SPECIAL ~mFTING The Special meeting of the Planning and Zoning Commission was called to order by Vice-Chairman Mr. Louis E. Rinn. PRESENT: Vice-Chairman: Mr. Louis E. Rinn T~r. Gene Welborn Mr. D. R. Stembridge CITY STAFF PRESENT: Acting City Manager: City Clerk: M. E. Riddle Betty Terrell ABSENT: Chairman: Dr. Charles Hager Mrs. J. W. Shaunty Reguest of Foster Village to present the revised plat to the Planning and Zoning Commission. JACK HOWELL - FOR Mr. Jack Howell came forward to represent Foster Financial Corporation. Mr. Howell stated they had two meetings with the City Engineer and had revised their plat according to his specifications. He stated that the grid system and the length of the blocks were the main objections of the first plat presented. Mr. Howell stated that with the revision of the plat, the lots would average out the same and meet the subdivision requirements. He said the drain- age design worked well in their plans. streets were also discussed on the plat presented to the Commission. Mr. TIowell stated that the first units constru.cted would be approximately in the middle of their property, east of Rufe Snow Drive and they would then develop to the north and south in the next phase. He pointed out that starnes would be a 60 foot street, and that they were ready to start development as soon as the final plat had been approved. Mr. Riddle stated that Fire Chief, Dean Holland, had checked the plans and they did conform as long as the fire coverage stayed the same. . No one came forward from the audience in favor or in opposition of this request. ~'1r. Welborn moved, seconded by 1~r. 3tembridge to approve the revised plat. Motion carried by a vote of 3-0. Request of Robert A. LegGe' to present Coventry Place Estates revised plat to the Planning and Zoning Commission. Mr. Elliott, Engineer, came forward to represent Mr. Legge' in his request. The letter from the City F~gineer was reviewed by the members of the Commission. Mr. Elliott stated that they would conform to what the City Council, and the members of the Zoning Commission wanted. He said tl1ey would put money in escrow wi th the City for their share of the street and drainage cost. Mr. Elliott pointed out on the revised plat that they had lost about 17 lots in this revision, but it was a much better plan. lIe stated that no lots would face on a major thoroughfare. Mr. Riddle stated that starnes Road would probably go all the way through. Mr. Elliott pointed out the way the lots were planned, this would make almost a private settlement. No one in the audience came forward in favor or aganist this request. Mr. Welborn moved, seconed by Mr. Stembridge to approve the revised preliminary plat. The motion carried by a vote of 3-0. NONE Mr. Welborn moved, seconded by Mr. Stembridge, that the meeting be adjourned. John Barfield to rezone 20.2317 acres out of the John Barlough Survey from its present classification of "Agriculture" to a proposed classification of "IF-7 One Family Dwelling". I,m. JOE SPURLOCli - FOB. J-,ír. Joe Spurlock came forward to represent r'1r. Barfield. He stated he was all at+.orney with tIle firm of Craig, ~'Ihitley, Boring, lŒorrisón, and Spurlock, and was also State Senator. He stated he received fees for his services as an attorney, and would like to make this statement to dispel any thinking that his position as a state Senator had anJrt11ing to do \1Ì th his being present tonight. ]\·fr. Spurlock asked if he could present both cases to the Commission at the same time. Chairman, Dr. Hager, stated he could. ~.~. Spurlock stated the property for which residential zoning is requested would be a buffer zone for the Industrial zoning. He advised the Commission that the residential was bounded on Davis Blvd. by local retail, and the Industrial was bounded on the West by . l~ultiple Family zoning, and on the South by the 110bile Home Trailer Park, and on the East by the Industrial tract including the airport. No one came forward from the audience in favor of the request. r~:Rs. TŒ'1 FETWßLî - AGAINST 1"TS. Fetner stated 511e oM1ed propertJr joining this zoning request, and was in question of the plat. She stated Freida Lane dead end to her property, and would like larger homes at the rear of her property. l-'iR. (JOE B&T{I'JETT - AGAINST l':r. Barnett came forti'ard and stated he owned property at 6000 Davis Blvd., and was against the rezoning of this property in both cases. He stated to the Commission this property had been before tl1e Planning and Zoning Commission on September 25, 1969, February 26, 1970, and July 23, 1970. He also pointed out it had gone to the City Council on August 24, 1970. He stated they did not need any more low cost homes in the area. Jolm Barfield to rezone 42.1532 acres out of t11e John I3arlough Survey from its present classification of "Agriculture" to a proposed classification of "Industrial". This zoning request 't'faS presented along with PZ 72-25. Mr. Rinn moved, seconded by Dr. Hager to approve the zonir~ request. ITotion carried 2-0 '¡Arith Ilrs. S11aunty voting negative. l-ffi. A.lv. CRISP JR. - FOR I-lequest of lIre A.~·¡. Cl'isp Jr. to rezone 6.5281 acres out of the S. Richardson Survey from its present classification of "Agriculture" to a proposed classification of "Co!rùTIercial". J.~r. Crisp carne forward to present his case to the Co:mmission. He stated he 'tlanted this type of zoning for storage rental and sales of heavy raachineIJ' equipment. He pointed out the location of his property to the m~nbers of the COmmission, stating tllere '-las· very little frontage on Davis Blvd. ì'Jr. Crisp said there was open land on tIle back of his propert~l, arld Ifr. lIarrington f s property took most of the frontage on Davis. 11e stated he was approximately 300 to 400 feet South of Rur!.field I-m. Crisp, and proposed a large home type subdivision on the propert~T l1e had purcllased. lle said l1e had objections to the use IT. Crisp had in mind as it would darnage his residential area 't'l11en developed. lIre lfarmn stated ÌIe would not object to Local-Retail zoning as it "TaS needed Ul the area. lie pointed out to tl1e Cormnission 11e would come in at a later date for the zoning on his tract. lIr. 11iddle stated he was in Agriculture zoning at the preseIlt time, but could build on two acre tracts as presently zoned. !,rotion of DillJIAL was made b:y lIrs. The nlotion was seconded by }Irs. Shaunty. All members voting affirmative. Dr. }~ger stated this request would go to the City Council as Local-Retail, rather than as Commercial as s110wn on the applicatio!l. Request of lIr. E.F. v'lIGu'''Y - FOR lIre ~'ligley came forward to present his case to the Commission. 1-1e stated most of the surrounding area was zoned for business. tie pointed out to the Commission there was a house on tl1e property at the present time, and could be used to conduct a business. 1m.. I-Ie stated he owned property at 4166 ~'lillman, being South of l~Ir. t·¡igley. lIe said tllere 1-rere only about seven homes in the area that were residential, and most of the area being zoned for business, he 11as in favor of the zoning request. IIr. Riddle pointed out t11at the trend along the highway was of a retai]. type, and also in the area being in Richland Irills. No one came fO~lard from the audience in opposition. lIrs. ShauntJ' moved, seconded by 1·Ir. R.inn to APPROVE tl1is zoning request. All rnerilbers voting affirmative. Village Properties and Associates, Northridge Addition Final Plat. 1m. GORD01J SllIFT - FOR r·1r. Gordon Swift came forward to represent Village Properties in this request. He pointed out this property had been zoned Planned Development and approved October 23, 1969. He stated . . . plans had been made for the first phase, and had been approved by the City Engineers, and the City staff. He said the purpose of the plat ~ms to dedicate streets, right-of-way, and ease- 1Ylent s . Dr. Hager pointed out that the ovmers TIlust have their taxes paid i~ediately, or the Council would not consider the plat approval. fT. Swift stated the owners had been notified, &ld would pay t11e taxes immediately. He said tlley had plaru1ed on approximately 200 units on tl¡e first phase. r~. Rinn moved, seconded by l\1rs. Shaunty to approve this plat subject to the payment of taxes. l-Iotion carried unanimously. All members voting affirmative. VI. PZ 72-29 CARL STARR APPROVED Request of l:Tr. Carl Starr to rezone Tracts 13A, 12B, and 12C, Block 2, If1. Lynch Survey from its present classification of "Local-Retail" and nIF-7 One Farnilj'" Dw-elling" to a proposed classification of n Cormnercial H . ~,ûì. CARL STARR - FOR J·1r. Starr came forward to present his case to tIle Commission. lIe stated he 't1anted to lease the property to a construction firm similar to the type of business of the previous otiner, l·:lr. Lee Crowley. I-Jr. Starr stated the property was approximately 600 feet in depth, and would serve the purpose of a construction firm. The property joining this property ~lest of the creek is owned by Anderson Furniture Company. ~T. Starr. lIrs. Shal1nty moved, seconded by J'.l:r. Rinn to approve the zoning request as amended. 1vlotion carried unanimously. VII. PS 72-12 DIArJOI~D LOCII EAST Fll'JAL PLAT APPROVED Request of Sabine Valley Lumber COlnpany for final plat approval for Diamond Loch East Subdivision. The overall preliminary plat has been approved. l"ffi. DA VE RITZ - FOR lir. Ritz came fort~ard to represent Sabine Valley I-lumber Company in their request for the Final Plat approval. He stated they planned to construct the same type homes as they had developed at the present time in Diamond loch. This would be of tlle same size construction. fIr. Ritz pointed out they planned to construct . some duplexes, but if they did not prove satisfactory, they would stay strictly single family dwellings. Ì-1rs. Shaunt~l moved, seconded by lir. Rinn to APPR01lE the final plat as requested subject to t11e Engineers final approval. Illation carried unanimously. Tl1e vote being 3-0.
