PZ 73-12 PHILLIP BERNSTEIN DENIED . ~ MINUTES OF THE MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF NORTH RICHLAND HILLS, 4101 MORGAN CIRCLE, THURSDAY APRIL 26, 1973 - 7:30 P.M. The regular meeting of the Planning and Zoning Commission was called to order by Chairman f~r. Louis E. Rinn. PRESENT: Chairman: Vice Chairman: Secretary: Mr. Louis E. Motion carried by a vote of 5-0. Dr. Hager moved, seconded by Mr. Palachek, that the minutes be approved of the April 2, 1973 special meeting. Motion carried by a vote of 4-0; Mrs~ Shaunty abstaining due to absence from this meeting. Request of Mr. Phillip Bernstein to rezone 0.89 acres out of the ~1. Mr. Lunsford of 3920 Honey Lane came forward in opposition of this zoning request. He stated he wished the area to remain residential. MR. JIMMY RAY PARKER - AGAINST Mr. Parker of 3917 Honey Lane came fonvard in opposition of this zoning request. He stated he wished the area to remain residential. After discussion by the members of the Commission, Mr. Welborn moved, seconded by Dr. Hager, to DENY this request. Motion carried 5-0. II. PZ 73-19 RICHLAND PROPERTIES ,APPROVED Request of Richland Properties to rezone 76.092 acres of land more or less out of the John Condra Survey~ Abstract 311 from its present classification of "Agriculture" to a proposed classification of ' IIIF-9 One Family Dwelli,ngll. ~JR. R.' B ~ 'TRAr'1MELL ~ FOR r~ . Mr. R. B. Trammell, Consulting Engineer, came forward to present thi s request to the Commi 55; on. He 'stat,ed this property was East of Foster Villiage Development, and West of Douglas Lane. Plans were discussed to, the members of the Commission. MR. LUCIAN SMITH - QUESTION Mr. Smith came forward asking the size homes for the IIIF-9 request. It was pointed out it \A/ould have to meet the requirements of the IF-9 zoningG MR. LASLEY - AGAINST Mr. Lasley of 7113 Douglas Lane came forward in opposition to the dwelling being on 80x120 feet lots. He stated the homes backing up to Douglas Lane were 1,800 square feet. MR. EARNEST J. SIMMACHER - AGAINST Mr. Simmacher came forward stating that all the homes on the Eastern boundry of his property were 1,600 square feet. . ~ . After discussion by the members of the Commission, Mr. Palachek moved, seconded by Dr. Hager to APPROVE this zoning request. Motion carried 4-3, with Mr. Welborn abstaining. III. PZ 73-20 RICH-LAND PROPERTIES DENIED Request of Richland Properties to rezone 6.84 acres of land more or less out of the John Condra Survey, Abstract 311 from its present classification of IIAgriculture" to a proposed classification of ItLocal Reta i 1" . MR. R. V. TRAMMELL - FOR Mr., R. V. Trammell, consulting Engineer, came forward to present this request to the Commission. This property joins PZ 73-19 on the South and is West of Douglas Lane and is bounded on the South by High- tower Drive. This property was discussed with Case PZ 73-19. MR. B. L. MOORE - AGAINST .':...... .'" Mr. B. L. Moore of 7201 Hightower came forward in opposition of the "Local-Retail II request. After discussion by the members or the Commfssion, Dr. Hager moved, seconded by Mr. Welborn, to DENY, this zoning request. Motion carried 5-0. IV. PS 73-8 WINDCREST ADDITION PRELI~1INARY PLAT APPROVED This Preliminary Plat is the prope.rty described in Case PZ 73-19 and Case PZ 73-20. MR. R. V. TRAMMELL - FOR . Mr. Trammell came forward to present this request to the Commission. He pointed out the "Local-Retail" would be deleted from this, plat after being denied. The plat was discussed by the n1embers of the COfimiss;on. It was pointed out of the low spot at Little Ranch Road and Hightower Drive. The Commission advised the drainage would have to be finalized before the Final Plat was approved, and asked the City Engineer to look at the East side and South side of the property. This is for the residential only since the HLocal- Retailll was denied. ~ . Mrs. Shaunty moved, seconded by Dr. Hager to APPROVE this plat. Motion carried 5-0. v. PS 73-6 J. L. GODSEY PRELIMINARY AND FINAL REPLAT APPROVED Request of Mr. J. L. Godsey for a Preliminary and Final Replat showing Lots A, Band C, Lonsdale Addition being a revision of Lot 13 and part of Lot 12, Lonsdale a Subdivision to the City of North Richland Hills, Tarrant County, Texas. MR. J. L. GODSEY - FOR Mr. Godsey came forward to present this request to the members of the Commission. He stated the lots were too large, and he would like to change to (3) three lots~ He pointed out the lots were 224 feet deep. This would make one lot on Harwood, and two lots on Tiffin, being approximately 200 feet West of Davi s 81 vd. . . . Dr. Hager moved, seconded by Mrs. Shaunty to approve this Preliminary and Final replat subject to the letter of approval from the City Engineer. ~1otion carried 5-0. VI. PZ 73-21 R.l\ Y MYERS APPROVED Request of Mr. Ray Myers to rezone the South 133 feet of Lot 4, Block 2, Jack M. Estes Jr. Subdivision from its -Dresent classification of IILocal-Retaillt to a proposed classification of "Commercial If. MR. RAY MYERS - FOR Mr. Myers came forward to present his zoning request to the Commission. He stated in his application it would take the zoning change to tlCommercialtl to operate an automotive aligment service. He stated this property was in the 3700 Block of Rufe Snow Drive, and some of his adjoining property owners had thei r property zoned "CoITnnerc i a 1" . Mrs. Shaunty moved, seconded by Mr. Palachek to APPROVE this request. Motion carried 5-0. . VII. PZ 73-22 CA~1CO ENTERPRISES INC. APPROVED Request of Cameo Enterprises) Inc. to rezone 4.67 acres of land more or less out of the Stephen Richardson Survey, Abstract 1266 from its present ~ . classification of HAgriculturetJ to a proposed classification of "IF-12 One Family Dwelling". MR6 O. D. LONG - MR. GLENN BUCKNER - FOR Mr. Long and Mr. Buckner came forward to present this zoning request to the Commission. They stated this was the highest and best use of the property for residential homes. This property is off Davis Blvd. between Davis and KÏ'rk Lane. MR. FRED MORROW - AGAINST Mr. Morrow stated the average homes in his area were approximately 2,100 square feet and up. Mr. Buckner stated the homes would be above the IfIF-12 One Family Dwellingll required square footage. After discussion by the Commission, Dr. Hager moved, seconded by Mr. Welborn, to approve this request. Motion carried 5-0. VIII. PZ 73-23 CANCD ENTERPRISES INC. APPROVED Request of Camco Enterprises) Inc. to rezone 23.44 acres out of the Stephen Richardson Survey, Abstract 1266, Tarrant County, Texas from its present classi- fication of IIAgriculturell to a proposed classifi- c at i on of II IF - 9 On e F am i 1 y D'rJe 11 in 9 . II .\ . MR. O. D. LONG AND MR. GLENN BUCKNER - FOR Mr. Long and Mr. Buckner came forward to present this request to the Commission.. They stated the drainage would be corrected, and the lift system would be installed. Sewage for park will also be serviced. Mr. Buckner stated that 50% of the homes would be 1,500 square feet~and 50% would be 1,300 square feet. Mr. ~Jelborn moved, seconded by ~1r. Palachek to APPROVE this zonin'g request. Motion carried 5-0. IX. PZ 73-24 CAMCO ENTERPRISES INC. Long came forward to present this request for Mr. Buckner. He stated 50% would be 1, 500 square feet, and 50% would be 1,300 square feet or better. After discussion by the members of the Commission, Mr. Palachek moved, seconded ~ Mrs. Shaun~, to DENY this zoning request. Mr. Palachek, Mrs. Shaunty, and Mr. Welborn voting for denial. Mr. Rinn and Dr. Hager voting for approval. Motion carried 3-2. Request of Camco Enterprises, Inc. Preliminary and Final Plat, this is part of Glenann Addition Section 4. MR. O. D. LONG - FOR Mr. O. D. Long came forward to present this zoning case to the Commission. He stated that they would comply with the new Sub-Division Ordinance. After discussion, Dr. Hager moved, seconded by Mrs. Shaunty, to approve this zoning request. Motion carried 5-0. Request of Richland Enterprises, Inc. to rezone 4.23 acres out of the W. W. ~Jal1ace Survey from its present classification of "IF-9 One Family Dwelling" to a proposed classification of 112F-9 Two Family Dwelling". MR. CLAVIN LUPER - FOR Mr. Clavin Luper came forward to present this zoning case to the Commission. He stated that theywouJd put up a buf~r zone to the South of this property and also a stockade fence. After discussion, Dr. Hager moved, seconded by Mr. Weldon, to table this zoning case to give the developer a chance to cut down on the area on 2F-9 and come up with something satisfactory to everyone. Motion carried 5-0. ~ . XI I. PZ 73-26 Alan Hamm & J. B. Sandlin Request of Mr. Alan W. Hamm and Mr. J. B. Sandlin to rezone 7.537 acres of land out of the S. Richardson Survey from its present classification of "Agriculture" to a proposed classification of IlLocal-Retailu. MR. CLAVIN LUPER - FOR Mr. Clavin Luper came forward to present this zoning case to the Commission. After discussion, Mrs. Shaunty moved, seconded by Mr. Welborn, to approve this zoning case. Motion carried 5-0. XIII. PS 73-10 IMMANUEL EVANGELICAL LUTHERAN CHURCH APPROVED Holiday Hieghts Addition - Preliminary and Final Plat of Tract A, Block 7 Immanuel Evangelical Lutheran Church. ~. Mrs. Shaunty moved, seconded by Mr. Palachek, to approve Preliminary Plat and Final Plat of Tract A, Block 7, per Engineers letter of comment. Motion ca t"ri ed 5-0. XIV. PS 73-11 FOSSIL CREEK TRAILS APPROVED Request of Fossil Creek Trails out of the R. P. Barton Survey, Abstract 175, W. A. Trimble Survey, Abstract 1520, and the J. M. Vandusen Survey, Abstract 1588 Section I - Final Plat of the Residential Section of 148 Lots. MR. LONG - FAR Mr. Long came forward to present this zoning case to the Commission. After discussion of Plats and letter of comments, Dr. Hager moved, seconded by Mrs. Shaunty, to approve this Final Plat of Fossil Creek Trôils.
