H01iE DENIED ~ MINUTES OF THE ~1EETING OF THE PLANNING AND ZONING COJvITvlISSION OF THE CITY OF r~ORTH RICHLAND HILLS, 4101 MORGAN CreCLE, THURSDAY SEPT~fBER 28, 1972 - 7:30 P.M. REGULAR MEETING The regular meeting of the Planning and Zoning Commission was called to order by Chairman, Mr. Louis Rinn. PRESENT: Chairman: Mr. Louis E. Rinn Dr. Charles Hager l1r. J. W. Shaunty CITY STAFF PRESENT: City Manager City Clerk 14r. M.E. Riddle Betty Terrell ABSENT: Vice Chairman Secretary Mr. D.R. Stembridge .Mr. Gene Welborn Dr. Hager moved, seconded by Mrs. Shaunty, that the minutes be approved of the August 24, 1972 regular meeting. Motion carried 2-0. Mr. Rinn abstaining not being present at the meeting. Request of Mr. H.M. Howe to rezone 9.01 acres out of the Stephen Richardson Survey, Abstract 1266, and the John Condra Survey, Abstract 310 from its present classification of "Agriculture" to a proposed classification of "Local- Retail" . }1R. H.lvI. HOWE - FOR ~~. Howe came forward to present his case to the Commission. He presented some old plats dated September, 1967 to the members. He pointed out the area that was restricted at that time and filed for record. He stated his property was not in the City at that time. The purpose of the zoning request was for apartments or town houses. It was noted that this would be impractical at the present, due to there being no sewage. ~~. Howe stated he had sold most of his property except for the nine acres, and forty acres behind him. . . . PZ 72-40 L.D. KE11P & }lIIŒ BFulCKNEY DENIED ~ JvlR. TO~1 CAVE - AGAINST Mr. Tom Cave, Attorney, came forward to represent the general property owners in this zoning request. He stated most of them had already built homes, and some had not at the present time. He presented a plat drawn up to show the surrounding property owners of the area, and presented a petition opposing this request. ~,~. Cave had two petitions, one with names of the adjoining property owners, and one with the general property owners. He was advised that only property owners within 200 feet would qualify. }1r. Riddle asked him to file it with the City Secretary. He pointed 011t that most of the property owners had approximately one acre tracts, and some of the homes were in the $40,000.00 to $60,000.00 range. }~. Cave stated that local-retail was too broad for zoning, and premature at this time. There being no water or sewage in the area for this type zoning change, it was not practical to consider this request. Mr. Howe's son stated his father did not intend to hurt~~ one. He only wanted to help the community. After consideration by the members present, Mrs. Shaunty moved, seconded by Dr. Hager to DENY this request. Motion carried 3-0. All members present voting affirmative. Request of l~. L.D. Kemp and .Mr. II/like Brackney to rezone 1.50 acres out of the S. Richardson Survey from its present classi- fication of "Local-Retail" to a proposed classification of "Conunercial" . MR. KEN" DANIEL - FOR Mr. Daniel came forward to represent Mr. Kemp and Mr. Brackney in this zoning request. He stated the location of this tract was not practical being behind Harrington Grocery and Station. He stated they wanted to open an electric shop at this location. Dr. Hager;as.ked why did they request commercial on only this l~ acres. He stated it was because of the trucks coming into the business, and this would be a buffer zone around it by leaving the local-retail on the other property. 1\1r. Riddle asked :[vIr. Kemp if he was in the excavating business. He stated he was. He said l~fr. Brackney had two dump trucks, and he had two loaders, two floats, and two trucks. At the present time they were on the John Hay property, and were having to move to another location. lÆR. ALAN 00111 - AGAlliST l1r. Hamm came forward in opposition of this zoning request. . . . PZ 72-41- ~v.F. POLSTER TABLED PS 72-22 FOSTER VILLAGE FINAL PLAT APPROVED PS 72-23 OAK RIDGE PARI\: PREL]}1INARY OVERALL PLAT APPROVED ~ He stated he owned property 201 feet North, and property East of this tract. .Mr. Harron pointed out to the members of the Commission that they had opposed the zoning request made by l1r. Crisp when he owned this property, and had asked for Commercial. At that time the tract was zoned local-retail. 1-1r. Hamm stated he was trying to protect his property, as he had some 28 acres to be residential area, and to sub- divide at a later date. He pointed out that dirt working equipment would not be desirable for a residential area. After discussion by the members of the Càmmission, }œs. Shaunty moved, seconded by Dr. Hager, to DENY this zoning request. 11otion carried 3-0. All members present voting affirmative. Request of 1{r. W.F. Polster to rezone the South 33 feet of Lot 3, and the North 67 feet of lot 4, Block 2, J .14. Estes Subdivision from its present classificati,on of "Local- Retail" to a proposed classification of "Commercial". No one came forward to present this request to the Commission. Dr. Hager moved, seconded by Mrs. Shaunty to table this request until last on the agenda. At that time no one was present to present this request to the members. This request was TABLED until the next regular meeting. Motion was made by Dr. Hager, seconded by }írs. Shaunty. },Iotion carried 3-0. Request of Foster Village - Final Plat l~ffi. Jll,í S~ŒENY - FOR 1-1r. Sweeny came forward to present the case to the Commission. He pointed out to the Commission the plat he had on the wall. He advised the members that all corrections had been made as outlined by the City Board, City Council, and had now been approved by the City Enginee~s. This plat and construction plans did conform to the cormnents as outlined in the letter of comments from the City Engineers. Dr. Hager moved, seconded by Mrs. Shaunty, to APPROVE this Final Plat. Motion carried 3-0. All members voting affirmative. Oak Ridge Park - Preliminary Overall Plat . . . PS 72-24 OAK RIDGE PARK FINAL PLAT PHASE #1 TABLED PS 72-25 ROBERT A. vffiITE VARIANCE ON SUB- DIVISION AND BRICK ORDINANCE APPROVED ~ fIR. F. D. RUTLEDGE - FOR Mr. Rutledge came forward to present his case to the Commission. He stated he had changed the lot size to comply with the City Engineers. He also pointed out to the members of the Commission that he had been working with other developers in the area to accomplish what could be gained in this area. They are all working together. The overall water and sewer study is being made by the surrounding Cities of the area. After consideration of the members of the Commission, 11rs. Shaunty moved, seconded by Dr. Hager to APPROVE this preliminary plat with the stipulation that all requirements be met as outlined by the letter of comment by the City Engineers. Motion carried ]-0. All members present voting affirmative. MR. F.D. RUTLEDGE - FOR Mr. Rutledge came forward to present his case to the Commission. He stated he had appealed his zoning to the members of the City Council. This being the meeting of October 9, 1972. Mr. Rutledge stated that if it was approved by the City Council the final plat was in order according to the letter from the City Engineers. Dr. Hager stated it would be in violation to approve this plat at this time, not being approved by the Council. Members of the Commission did tell l-1r. Rutledge they would be glad to call a special meeting at such time the zoning had been approved. At this time if the plat was approved, there would be some lots not up to the IF-9 zoning, and this was not what had been re- quested in the zoning change from the IF-9 to IF-7. Dr. Hager moved, seconded by 11rs. Shaunty to table this final plat until after it had gone before the Council. After that time, if approved, they would call a special meeting to hear this request. 11otion carried ]-0. All members present voting affirmative. ~·ffi. ROBERT A. m-IITE - VARIANCE ON SUBDIVISION AND BRICK ORDINANCE . . ~ MR. ROBERT A. WHITE - FOR ~fr. White came forward to present his case to the Commission. He stated he purchased this property in May of 1972, thinking it was in Hurst. At the time of the purchase he did not plan to build. He stated his friend being an architect wanted to build him a recreational type home for the weekends for he and his family. At this time they went to Hurst City Hall and was told this property was either in Smithfield, or Colleyville. .Mr. Vfuite said he did not know it was in the City of North Richland Hills. This being an unusual type structure he did not know the building code. He stated he had local builders to construct this type house, and was acting in complete honesty at the time the construction was going on. Pictures of the construction was shown to the members of the Commission. :r.1r. White stated the approximate cost was $6,800.00. This building is 28.6 feet in diameter, being approximately 615 square feet. The requirement for Agriculture zoning is 800 square feet. ~~. White stated he had a deep well on the property, and had installed a septic system. After going before the Board of Adjustment, he has gone to the County Health Department to have a percolation test made for hi~ septic system. JvIr . White asked the members if they would grant this variance, he would abide by the ruling set forth by the Board of Adjustment. He stated he would like to enjoy his home for ~mekends at this time, and not enclose the bottom portion of the structure due to the fact he wanted to move it to a water front when he could purchase the property suitable. }~. Riddle stated to the members of the Commission that ~œ. ~f.hite should have had a topo made and checked by the City Engineers. This would have been for drainage of water, and streets should have curb and gutter, and the structure should be facing a street. These items are outlined in the Subdivision Ordinance. After discussion by the members of the Commission, Dr. Hager moved, seconded by l1!-s. Shaunty to approve this request within the time limit as set forth by the Board of Adjustment. Motion carried 3-0. The Zoning Foard of Adjustment granted the following: A (1) year minimum variance to begin at such time the City l~ager removed the red tag, with a (]6) thirty six months maximum limit. At any time after (1) yeat from this date with written letter from the City }1anager, with or without cause., with a (90) day limit this structure is to be removed from the property.
