BULLOUGH The regular meeting of the Planning and Zon- ing Commission was called to order by the Vice-Chairman, Dr. Charles Hager at 7:30 P.M. PP~SENT VICE-CHAIRMA~¡ SECRETARY DR. PAULINE SPAIN Dr. Hager asked for nominations for chairman. Charles palachek was nominated by l{rs. Shaunty, seconded by Mr. Mills. Motion carried 4-0. Mr. palachek then took the chair the chair and asked for nomination for Vice-Chairman and sec- retary. Dr. Hager was nominated for Assistant- Chairman by Mr. Welborne, seconded by Mrs. Shaunty. Mr. Welborne was nominated for Secretary by Dr. Hager seconded by Mr. Mills. Motion carried .4-0. Mrs. Shaunty moved, seconded by Mr. Mills to accept the minutes as presented. Dr. Hager and Mr. Palachek abstained as they were.absent at the June meeting. Motion carried 3-0. Request of Mr. Dale C. Bullough to rezone Lot 1, Block 1 of Morgan Meadows Addition from its present classification of "1F-12 ONE FA:f,!ILY DWELLING" to a proposed classification of "LOCAL RETAILu. FOR - Mr. Dale C. Bullough Mr. Dale C. Bullough stated the Pearch Co. has ten such shopping centers they build and manage themselves. He showed drawings of proposed build- ings . FOR - 1m. B. A. MA Y Mr. May owns property across the street and has a Realty Co. He feels the property should be re- zoned to "LOCAL RETAIL". . . . II. PS 73-15 STONYBROOKE ADDITION PRELIMINARY AND FINAL PL.4. T III. PS 73-17 MEADOWVIEW ESTATE PRELIMINARY PLAT -- AClt\INST - MR. B. L. MOORE Mr. Moore feels before anything is built some- thing should be done about the drainage. AGAINST - ?iffi. NEIL INGBERG Mr. Ingburg owns Lots 2 & 3 backing up to pro- perty in question. He feels rezoning would de- valuate his property. He feels people bought in Morgan Meadows to get away from commercial atmosphere. ~x. Mills asked about the drainage problem. Mr. Ingburg said drainage is poor, but feels once the area is developed this problem will be taken care of. AGAINST - r·m. EMMETT ~!OODY Mr. Moody agrees with Mr. Ingburg. AGAINST - MR. B. J. Fanning Mr. Fanning stated he did not feel said pro- perty should be rezoned without all of Hightower Drive being rezoned. Mr. Fanning stated the water problem is bad. After discussion by the Co~~ission Members, Dr. Hager moved, seconded by Mary Jo Shaunty for denial of said request. Dr. Hager stated this is spot zoning and there are too many opposed to request. Motion carried 5-0. Mr. Walter Elliott represented Stoneybrooke Inc. It was brought out area on plat was zoned originally as 1F-9 & 1F-12 but on fina¡ shows nothing. He was told he would have to come before the Commission if this area was to be used for any other purpose. The same was true for area blocked as school pro- perty. Mr. Palachek suggested the zoning plat show percentage of 1F-7, 1F-9, 1F-12 as well as final plat. Mr. Bronstad asked about the Engineers letter. Mr. Elliott said all had been taken care of. Engineer's letter dated July.J.:L,~ 1973 is attached to these minutes as permanent record. After discussion by the Commission Members, Dr. Hager moved, seconded by Mr. Welborne to approve said request subject to Engineers comment. Motion carried 5-0/ Mr. Glen Buckner represented Meadowview Estate. After discussion by the Commission Members, Dr. Hager moved, seconded by Mrs. Shaunty to approve this request. 'AND' FINAL' PLAT Dear Sirs: We have received the revised preliminary and final plat for the subject subdivision and offer our comments as follows: 1. The Developer has complied with our suggestions and comments as indicated in our letter of June 21, 1973; and, in our opinion~ the requirements of the Subdivision Ordinance have been met. We, therefore~ recommend approval of the subject plat. 2. The suggestions concerning pro-rata costs of street and water line construction (Items 5 and 7) of our previous letter should be taken into consideration, and we also re~r you to Item NO.9, concerning construction of one-half the street on the Eastern portion of Hightower for your consideration. 'STONEYBROOKE"ADDITION Dear Allen: . Pursuant to our conversation this date concerning the discrepancy between the zoning plat and the final plat submitted for the subject subdivision, we have talked with the Developer's Engineer and the property in question is planned for Commercial usage as opposed to the IF-9 zoning granted. . To be more specific, the property is a rectangular portion of Block 14 (Final Plat) that borders on the North line of Brookhaven Drive and extends North 260 feet to a point approximately 300 feet South of Hightower Drive (see attached excerpt from the final plat). According to the Developer's Engineer, the Developer plans to rezone this section of the present IF-9 zoning to Commercial zoning, but not prior to approval of the Final Plat. We feel that the City Attorney should be consulted regarding the legality of such approval of a final plat where zoning has not been finally determined. PROPOSED NEW ORDINANCE AN ORDINANCE AMENDING ORDINANCE # 119 v. OLD BUSINESS ~ Dr. Hager asked if mixed drinks were restricted to sales with food. Prefers restricting beer sales to be food and beer outlet. Before discuss- ion Mr. Bronstad called and asked Tim Truman to join the meeting. Safety and morals were discussed. Tim stated this is no moral ordinance. Basic or- dinance should be General & Liberal. Tnis ordinance is not zoning any said part of City. Each applicant should come before the Commission each time a Specific Use Permit is requested. Mr. Mills asked once it is granted one business, how can you not approve all? Tim stated best control would be option oÎ Council and Commission, based on safety laws and welfare of City. Weigh pros and cons and all considerations should be raised. Have everything in writing and state basis for same. It w~s asked if the City would collect any revenue from the tax? Tim stated after three years the City can collect one half total tax. After discussion by the Commission Members, Dr. Hager moved, seconded by Mr. Welborne to adopt amended ordinance #119, as changed, (See Attached) Motion carried 5-0. NONE ~œ.
