The regular meeting of the Planning and Zoning Commission was called to order by the Chairman, Mr. Charles Palachek, Jr. at 7:35 P.M. CLER.TC Mr. Allen Bronstad Mrs. Pauline Spain Mrs. Shaunty moved, seconded by Mr. Mills to accept the minutes of the Au~~st 23, 1973 meeting. Motion carried 4-0, Mr. Welborn abstain- ing as he was absent from said meeting. Dr. Hager moved, seconded by Mr. Welborn to add PS 73-21 to agenda. Motion carried 5-0. Req'uest of D. D. Investment Company - Fox RolIoTÑ Addition - Final Plat. Mr. David Moak presented this request for D. D. Investment Company. Mr. Falachek asked about the Rail- road crossings. Mr. Moak stated $25,000 has been turned over to the City for cost of flashing signals to be installed at crossing on Fox Hollow Lane. After discussion by the commission members, Dr. Hager moved, seconded by Mrs. Shaunty to approve this request. Motion carried 5-0. Request of F. E. Harrington to rezone Abstract 1266, Tract 12B being 1.403 acres out of the S. Richardson Survey from its present classification of "LOCAL RETAIL" to a proposed classification of "LOCAL RETl~IL S. U. - SALE OF BEER FOR OFF PRE~!ISE CONSID;fPTION". This property is located at 7700 Davis Boulevard. After discussion by the commission members Dr. Hager moved, seconded by Mr. Welborn to approve this request with the stipulation the rezoning is limited to ex- isting building only. Motion carried 5-0. Hequest of B. Huber to rezone Lot 2, Block F, Hich- land Oaks Addition Îrom its present classification of "LûCAL RETAIL" to a proposed classification of . . ..... ~ HLOC~4.L RETAIL S.U. - SALE OF BEER FOR OFF PREMISE CONSUMPTION". This property is located at 8218 Grapevine Highway. After discussion by the commission members Mrs. Shaunty moved, seconded by Dr. Hager to approve this request. Newton Survey, Abstract 1182 from its present classification of "AGRICULTLTREtt to a proposed classification of -LOCAL RETAIL S.U. - SllLE OF BEER FOR OFF PREï,fISE CONSU1\lPTIO~Pt. This property is on Precinct Line Road approximately 3 miles North of Highway 121. Mrs. Harrington presented this request. She stated they had a small àrive in store at this location for years. After discussion by the commission members Dr. Hager moved, seconded by Mr. Welborn to table this re- quest for futher study and discussion. PZ 73-45 .4.PFROVED Request of 1 Eleven stores Incorporated to rezone Lot At Block 7 of Clearview Addition from its present classification of "COMliIERCIAL" to a pro- posed classification of "COMMERCIAL S.U. - SALE OF BEER FOR OFF PREMISE CONSUMPTIO~I". This property is located at 5°50 Davis Boulevard. Mr. Joe Brown, District Manager for 7 Eleven pre- sented this request. After discussion by the commission members Mr. Welborn moved, seconded by Dr. Hager to approve this request with the stipulation we recieve a let- ter of approval from the owner of the property before October '5. 1973. Motion carried 5-0. PZ 73-46 APPROVED Request of John R. Wright to rezone Lot 1 of Red- dings Revision from its present classification of "COMMERCIAL" to a proposed classification of "C01tIMERCIAL S.U. - SALE OF BEER FOR OFF PREriIISE CO~¡SUMPTIONtf. This property is located, at 7909 Main street, Smithfield, Texas. Mr. Wright presented this request. Mrs. Wright stated she didn't particularly want this in Smithfield but felt her husband would have to sell beer for competitive reasons. AGAINST Mr. Kirby Cox presented opposition from the Smith- field Baptist Church reading a letter from the deacons of the church. Mr. Ron Smotherman, pastor of the Smithfield Church of Christ. . . . ~ Mr. Wayne Goodman stated he was neither for or against this req.uest. He only wanted to ask a question. What type store can sell beer? Can they later sell liquor? Do we have laws stating so many feet from school, church and hospitals? Wr~t it entails when you rezone for sale of beer? Dr. Hager stated any change in sale of beer or mixed drinks would have to be voted 11pon by the people. flr. Palachek read Mr. Goodman Ordinance No. 488. After discussion by the commission members Dr. Hager moved, seconded by Mr. Mills to approve this request. The motion carried 4-1, Mrs. Shaun.ty voting against. PZ 73-47 ..tlPPROVED Request of Day Homes Incorporated to rezone 15 acres of the J. C. McComas Survey, Abstract 1040 from its present cla.ssification of "AGRICULTURE" to a proposed classification of " 1F 9 ONE FAMILY DWELL- ING". This property is located on Chapman Road be- tween Meadow Drive and Hewitt Road. Mr. Jimmy L. Day presented this request. Mr. O. D. Long spoke for Mr. Day. AGAINST Mr. J. D. Richmond stated he and his neighbors feel something should be done about the drainage problem before anymore development is done. After discussion by the commission members Mr. Welborn moved, seconded by Mr. Mills to approve this request. Motion carried 5-0. P.Z 73-48 TABLED Request of Figgly Wiggly to rezone Lot 1, Block 2 of Richfield Place Commercial Addition from its present classification of "LOCAL RETAIL" to a proposed classifica t ion of "LOCAL RETAIL S. u. _ SALE OF BEER FOR OFF PREMISE CONSUÞWTION! This property is located at 7823 Grapevine Highway. Dr. Hager moved, seconded by Mr. Welborn to table this request until October 25, 1973, since no one was present to speak for Piggly Wiggly and they had no authorized letter from the property owners, Leonards Properties.
