CALL TO ORDm The regular meeting of the Planning and Zoning Commission was called to order by Chairman, Mr. Louis E. Rinn. ROLL CALL PRESENT : Chainnan : Vice Chairman: Secretary: Mr. Louis E. Shaunty CITY STAFF PRESENT: Director of Public Works: Çity Clerk: Allen Bronstad Betty Terrell ABSENT : None CONSIDERATION OF MINUTES OF THE FEBRUARY 22, 1973 RFnULAR MEETING Dr. Hager moved, seconded by Mr. Palachek, that the minutes be approved ot the February 22, 1973 regular meeting. Motion carried 4..{). Mr. Welborn abstaining not being present at the meeting. ITm3 ON AGENDA FOR RFnULAR PLANNING AND ZONING COMMISSION MEETING I. PZ 73-10 DORIC INVESTMENT CORPORATION APPROVED Request of Doric Investment Corporation to rezone 29.839 acres more or less out of the John Condra Survey, Abstract 310 fran its present classification of "Agriculturel1 to a proposed classi- fication of IfIF-12 One Family Dwelling". MR. BILL DUNN - FOR Mr. Dunn came forward to present this zoning request to the Conmdssion. He stated the houses would have a minimun of 1,600 square feet of living area, and possibly 1,800 square feet. He pointed out the price range would be in the upper $30,000.00 bracket. Mr. Dunn said they were now building in Diamond Loch Addition, and all houses would be above the IF-12 requirElllent. MR. RALPH PARKS - FOR . . . II. PS 73-4 GREEN OAKS ESTATES PRELIMINARY AND FINAL PLAT APPROVED III. PZ 73-11 C.F.· GRm'HAM AND DOUG HIooms APPROVED Mr. Parks stated this type zoning request was tor the highest and best use of the land. MR. BILL DICKSON - QUESTION Mr. Dickson came forward asking if these homes would be on septic system or if sewer would be available. The area is on septic system, and Mr. Dunn stated he was having a percolation test made on each lot as required by the County Health Department. This must also be approved by the Health Department before any building can begin. Mr. Dickerson stated he felt this would make too :many houses for the area, and he had invested a lot of money in his hane. After discussion by the members ot the Commission, Mr. Welborn moved, seoonded by Mrs. Shaunty, to approve this request with the stipulation of 1,600 square feet of living area. Motion carried 5..{). All members present voting a.t'tirmative. MR. BILL DUNN - FOR Mr. Dunn came forward to present this request to the Commission. He pointed out this was the same property that had been approved for IF-12 One Family Dwelling in Case PZ 73-10. He pointed out there would be curb and gutter, storm drains, and good streets. This would be above anything in the area. He said he gave up 40 feet across the entire front ot this properly for the widening of Edmond Spronce Road. Mr. Rinn asked if he was aware of the letter of cœmnent for the City Engineer, and he said he was. He said funds would be put in escrow before any construction began, and he had worked with his &gineer as well as the City Engineer, and would canply with anything required. After discussion by the members of the Cœmnission, Dr. Hager moved, seconded by Mrs. Shaunty, to approve this preliminary and final plat with the stipulation ot canplying with the letter £ran the City Engineer. Motion carried 5'-0. All members voting a.t'firmative. Request ot Mr. C.F. Grantham and Mr. Doug Higgins to rezone 0.46 acres out or the A.G. Walker Survey, Abstract 1630 fran its present classification of "Multiple F8.1Diq" to a proposed classification of "Cœønercial". . . . IV. PZ 73-12 PHILLIP BERNSTEIN TABLED MRS. SHAUNTY - FOR Mrs. J.W. Shaunty of 5005 Cummings came forward to present this request to the Commission. She stated her husband had purchased. this property under contract that it was Cœmercial. The wrong tract ot land was shown on the plat by the surveyor, but the legal was correct. This being located at 681.7 Harmonson Road. This zoning request was approved by the City COWlcil February 10, 1969. This plat has now been corrected. Dr. Hager stated this was more of a map change, rather than a zoning change. This was the only way to correct this mistake fran the lagal point. Mr. Palachek moved, seconded by Mr. WeJ.born to approve this request. Motion carried 4..{) with Mrs. Shaunty abstaining. Request of Mr. Phillip Bernstein to rezone 0.89 acres out of the M. IQnch Survey fram its present classification of "IF-7 One F~ Dwellingn to a proposed classification of nCamnercialtt. IYffiS. BmNSTEm - FOR Mrs. Bernstein came forward to present this request to the Commission. She stated they were requesting this type zoning for a cabinet shop. The bni1qing would be of masonry and and would front on Harmonson Road. She said this was vacant property at this time. Mrs. Bernstein stated she bad talked to various property owners, and they wanted to rezone their property also. MRS. ELSIE COTE - FOR 141-s. Cote of 6505 Harmonson came forward in favor or this zoning change. She stated. she thought this would be better for the cormnunity, and a better tax revenue for the City with a business, rather than vacant property. MR. JIMMY RAY PARKER - AGAmST Mr. Parker of 3917 Honey Lane came forward in opposition of this request. He said this property abuts his property and home, and did not want camnercial zoning. He stated he also had rent property, and there was no need for camnercial. MR. KEMP BARRa; - AGAINST Mr. Barrow of 6504 Harmonson came forward in opposition of this request. He stated he was speaking for his mother who was el.derJJr. . . . v . PZ 73-13 CAMCO ~RISES, INC. APPROVED VI. PZ 73-14 CAMCO ENTERPRISES , INC. APPROVED. He said he recognized the fact it was an oJ.d area" and SCI'll8 parts were .~ l'Un down, but this would create too much traffic flow on Harmonson. Atter discussion by the members of the Camnission, Dr. Hager moved, seconded by Mr. Welborn to Table this zoning change until the next month meeting. The reason being this would be spot zoning at this time, and if most of the property owners want their property rezoned then the area could be rezoned. This meaning each property owner would have to apply tor the zoning request. Motion carried 5..{). l\equest ot Cameo ~erprise8, Inc. to rezone 5.76 acres out of the T.K. Martin Survey, Abstract 1.055 !ran its present classification ot "Agriculture" to a proposed classification of nIF-9 One Family Dwelling". MR. GLENN BUCKNER - FOR Mr. Buckner of 7728 Mary Drive came forward to present this request to the Camnission. He stated this would be a part of Glenann Addition. He would maintain the 1,500 square toot minimu.n on the houses, same as Phase 2" and Phase .3. They would have a two car garage, and be brick hClnes. Dr. Hager moved, seconded by Vœ. Palachek, to approve this zoning re- quest. Motion carried 5..{). All mEmbers voting affirmative. Request of Cameo Enterprises, Inc. to rezone 1 acre out of the T.K. Martin Survey fran its present classification of "Agriculture" to a proposed classification of uIF-9 One Family Dwellingtt. MR. GLENN BUCKNER - FOR Mr. Buckner came forward to present this request to the members of the Cœunission. He stated the reason for the 1 acre tract was he wanted to make two (2) One Half acre tracts with the J.,500 square foot minimun restrictions or more. This woul.d carry on Sizmnons Road, and Phase 2. Mr. Welborn moved., seconded by Dr. Hager, to approve this zoning request. Motion carried 5..{). All mElnbers voting affirmative. . . . -VII. 'PS 73-3 GLENANN ADDITION SECTION 3 FINAL PLAT APPROVED VIII. PZ 73-15 ALAN FlAMM AND J.B. SANDLIN DmIED Request of Final Plat approval for Glenann Addition Section 3. MR. O.D. LONG - CONSULTING ENGINEER - FOR Mr. long came forward to present this request to the members of the Camnission. He pointed out this would be improving property adjoining his tract at this time. Mr. lDng discussed the plans to the members. He pointed out Councilman Cato had voiced sane concern about Chilton Drive being stubbed out, and this now corrected on the plat as sutmitted at this time. Mr. ~in on Simmons Drive checked the street locations with Mr. Buckner and Mr. Long. MR. JIM MARTIN - QUESTION Mr. Jim :Martin asked about the 100 feet of undeveloped property. The rep1y was it w:i..ll remain undeveloped. Mr. Palachek moved, seconded by Mrs. Shaunty~ to approve this request. Motion carried 5..{). All members present voting affirmative. The members felt this was a good developnent to increase acreage. Request Qf Alan Hatmn and J. B. Sandlin to rezone 7.55 acres out of the W. w. Wallace Survey from. its present classification of uIF-9 One Family DweWng" to a proposed classification of "2F-9 Two Family Dwelling". MR.. CALVm LUPm .. FOR Mr. Iuper came forward to represent Mr. Hamrn and Mr. Sandlin in this zoning request. Mr. Iuper read a letter to the mEmbers concerning land use and population :trom the Texas Hig~ Department and the U.S. Census Ibreau. Mr. Iuper also asked additional consideration to be given to the tact that the . owners would install a (6) six foot stockade fence within (6) months after the zoning was approved. They also guarantee that all drive ~s and garage entryways shall be from the street side of streets within this proposed developnent. Mr. Luper stated with this assurance being publicly stated and entered into the minu.tes of this meeting" he hoped the Camnission would consider this zoning request favorably .He pointed out they would maintain the fences as long as they owned the property. MR. JIl-í PE:NNY - AGAmST Mr. Penny of 5513 Topper came .forward in opposition ot this zoning change. He wanted it to remain single family dwelling as it would be too overcrowded. MR. DON NORGARD - AGAINST . Mr. Norgard of 5501 Topper came forward in opposition. He stated some of the property was low, and some of it needed cleaning up. . MR. MARK KEATING - AGAINST Mr. Keating of 7621 NortEast Drive came forward in opposition. He stated he would like tor it to remain the same, but it it was approved he did want a high quality fence. MR. KENT LOvm - AGAmST Mr. lDvin of 7624 Circle Drive came forward in opposition. He stated there was too much traffic in the area now, and it would over crowd the schoo1s if approved. MRS Bm'Y PE:NNY - AGAmST :Mrs. Penny of 5432 Greenwood \'Ý~ came forward in opposition. She stated the schools were too crowded at the present time. J..1RS.. SHELIA NORGARD - AGAINST }frs. Norgard came forward in opposition of this request. She lives at 5501 Topper. It is too crowded in the schools at the present time, and would. make too much traffic in the area. Request of O.D.S Construction Ccmpany, Inc. to rezone Lot 5, Block 23, Clearview Addition, 3rd Filing iran its present classification of nIF-9 One Fami1;y Dwellingf1 to a proposed classification of "Neighborhood Retail ff . MR. O.D. STF.}/ARD JR. - FOR Mr. Steward ot 7832 Map1ewood came forward. to present his request to the Commission. He presented construction plans per this request. He stated he wanted Specific Use on Neighborhood Retail for professional office use for O.D.S Construction Canpany. He pointed out his house was 85 feet from connnercial property, and it had effected the sale of his property. Mr. Steward stated traffic would be kept off Maplewood as he would have parlå.ng at the rear of the house. This would include a three car driveway. He pointed out to the members by requesting spec.tic use to the request this would assure the plans submitted 1roUl.d be used as shown. Dr. Hager moved, seconded by Mrs. Shaunty, to approve this zoning request with the stipulation with Neighborhood Retail. Specific Use zoning would be for O.D.S. Construction Company offices only. Motion carried 5--0. All members voting af£irmative. Request of O.D.S Construction Canpany, Inc. to rezone Lot 7, Block 6~ Clearview Addition, 3rd Filing from its present classification of "IF-9 One F~ Dwelling" to a proposed classification of "2F-9 Two Fami1;y Dwellingn. MR. O.D. STE1iARD JR. - FOR 1.fr. Steward of 7832 Map1ewood came forward. to present his request to the Gamnission. He stated that F .H.A would not handle this property tor residential use. Th~ lot being vacant was nothing but grass to be maintained. He said the dup1.ex would have 2374 square feet, and it would be according to the plans submitted. It would be total electric, and would face on Joreen. He stated. there were some rent houses in the area, and he presented a petition of the property owners within 200 teet of his property in favor of this request. . . . XI. PZ 73-18 O.D.S. CONSTRUCTION COMPANY, INC. APPROVED XII. PS 73-5 FOSSn. CREEK TRAns PRELDíINARY PLAT APPROVED MR. WELDON BUTLER - FOR Mr. Butler came forward in favor of this request. He said it had only been a garbage dump in the past, and he lived next door. Mr. Butler said it 'WOUld be a great asset to the area to get it cleaned up. 14R. DANNY SCHAFFER - FOR Mr. Schaffer of 7905 Birchwood came forward in favor of this request.. Mr. Palachek moved, seconded by Mr. Welborn, to approve this reques~ 'with the stipulation, plans submitted to be the final plans. Motion carried 5..{). Request of O.D.S Construction Canpany, Inc. to rezone Lot 6, Block 23, Clearview Addition, 3rd Filing frcm its present classification of tfIF-9 One Family Dwellingn to a proposed classification ot "Specific Use". ~m. O.D. SmiARD. JR. - FOR Mr. Steward or 7832 1vlaplewood came forward to present his request to the Cœmnission. This request would be used by O.D.S Construction Company, Inc. for storage of material. There would be a (6) six foot stockade fence around the property, and the storage height would not be more than (5) feet. He stated this would enhance the neighborhood. Plans were presented on this request. Dr. Hager moved, seconded by Mr. Palachek, to approve this zoning request with the stipulation that plans presented to be the final plans. l~tion on plans su'bmi.tted on PZ 73-16, PZ 73-17, and PZ 73-18 be included. as execution of these request.,was made by Mr. Palachek, seconded by Dr. Hager. Motion carried 5..{). All members voting affirmative. This being the final plans. Request of Fossil Creek Preliminary Plat approval. 1m. O.D. LONG. 1m. GARY E. BARTA. AND MR. BAT.EMAN - FOR . . . Mr. lDng, Consuting Engineer, came forward to present this request to the Commission. He stated to the members this was a Preliminary Plat of the overall plat. They wished to start immediately on the residential tract and the street plans. The major overall can not start now that there are some final approval not canpJ.ete in Haltcxn City. They want to put the street network in the next phase. The remaining property will be worked in other phases. This being from the residential area. This would allow one to drive thru and see what is proposed from the streets. Streets were discussed with the members. They were trying to keep trœn getting any traffic probJ.ems. After discussion by the members, Dr. Hager moved, seconded by :Mr. WeJ.born to approve this pre1:iminary plat subject to the letter of comment fran the City Engineer. Motion carried. 5-0.
