secondsd by Mr. Mills to approve. Mr. Mills moved to amend the motion with the stipulation that a 6 foot tall screening fence be built along property of adjoining Stone Co. approximately lOO feet to building line. Mrs. Shaunty seconded this amended motion. Motion carried 4-0. Request of Rita Moore to rezone Lot9, Block 31 in Nor ' East Addition from its present classification of IF-9 One Family Dwelling to a proposed classification of Local Retail. Mr. Neil Adams, attorney, represented Mrs. Moore. He spoke about the local retail and connnercial zoning around Mrs. Moores property, showed pictures, discussed aaailability for parking according to zoning ordinance arid stated there would be no signs. Mrs. Gladys Tucker of 7751 Nor'East Drive was for this request. Mr. Carr of 5409 Davis Blvd. was for this request. There was no opposition. After much discussion by the commission members Mr. PaJ.aèhek, Jr. explained this would be spot zoning. He explained the dangers of spot zoning and stated the commission members were against such zoning. He explained refusal of spot zoning is for . . . PZ 74-l6 APPROVED PZ 74-17 APPROVED CITIZEN'S PRESENTATION PS 74-6 APPROVED ADJOURNMENT 4~~ SECRETARY, PLANNDIG AND ZONING ~ the protection of all property owners. Mr. Mills moved, seconded by Mr. Welborn to table this request until later date. ~lotion carried 4-0. Request of Morris E. Riddle to rezone 4.00 acres of the J.B. Eden Survey from its present classification of Agriculture to a proposed classification of IF-12 One FaIiJily Dwelling. Mr. O.D. Long represented Mr. Riddle. Mr. Riddle has four acres and is selling two acres but as the frontage is not wide enough the property has to be rezoned. A 1400 square foot house is to be built on property to be sold. After discussion by the commission members Mr. Mills moved, seconded by Mr. Welborn to approve this request. Motion carried 4-0. Request of J.P. Birdwell to rezone Lot 5C, Block 1 of the Jack M. Estes Subdivision from its present classification of Local Retail to a proposed classification óf Commercial. After discussion by the commission members Mr. Mills moved, seconded by Mrs. Shaunty to approve this rezoning. Motion carried 4-0. MRS. SHAUNTY LEFT THE l1EETlliG AT THIS TIME. Þfr. Atkins was unable to attend the meeting. Mr. Nielson was not at the meeting. Mr. Bronstad explained they were building a house on 3 lots and wanted it replated. After discussion by the commission members Mr. Welborn moved, seconded by Mr. Mills to approve this replat. Motion carried 3-0. Mr. \ielborn moved, seconded by Mr. Mills to adjourn. The meeting ·ourned at 11:05 March 28, 1974.
