MINUTES OF THE REGULAR MEETING OF
THE ZONING BOARD OF ADJUSTMENT OF
THE CITY OF NORTH RICHLAND HILLS,
TEXAS, THURSDAY, AUGUST 19, 1976
CALL TO ORDER
The meeting was called to order by the
Chairman, J.B. Helton at 7:35 P.M.

CONSIDERATION OF MINUTES
OF THE JUNE 17, MEETING
Mr. Trotter moved, seconded by Mr. Roseberry
to approve the June 17 minutes as written.
Motion carried 4-0

NEW BUSINESS
BA 76-10
TABLED
Request of Dean Alexander for a variance to
extend a fence past the front of his house
and for a storage building in his side yard.
This property is located at 6513 Jerry Ct.
Mr. Alexander asked for the variance as the
fence and storage building are already there
and he doesn1t want to take them down. Mr.
Roseberry asked if he was aware of the deed
restrictions. Mr. Alexander stated not until
he recéi.ved the letter from the attorney, Mr.
Wood. Mr. Alexander tried for a week before
reaching Mr. Wood. Mr. Wood did not realize
the fence and building were already built.
Mr. Roseberry explained the deed restriction is
to protect all property owners. Mr. Alexander
had a note on his door when he returned home
Thursday afternoon stating the developer had
no objections to the request for a variance;
however the developer wants to discuss with
Mr. Alexander the type of fence to be used.
Mr. Alexander stated he did not know what
Cameo Developers wanted. If their requirements
are too expensive he will have to remove the
fence and building. Mr. Trotter asked how this
was found. Mr. Britton told the Board the
city had a complaint about a horse at this
residence and when the inspector went out there
he found the zoning violation. Mr. Britton
told Mr. Alexander he had to either go before
the Board of Adjustment or comply to the zoning
ordinance.

After much discussion by the Commission, Mr.
Trotter moved, seconded by Mr. Roseberry to
table this request for one month to give Mr.
Alexander an opportunity to talk with the
developer regarding the deed restriction.
Motion carried 4-0.

APPROVED
Request for David Smith to vary from 20% depth
of lot for a back yard. This property is
located at 3861 Diamond Lock West.

Mr. Smith stated he built this same house at
Camelot Court last year. When he came in for
a building permit last month he was told he
did not comply with the zoning ordinance.
This is a five sided lot on a cul-da-sac. It
is contiguous to the golf course. Mr. Smith
had a petition signed by four property owners
stating they have noobjections to this request.
Mr. Trotter moved, seconded by Dr. Hahn to
grant this variance due to the peculiar shape
of the lot. Motion carried 4-0.
OLD BUSINESS
Dr. Hahn requested again that the City Council
pass an ordinance stating that fence companies
are responsible for a permit and take all
responsibility as for type and location of
fence.
ADJOURNMENT
The meeting adjourned at 8:30 P.M.
