SANDLlli DENIED . Request of Mr. Alan W. Hamrn and þt1r. J.B. Sandlin to rezone 7.55 acres out of the W.W. Wallace Survey from its present classification of nIF-9 One Family Dwelling" to a proposed classification of ff2F--9 Two Family Dw'elling". CALVIN F. WPER - FOR 1-fr . Calvin F. Iuper came forward to represent }fr. Hamm and }1r. Sandlin. Jvfr. luper pointed out the location of the propery on the plat presented to the Commission. He also explained the overall plat to the members. ~'1r. Iuper stated the property was adjacent to }W.tiple Family zoning and the duplex zoning would be a buffer to the residential area. He also stated two family dwellings would be a credit to the City. No one came forward from the audience in favor of the request. MR. Jll-l PllJNY - AGAINST !1r. Jim Penny came forward in opposi tion of the zoning re- quest. He stated he was speaking for himself, and the home owners in the audience. They wanted the area to remain as . . . II. After much discussion motion of DENIAL was made by Þfr. Stembridge, seconded by 111'. ~velborn. }1otion carried unanimously. 4...(). 1-fr. Rinn then stated the board feelings were Lots 21 thru 26 were suitable for 2F-9 zoning, but not the entire tract. Request of Continental Housing Consultants to rezone 15 acres out of the vlilliam Cox Survey from its present classification of "Agriculture" to a proposed classi- fication of "Multiple Family Dwelling". F .D. RLTTLEDGE - FOR 1"Tr. F .D. Rutledge came forward to present the case for Continental Housing Consultants. He stated this case was tabled at the ~1arch 23, 1972 meeting as Planned Development upon his request, and now he was asking for the application to be amended to lvlultiple-Family Dwelling. Mr. Rutledge pointed out the property, and the surrounding property on the plat to the members. He pointed out on the plat that this property was North of the property they had zoned previously. He stated they were ready to bring water and sewer to the area. No one in the aud:ience came forward in favor or in opposition of this request. After discussion by the Conmission, motion of APPROVAL was made by 1~1rs. Shaunty, seconded by ¥..r. Stembridge. l~tion carried unanimously. 4...() Vice Chairman, lŒr. PZ 72-18 STOliYBROOK, INC. APPROVED . presented along with PZ 72-14. It was requested by the City Council that lvfr. Rutledge amend his application from Commercial to Local-Retail. He stated that from tIle residential type zoning in the area, there was a great need for local-retail for shopping areas. Þlotion of APPROVAL was made by 1;lrs. TOÌ¡I LA~v .. FOR ~Œr. Tom law came forward to present the case for Catherine Calloway. He stated she was the owner, and Chrysler Corp. wished to purchase this property for an automobile retail sales establishment. 1··fr. law showed the members of the Commission and the audience a sketch drawing of the pro- posed building. He stated the building would be about one half' million dollars in cost, and would have about 24, 520 square feet of area. He stated that they planned to utilize all the property , with the parking area being asphalt and gravel at this time. The entire tract would be enclosed with a six foot chain link fence. }1r. Law stated they felt this was the highest and best use of tlle property. No one came forward in favor, or in opposition of this zoning request. 1,lotion of APPROVAL was made by 1·:Tr. Welborn, seconded by 1"Jrs. Shaunty. I'lotion carried unanimously. 4...() Request of Sto~brooke, Inc. to rezone 4.7 and 2.3 acres out of the O. Rumfield Survey, and J.B. Eden Survey from its present classification of ffAgriculture" to a proposed classification of "IF-12 One Family Dwelling". 1·1R. HERJvIAN J. 511ITH AND MR. \lALTER ELLIOTT - FOR Mr. Herman J. Smith, owner of the property, and 14r. vlalter Elliott, Engineer, came fon-rard to present the case to the Commission. 11%'. Smith asked the Commission if he could present PZ 18, PZ 19, and PZ 20, at the same time as they were for residential zoning. !vir. Rinn stated he could, and they would vote on each case as a sepe-rate issue. 1\1r. Elliott posted the plat of the cases involved on the board for the Commission to review as 1vIr. Smith stated his zoning request. ~1r. Smith stated they proposed to start with larger . homes on the North line of their property, and then the IF-9 dwellings, and that leaving the IF-7 at the south property line. He stated the IF-12 dwellings would have approximately 1,800 square feet of living area, the IF-9 would have approximately 1,400 to 1,600 square feet of living area, and the IF-7 would have over the minimum requirement of square footage living area. Mr. Smith stated tilat water was now available on F .M. 1938, and they would properly engineer the entire tract. He stated this would front };Irs. H. 8mi th of 3202 Smithfield Road came forward to ask }fr. 3mi th what he proposed to do about the drainage on the South portion of his property, as his property joins on the South portion of 1~1r. Herman Smith. lvIr. Herman 8mi th stated they planned to_. in~tall . a large collector system to correct this matter. . 1-1RS. CLAUDE W. SHACKELFORD - AGAINST l'jrs. Shackelford of 4713 Redondo came forward in opposition of the zoning request. She stated that smaller type homes would not be of any advantage to the City of North Richland I-lills . 11m. RICHARD KURTZ - AGAmST lIre Richard Kurtz of 8501 RUTrd'ield Road came forward. He stated he had no objection to the house size, but wanted larger lots. He stated they had fram one to one and one half acres, and 'tdshed to continue with larger lots in the area. till. CHARLES PALACHEK JR. - AGAINST 1~Tr. Charles Palachek came forward in opposition of the zoning request. He stated his home was at 8908 llirk Lane, and he was opposed to smaller homes, and also to smaller lots. He stated that the area should remain in at least one acre tracts. I·!r. After discussion by the members of the Commission, motion of APPROVAL with the minimum of 1,800 square foot living area was made by l'1rs. Shaunty, seconded by Ivfr. Welborn. Smith asked Mr. Rirm if he could present the three cases at the same time since they were for Connnercial zoning. This being PZ 72-21, PZ 72-22, and PZ 72-23. }fr. Smith stated the purpose of the request was for a general shopping center for the area. He stated they were trying to bring Rumfield Road extension to conform with existing streets. He pointed out that Industrial zoning was to the West of this property at the present time. The small area would be for garden type office area. ~fr. Smith stated with the growth of the area, and being so close to F.M. 1938 that was the highest and best use of the property. He stated they were to bring the scever from the South to Rumfield Road, and to the tracts requesting Commercial zoning. This would also make the property owned by 1·1r. Legge' accessible for sewer. Þ1R. BOB LEGGE' - FOR lyfr. Bob Legge t came forward in support of the zoning request. He stated he was developing the tract of land to the vlest of I·Jr. Smith. I~Ir. Legge' stated that tying in Starnes Road to the adjoining development would be a great asset to the area. No one came forward from the audience for the request, or against the request. After discussion by the members of the Commission, motion of approval was made by Mr. Stembridge, seconded by Þ'œ. Welborn. Motion carried unanimously. 4-'J Request of Stonybrook, Inc. to rezone 12 acres out of the W.D. Barnes Survey from its present classification of "Agriculture" to a proposed classification of "Commercial". 11R. HERMAN J. SI1ITH AND 1.ffi. \iALTER ELLIOTT - FOR 1,,11'. Herman Smith, owner, and Mr. Walter Elliott, Ellgineer, came forward to present the case to the Commission. This request having been reviewed with PZ 72-21, motion of ArPROVAL was made by 11rs. Shaunty, seconded by Mr. Stembridge. 1vfotion carried unanimously. 4..() Request of Stonybrook, Inc. to rezone 2.1 acres out of the William Cox Survey from its present classification of "Agriculture" to a proposed classification of "Commercial" 1vffi. PZ 72-24 SABINE VAILEY LUJvfBER CO~1P ANY APPROVED Request of Sabine Valley Lumber Company to rezone 1.394 and 1.028 acres out of the R.P. Barton Survey from its present classification of "2F-9 Two Family Dwelling" to a proposed classification of "Neighborhood Retail". IvfR. DAVE RITZ - FOR Mr. Ritz came forward to present the request to the members of the Commission. He stated they were plarming to begin Phase 2 of Diamond Loch Addition. This property fronts on Glenview Drive, and Neighborhood Ret~il now exist across the street, and Local-Retail to the East of the property in question. Mr. Ritz stated this would be the highest and best use of the property. No one came forward from the audience either in favor, or in opposition of the request. l~lotion of APPROVAL was made by Þ1rs. PS 72-7 P&S CONSTRUCTION COMPANY RE-PLAT Request of P&S Construction to re-plat Lots 26R-l, and APPROVED 27R-l, Block 2, Diamond Oaks South Addition, being a revision of Lots 26R, and 27R, BloCk 2, Diamond Oaks South Addition. No change in utility easements are necessary. l\m. CALVIN LUPER - FOR 1fi~. Luper came forward to present the case to the members of the Commission. The request is to combine the two lots into one in order to erect one house at this location. No one came forward from the audi~ence either in favor, or in opposition of the request. 11otion of APPROVAL was made by }1rs. Shaunty, seconded by 11r. PS 72-8 REVISION OF HOLIDAY NORTH PRELDfINARY OVERALL PLAT APPROVED Request of Richland Enterprises, Inc. to present the revision of Holiday North Preliminary Overall Plat. . 1m. CALVTIJ LUPER - FOR 11r. Calvin Luper came forward to represent Richland Enterprises, Ine. The overall plat was reviewed and discussed by the members of the Cammi3sio~. 1~. Luper reviewed the changes with the members. Th~s plat was . approved by the City Engineers. After discussion by the members, motion of APPROVAL was made by l1rs. Shaunty, seconded by Ivfr. Stembridge. lvTotion carried unanimously. 4-0 XIV . PS 72-9 FOSTER VILIAGE PRELTI~IINARY PLAT TABLED Request of Foster Financial Corporation to present the Preliminary Plat of Foster Village. lv1R. JACK HO\ŒLL - FOR . Mr. Jack Howell came forward to represent Foster Financial Corporation. A copy of the plat was posted, and it was reviewed by the members of the Commission. ~JJr. Howell stated they planned to start with approximately 90 plus lots on their first unit development. The letter from the City Engineer was reviewed at great length. ~1r. Howell explained the reason for the additional street length shown on the plat. He also stated they proposed that Rufe Snow and Hightower Drive be 80 feet R.O.\i., and would comply with the Final Plat. This would also conform to the water and sewer system requirement. After much discussion motion to TABLE was made by }1r. tvelborn. until such time the Engineers could work out all details, and be in conformance with the City re- quirements, seconded by fIr. Stembridge. lvIotion carried unanimously. 4...() "XV. PS 72-10 COVENTRY PLACE ESTATES PRELn'~iINARY PLAT TABLED Request of Nr. Bob Legge' to submit a Prel.imina.ry Plat of Coventry Place Estates.-, Ivlli. vlALT:ER ELLIOTT - FOR 1"fr. Elliott, Engineer, came forward to represent ¥œ. Legge f in his request. lJlr. Legge' is the owner and developer of the property. 1{r. Elliott, and the members of the Commission revi~ed the letter from the City Engineer. After much discussion on this matter, motion to TABLE was made by Mr. \~lelborn, seconded by Mr. Stembridge. l·fotion carried unanimously. The vote was 3-0 with l·frs.
