J1INUTES OF THE r·ŒETING OF THE PLANNING AND ZONING COr·1}fISSION OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, HELD AT THE CITY HALL, 4101 l10RGAN CIRCLE, THURS- DAY, FER.'qTJARY 25, 1971 - 7:30 P.li. The regular meeting of the Planning and Zoning Commission was called to order by Chairman, Vim. N. Ratcliff 1·1otion of approval was made by ¥~s. Shaunty, seconded by 1"1r. Rinn. Motion carried unanimously. PPtESENT : Chairman Secretary \'m. N. Ratcliff }1rs. J. 1'1. Shaunty H.P. Peters Louis E. Rinn ABSENT: Dr. Hager C.R. Ballenger, Director of Public \vorks, Betty Terrell, City Clerk lŒ. ·Rat.cliff called for PS 71-1 request of 1vfr. B.R. Franks to subdivide Lot G, Calloway Acres into Lots Gl and G2. There be- ing no one present at this time to represent this case Ivir. Rat- cliff moved to pass this case and move to the next case on the agenda. Request of 111-. Jirmny R. Frost, ~>1r. Charles L. Yates, and 11r. Lucian W. Smith to rezone 6.0 acres out of the John Condra Survey from its present classification of "Agriculture" to a proposed classification of "IF-12 One Family Dwelling". 1\11-. Lucian Smith asked the Commission if }~. Ballenger could pre- sent his case to the Commission. The Commission allowed this presentation. 1~. Ballenger stated that permanent zoning from Agriculture to IF-12 was requested and subdivision into two acre tracts was asked for and explained that water would be furnished from the Douglas Lane water line. !oír. Ballenger poiJlted out the lots were deed restricted to 1,800 square feet of living area, and the Administrative Staff had been instructed by the Council to handle this case with the upmost expediency. }~. Harold Rhea came forward stating he was in agreement with the proposed change. No one came forward in opposition. After due deliberation by the members of the Conrrnission motion of approval was made by ~æ. Peters, seconded by }~. Rinn. Motion carried UnanLYIlOusly. l~íotion on PS 71-2 of approval was made by l1r. Rinn, seconded by lrIr. Peters. 1·1otion carried unanimously. PS 71-4 . PS 71-1 . . College Hills Final Plat was presented by Dr. Curtis Ramey. Dr. Ramey stated that in so far as he was able to determine all provisions of the City Ordinance had been met. }~s. Shaunty and }fr. Peters questioned the legal. }fr. Ballenger explained to the Commission the terminology of the legal and certified that it was in fact correct. rJ~. Peters questioned construction plans not being supplied. ~~. Ballenger explained to the Commission that funds for the construction of the culdesac would be placed in escrow, and that the City would handle this construction as a seperate function. After much deliberation, r~. Peters made the ¡notion to accept the plat subject to the Engineers clarifying a pointed question regarding lot sizes. l~fotion was seconded by I.'Irs. Shaunty. I-h-. Rinn voiced opposition to the motion stating that he felt that the stipulation should not be a part of the approval, and made the motion to amend l·ír. Peters motion to delete the stipulation. This was seconded by 1wirs. Shaunty. On a show of hands the Commission voted 2 to 2 to amend the motion. l-:Tr. Rinn and }~s. Shaunty voting affirmative, and I-fr. Peters and r.rIr. Rat- cliff voting negative. On a show of hands on 1-1r. Peters original motion t11e Commission voted 4-0 to approve. Chairman P~tcliff then called for PS 71-1 request of þ~. B.R. Franks to subdivide Lot G, Calloway Acres into Gl - G2. lIr. ~'l.}'I. Franks came forward to present the case to the Commission. lIr. Franks stated that he and his brother were O'WI1ers of these lots and '\-Tished to subdivide them. I¡Ir. Franks stated that he wished to develop this property and 'WOuld place curb and gutter, and meet any City requirements necessary. No one appeared to spe&( against this subdivision. After due deliberation motion to approve as a preliminary was made by I-Irs. Shaunty, seconded b:Jl llr. Rinn. líotion carried unanimously. Citizen Presentation - ~1r. R. P. Vinal! - This request was tabled at the meeting of January 21, 1971 for further on site inspection and accwnulation of additional facts. 1~fr. Ballenger presented the case to the Comwission stating that he could find nothing in the County records indicating a record of easement. He stated that he had no objection to the closing of Frankie B, but opposed the closing of Buck Street. After due deliberation the Commission on a TIlotion By I·Ir. Rinn, seconded by l¡Tr. Peters voted unanimously- to grant no recommendation regarding t11e closing of this street. l,íotion carried unanimousl:)T. Administrative Presentation... Request of I'·Ir. RaJt" Thomas to annex 120 acres 11est of Rufe Snow Drive and North of Chapman Drive re- quest Comrnission's feelings on annexation. 1"~. Ballenger stated that l.Jr. Ray Thomas requested the feelings of the Commission re- garding the annexation of his property joining this City on the ~~lest. After much discussion and due deliberation motion was made by lfr. Rinn that the Zoning Board express favorable attitude to his request. IIotion was seconded by Ì{rs. Shaunty.
