Mr. Palachek moved, seconded by Dr. Hager, that the minutes
be approved of the ,January 25, 1973 meeting. All mEmbers
present voting affirmative. Vote being 3-0.

DENIED Request of Mr. Oliver A. Pettit Jr. to rezone Lot 10, Block 2,
North Richland HiUs Addition traa its present classification
of "IF-12 One Family DwA"i"g" to a proposed classification of
"Local-Retail". .
MR. OLIVER A. PETTIT JR. - FOR
Mr. Pettit came forward to present his zoning request to the
Canm1ssion. He stated he would like his property rezoned in
order to lease for a beauty shop, or ceramic school. At this
time there is a 3 bedroan with 2 bath heme on the property.
The lease would state the lessee would reside at this location,
and having a place of bt1sines8 at the same time.

Mr. Gene Miller of 4120 Cummings Drive West came forward
repreàenting a group of property owners that were in
opposition ot the zoning change. He asked the group to
please stand that were in the audience. Mr. Miner presented
a petition signed by the property owners. He stated their
property deed was :tor residential lots and hanes in the area,

and not for any type business. He pointed out the feeling of
the property owners in the area was it anyone wanted a
business to lease or buy property tor business, and not use
residential property. After discussion by the members of the
Cœunission, Dr. Hager moved, seconded by Mr. Palachek to
DENY this zoning request. Motion carried by a vote of 3-0.
All members present voting to deny- this request. The CŒII1iss1on
stated this would be spot zoning, and they were not in favor
of spot zoning.
Request of Mr. W~e Richardson, and Mr. Jim McCoy to rezone
2.565 acres out of the John Barlough Survey.t Abstract No.
1,30 traa its present classification of "Agriculture" to a
proposed classification of "2F-9 'lito F8I11iq Dwellingu.
Request ot Mr. W~e Rich&rdson~ and. Mr. Jim McCoy to rezone
5.517 acres out of the John Barlough Survey, and the J.C. Me
Canas Survey traa its present claasification of "Agricultureu

Cases PZ 73--3, PZ 73-4, and PZ 73-5 were considered at the same
time.

Mr. Long came forward to present these zoning request to the
Cœmission. He asked if he could present the three cases at
the same time. Mr. Rinn stated he could.
Mr. Long pointed out to the Commission this tract of land on
the map. This tract is just North ot the presentq zoned "IF-7"
to the West is "Multiple FamiJ.y1t backing up, and. the railroad
is South of this tract.

West Main Street is stubbed in to the East ot this tract.
The proposed ItLocal-RetaU" would be for oflice professional
type business.
The proposed "Multiple F~tt would be for Townhouses for
sale, and some of the "M-F" tor rent.
The proposed tt2F-9 Two Fami.1y Dwelling" would back up to
residential property.
MR. IDY J. STURCH - IN QUESTION
Mr. Sturch came forward stating he owned property at the end
ot West Main Street, and. wanted to know if West Main would be
opened, or if it would remain as a dead end street. Mr. IAng
stated. his client had no use tor West Main Street. Mr. Rinn
pointed out this was not subdivision, onJ.;y a zoning request.
Mr. Long stated they needed ~ the North - South street using
C!1e.pnan Drive. Mr. Sturch said he was not in opposition, just
concerned about the street. He hoped it would rEID&in dosed as
it is at the present time.

Dr. Hager moved, seconded by" Mr. Palachek to APPROVE PZ 73-3
zoning request. Motion carried 3-0. All members present voting
affirmative.
Mrs. Shaunty arrived at 8 P.M. to the meeting, and was too late
to hear this request, and could not vote.
PZ 73-4
Mr. Palachek moved, seconded by" Dr. Hager to DENY this zoning
request. Motion carried by" a vote of 2-1. Mrs. Shaunty had
arrived at the meeting too late to hear this request, and
could not vote.
Dr. Hager made a motion to reopen Case PZ 73-4. seconded by"
Mr. Palachek. After consideration of this case by" the m8l1bers
present, Dr. Hager moved, seconded by" Mr. Palachek, to APPBBVE
this request. Motion carried 4-0. All members present voting
affirmative.
PZ 73-5
Dr. Hager moved., seconded by" Mr. Palachek to TABLE this request
until the end ot the meeting. This was due to the lack of a
second. At the time this was presented later in the meeting,
the Cœanission asked Mr. Richardson, and. !ú-. McCoy if they
wouJ.d amend their application .frcIn tfMu.J.tiple Fami.1y Dwellingff
to "2F-9 Two F~ Dwelling". They stated thq would agree
to this change, but would like fro them to reconsider PZ 73-4
in order they could consider their street construction on
this property. After discussion by the members, Mrs. Shanuty
moved" seconded by Mr. Palachek, to APPROVE this application
amended .trom the request of UMultipJ.e FamiJ.;y Dwe1ling1f to
f12F-9 Two F~ Dwelling". ~Iotion carried 4-0. AU members

of the W.A. Trimb~e Survey, Abstract 1520, T. Akers Survey,
Abstract 19, and R.P. Barton Survey, Abstract 175 tram its

Request of Fossil Creek Partnership to rezone 132.78 acres out
of the W.A. Trimble Survey, Abstract No. 1520, the R.P. Barton
Survey, Abstract No. 175, and the J.M. Vandusen Survey, Abstract
No. 1588 trœn its present classification of "Agriculture" to a
proposed classification of ItMultiple Family Dwelling".
Request ot Fossil Creek Partnership to rezone 32.40 acres out
of the W.A. Trimble Survey, Abstract J.52O and the R.P. Barton
Survey, Abstract 175 tran its present classification of
"Agriculture" to a proposed classification of "IF-12 One
Fami],y Dwelling".

Cases PZ 73-6, PZ 73-7, PZ 73-8, and PZ 73-9 were considered
at the same time.
Mr. Barta stated the overaJJ. plan developnent was for the best
land use. Plats and maps were displayed for the members ot the
Commission, and. for the audience. The land layout was explained.
It was pointed out that the lakes would be retained. Traf.fic
flow was discussed. The proposed Ccmnercial would consist of
offices and. warehouses for storage. The Local-Retail 'WOtÜ.d
consist of offices, and general. retail. The Multiple Family
Dwelling would consist of condaninium type units for sale at
approximatel;y $40,000.00. This making the property owner
having ccmnon interest in the recreational area. This consisting
ot swimming pools, and tennis courts. The IF-12 One Family

DweUing would carry the highest restrictions. The homes around
the lakes would be higher priced hClIles.

Various members came forward rraa the audience to speak on the
proposed issues. The general concern was the traffic flow tor
the area, the tact the townhouses would create too much population
for the schools, and the Haltom City residents that adjoin the
proposed IF..12 One F~ Dwelling wanted the same size square
footage on the proposed hanes as they have at the present time.

Dr. Hager moved, seconded by Mrs. Shaunty to APPROVE this
zoning request. Motion carried by a vote of 4-0.
Mrs. Shaunty moved, seconded by Mr. Palachek to APPROVE this
zoning request. Motion carried by a vote of 4-0.
Dr. Hager moved, seconded by }tfr. Palachek to APPROVE this
zoning request with the stipulation of owner type onJ..y, and
no rental. This stipulation also included the 300 feet on the
East edge of the tract toward Rufe Snow Drive to remain IF..J2
One Family Dwelling.

Mr. Palachek moved, seconded by Dr. Hager to approve this zcming
request with the stipulation ot 2~OOO squ&re foot hcraes in the
IF-12 zoning request as the minimum with 12,000 square foot lot
area as the m1n1mum. Jtlotion carried 4-0.

Mr. Rinn pointed out that break away gates could be used during
construction in order to keep the heavy trucks and construction
flow tran using the streets in the area.
