REGULAR MEETING
JUNE 22, 1972
Mrs. Shaunty moved, seconded by Mr. Welborn, that the
minutes be approved of the June 22, 1972 regular meet-
ing. Motion carried 3-0. All members present voting
affirmative.

Request of Stonybrooke, Inc. to rezone 35.6 ac~es out of the
J.B. Edens Survey from its present classification of "Agriculture"
to a proposed classification of "IF-9 One Family Dwelling".
MR. WALTER ELLIOTT - FOR
J.1r. Elliott came forward to represent Stonybrooke, Inc. in this
zoning request. He stated to the members of the Commission that
this tract of land had been before them approximately two months ago
presented by Mr. Herman Smith, and was denied because of the IF-7
request. The application was later submitted :for theIF-9 request,
and no one was present at the regular meeting July 22, 1972. At
this time the request was tabled.

Mr. Palachek of 8909 Kirk Lane came forward to check the minimum
square footage of the proposed homes. It was stated the minimum
would be 1,200 square feet. Mr. Palachek stated that was his main
concern in this zoning request.

After consideration of the members of the Commission, µ~. Welborn
moved, seconded by VJrs. Shaunty to approve this request. Motion
carried unanimously. All members present voting affirmative.
Request of Continental Housing Consultants to rezone 41.752 acres
out of the W.D. Barnes Survey from its present classification of
IIIF-9 One Family Dwelling" to a proposed classification of "IF-7
One Family Dwelling".
MR. F .D. RUTLEDGE - FOR
Mr. Rutledge came forward to represent Continental Housing
Consultants in this zoning request. He asked the members of
the Commission if he could present both cases at the same time,
this being PZ 72-32, and PZ 72-33. Dr. Hater told him he could,
and the Commission would vote on each case separately.
1>1r. Rutledge stated plans had been made for approximately two _
months with a retail shopping center company on the land they
had previously rezoned. He pointed out to the members this tract
was denied for the IF-7 zoning, and at a later date they applied
for the IF-9 classification which was approved. They were now
requesting the change for IF-7 on the 41.753 acres, and 5.008
acres to be zoned Local-Retail. He also pointed out the school
site would progress, regardless, of the outcome of this zoning
request. His reason for the IF-7 zoning was that this would be
the entrance to their subdivision, and with some of the area
being low, they had planned to develop this portion first. He
stated they proposed a minimum of 7,500 square feet per lot,
and 1,250 square feet per house. This area would be a buffer
zone between the Commercial zoned property, and the IF-9 zoned
property. They are prepared to bring water to this area, and
when zoned, all public utilities would be available.
Dr. Hager suggested to Mr. Rutledge to table the request at this
time, until he could come up with a Planned Development, or
Community Unit Development for this tract of land. He stated
the Commission did not think the proposed IF-7 would be feasible
at this time. Mr. Rutledge agreed to table this request until
a later date.
Mr. Welborn moved, seconded by Mrs. Shaunty, to table this
request. Motion carried 3-0. All members voting affirmative.

Request of Continental Housing Consultants to rezone 5.008 acres
out of the W.D. Barnes Survey from its present classification
of "IF-9 One Family Dwelling" to a proposed classification of
"Local-Retail".

Mr. Rutledge came forward to present the case to the Commission.
This request having been reviewed with case PZ 72-32, motion to
table was made by l\irs. Shaunty, seconded by Mr. Welborn. Motion
carried 3-0. All members voting affirmative.
Request of Mr. Jack Collard to rezone 5.934 acres out of the
E.S. Carder Survey from its present classification of "IF-12
One Family Dwelling" to a proposed classification of "Commercial".

Mr. Komatsu came forward to present the case to the Commission.
He presented a drawing of the proposed plans to the members of
the Commission, and to the audience. It was pointed out the trees
on the property would remain to screen the Commercial property
from the Residential area. The buildings to the East and West
were to be one story for an office park. The plans for the build-
ings to the North and South were planned to be multiple story.
Mr. Komatsu pointed out the location of the property. He stated
it was East of the Northeast Mall Shopping Center, Bank of North
Texas is on the West, and on the East is the residential area.
He stated they proposed approximately 80% to be one story office
buildings on the West side of the property line, and on the North
side facing Highway 121-A they proposed multiple story office
buildings. These buildings would be approximately three or four
stories in height.
MR. JOHN ERSKIN JR. - AGAINST - PEil'ITION
Mr. Erskin of 4812 Weyland came forward in opposition of the
zoning request. Mr. Erskin presented a petition signed by the
property owners in opposition of the zoning request. He stated
they wished to leave the area as single family. He pointed out
the noise level had gone up, traffic flow was much heavier, and
there had been more robberies in the area since some of the

property surrounding had been zoned Commercial. He stated with
the Connnercial type zoning, and not Planned Development, was
the same as a total blank check. Mr. Erskin pointed out the
excessability of this property was ve~ high.
Ivffi. LELAND CUMBIE - AGAINST
Mr. Cumbie of 4825 Weyland Drive came forward in opposition.
He stated this property was not in the same City as the North-
east Mall, and the property was not contiguous. He wanted the
property to remain the same, or Planned Development where it
could be agreed upon by the property owners.
ltffi. 11AX BRADFORD - AGAINST
Mr. Bradford of 7921 Weyland came forward in opposition of the
zoning request. He stated the trees to be used as a buffer did
not include his property, and if the multiple sto~ office
buildings were erected as proposed, the tennants would be looking
down in his back yard.
MR. TOM WINDERS - AGAINST
Mr. Winders of 4900 Weyland came forward in opposition of the
zoning request. He stated he had lived in the area since 1963
and did not ~nu1t commercial zoning or any type business in the
area. He said it would detract from the neighborhood.
MR. CLYDE HUSSEY - AGAD1ST
Mr. Hussey of 4901 Weyland came forward in opposition. He stated
he would consider Planned Development for fairness to all
involved.
After discussion by the members of the COnmdssion, Mr. Welborn
moved, seconded by Mrs. Shaunty to deny this zoning request.
Motion carried unanimously. All members present voting af.firmative.
Request o.f Mr. J.C. Harston to rezone Lot 18, Block J, Smith.field

MR. J.C. HARSTON - FOR
Mr. Harston came forward to present his case to the members of
the Commission. He stated he lived at 6345 Davis Blvd., and
this lot is at 6349 Davis Blvd., this being at the corner of
Cardinal Lane and Davis Blvd. Mr. Harston pointed out to the
members that he was surrounded by Local-Retail, Commercial,
and Industrial zoning. He stated he had been in doubt of his
zoning since the zoning map was adopted, and after the last
zoning map was printed, he realized he was zoned IF-9 One Family

Dwelling. He stated the property North of this lot was vacant,
and his home was to the South. Mr. Harston ownes three lots
behind this property. Dr. Hager stated that since Center Street
did not go all the way thru, it should be vacated to clear the
records. Dr. Hager asked Mr. Harston why .he was asking for
zoning on this one lot, and not on the other lots he owned.
He stated he wanted to put in a furniture store at this location.
Mr. Harston was asked if he would amend his application from
Commercial to local-Retail. He stated he would, and did not
realize at the time he made application what type zoning to
request. Motion to amend the application was made by Mrs. ShauntYJ
seconded by ~1r. Welborn. Motion carried 3-0. After discussion
by the members Iv1rs. Shaunty moved, seconded by ~1r. Welborn to
approve this zoning request for Local-Retail. Motion carried
3-0.
Request of Camco, Inc. to rezone 32.123 acres out of the S.
Richardson Survey from its present classification of "Agri-
culture" to a proposed classification of "IF-12 One Family
Dwelling r, .
MR. DA VID MOAK - FOR
:Hr. Hoak came forward to represent Cameo, Inc. in this zoning
request. He stated at the time of the application Cameo, Inc.
was the owner of the property, and since that time they had
sold it to lvIr. B.W. Franks. He pointed out there were 82 lots
drawn on the plat that was posted for the members of the
Commission to review. He stated there were some modifications
that would have to be made before requesting subdivision.
Mr. Fred l'Iorrow -
Mr. Morrow came forward stating he owned property to the East
of this tract of land, and wanted to know the size homes they
proposed to build. He was told that IF-12 was the highest type
ZOnillg with a minimum of 1,400 square foot living area.
¥Jr. Don Davis stated that they proposed from 1,400 to 1,BOO
square foot living area, and had planned to start within six
months.

Mr. Palachek of 8909 :Kirk Lane came forward asking that the
largest type homes be built in this area as possible. He stated
with smaJ.1.er homes to the South, he would object if ~_
strictions were not placed as to the minimum square footage.
MR. TED BOYD·,-
Mr. Boyd came forward to ask what type access there would be
from Rumfield. It was stated there was a proposed street on
the plat, and when developed there would be one off Kirk Lane.

After discussion by the members of the Commission, ~~s.
Shaunty moved, seconded by }1r. Welborn to approve this
zoning request with the stipulation that all houses
adjacent to Kirk Lane be a minimum of 1,600 square feet.
Motion carried 3-0. All members present voting affirmative.
Coventry Place Estates - Final Plat
MR. WALTER ELLIOTT - FOR
1vfr. Walter Elliott came forward to represent :Mr. Legge' in
this request. He stated the plans had been reviewed by the
City Engineers, and they would comply with any request made.
1~. Elliott pointed out to the members that their road in
this subdivision would line up with the road proposed by Mr.
Herman Smith in his subdivision (Stonybrooke, Inc.).
Mr. Welborn moved, seconded by Mrs. Shaunty to approve this
final plat subject to the letter from the City Engineer.
Motion carried 3-0. All members present voting affirmative.
Glenann Addition - Final Plat
MR. GLENN BUCKNER - FOR
Mr. Buckner came forward to present his case to the Commission.
He stated the plat should read Amundson Road South. Mr. Buckner
said he would comply with all request made by the City Engineer.
After review of the construction plans Mrs. Shaunty moved,
seconded by Mr. Welborn to approve this final plat subject to
compliance with the City Engineers specifications. Motion
carried 3-0. All members present voting affirmative.
After having been reviewed by the members of the Planning and
Zoning Commission, Dr. Hager stated if any error was found it
would not have to be rezoned, just changed to comply with City
official records. Mr. Welborn moved, seconded by Mrs. Shaunty
to approve the zoning map. Motion carried unanimously. All
voting affirmative.

Mr. Welborn moved, seconded by Mrs. Shaunty that the meeting
be adjourned. Motion carried 3-0. Meeting adjourned 9:15 P.M.
July 27, 1972.
