MINUTES OF THE REGULAR MEETING OF
THE ZONING BOARD OF ADJUSTMENT OF
THE CITY OF NORTH RICHLAND HILLS,
TEXAS, THURSDAY, JUNE 17, 1976
CALL TO ORDER
The meeting was called to order by the
Chairman, J.B. Helton at 7:40 P.M.

Mr, Roseberry. Motion carried 3-0.

CONSIDERATION OF MINUTES
OF THE MAY 20 meeting
Mr. Jones moved, seconded by Mr. Trotter
to approve the minutes as written. Motion
carried 3-0 with Mr. Roseberry abstaining
as he was absent May 20.

NEW BUSINESS
BA 76-8
Request of Edith M. Smith to retain a storage
building inside the three foot side yard line.
This property is located at 5312 Richland Ct.
Mr. Larry Smith spoke, stating the storage
building is built within fence rather than
three feet inside fence. Mr. Smith brought
photographs showing the building from both his
property and his neighbors property. The
building is constructed of red cedar. Mr. Smith
intends to install a red cedar fence to match
the building. The building is built on rail-
road ties recessed in the ground.
Mr. Kenneth Dell - 5309 Richland Ct.
Mr. Dell had no objections to the building being
on the property line but does want the fence
constructed of the same material.

Mr. Roseberry stated if either party gets ready
to sell property there could be trouble as the
building is an -encroachment to neighbors property
and violation of city ordinance.

Mr. Trotter asked about the problem of moving
the building. Mr. Smith stated it would be
quite a bit of work.
Mr. Dell asked if F.H.A. would stop sale of
property because of this. Mr. Roseberry said
F.H.A. would say get the encroachment off or
make both parties sign a waiver.
Mr. Jones questioned the legality of the
variance, if granted, and some one wanted the
building removed.
Mr. Jones questioned the overhang being on
neighbors property. Mr. Smith said the over-
hang was about 611. Mr. Smith asked if the
water on the adjacent property was a problem;
if so he said he could add gutters or cut 311
off the overhang. The four inch posts would
take up the difference. If I have to move the
building it will be elevated another eleven
inches.
Mr. Britton pointed out ordinance no. 461
Section 2.28 also in violation.

After much discussion Jack Roseberry moved,
seconded by J. Jones to deny this request due
to violation of zoning ordinance no. 179,
Article XXIII, Section 111.2 and ordinance no.
461, Section 2.28. Motion carried 4-0, all
v'ot i ng for.
Mr. Helton explained to Mr. Smith due to
possible future problems the Board felt it
best for him and the City to deny this request
and he hoped Mr. Smith understood.

Request of Robert J. Fennimore to vary from the
Zoning Ordinance no. 179 on lot 6, block 10,
Fossil Creek Trails Addition from 110· minimum
depth of lot and 30· building line facing
Circleview Dr. This property is located at
6051 Circleview Drive.

Mr. Fenimore presented this request stating
his house will face Circleview Dr. and the houses
on Circleview Dr. have a 25· front yard. He
would be conforming to the other houses. He
did not know about the ordinance concerning the
back yard until he came in for a permit. His
house will have approximately 2700 square feet
and there is no way it will fit on lot leaving
20% depth of lot for back yard. He will be ten
feet from the house behind him where he would be
only six feet from him if his house faced Riviera.

Mr. Lloyd Moore, 6101 Circleview Dr. and
Mr. C.R. Crites, 6050 Circleview Drive
stated they had no objections.
After discussion by the Commission Mr.
Trotter moved, seconded by Mr. Jones to
grant this request. Motion carried 4-0,
all voting for.
