Request of I-:Tr. }.]:. C. Johnson to rezone 1. 65 acres
out of the J. c. lTcComas Survey from its present
. classification of "Agriculture" to a proposed
classification of "IF-9 One Family Dwelling!'.
Request of }\~r. I:I.C. Johnson to subdivide 1.65
acres out of the J. C. }~CCoITtB.S Survey into six
lots. Dr. lIager stated to the members of the
Commission, and to the audi~nce that the zoning
case PZ 71-17 previously scheduled to be l1eard
at this time was not on the agenda for this
meeting, as a letter had been received stating
t~hey wished to withdraw the request of l'fr. H.O.
Pulliam. Dr. lIager also stated that all property
owners within 200 feet had been notified of this
change. lIr. iI.C. Jor.J1son cam.e fozward to present
his case to the Commission. He stated that he had
o'tm.ed the property for some time, and due to health
reasons.he''Wished to rezone, and subdivide making
it for sale. He stated that all taxes had been
paid on t11e property. lIre Riddle stated that the
plat 'WOuld meet the zoning request.I'ir. Gene ~velborn
came forward in opposition. He stated that he ownes
property adjacent to the property in question, and
having no sewage in tl1e area, the land \-rill not
t~(e septic systems for six homes on the acreage
involved. The 110mes in the area surrounding this

property are in the $30,000.00 to $35,000.00
price range on the tax roll. lIr. R. P. Vinall
ca~e forward in opposition to the request for
subdivision of six lots. That would r1ake too
TIlany homes for the size of the lots, and there
is a drainage problem in the area. l'·Ir. Robert
JeIartin came forward in opposition. He stated
that Flli\ asked for an acre or more in the area
to build. l·Ir. Dewitt P&er spol{e for his son
that llad propertj'r in tIle area in question. He
stated that by building that ~~T homes on the
amount of property beiP~ owned by ],1r. Johnson

T .11. Srnith came forward in protest of the sub-
division, stating t11at Inost of the propertð"

half acres in the $30,000.00 price range. He
stated that the size of the lots and l10mes in
question were too srnall. I~'Ir. C.S. Pearson came
fonrard in opposition of tIle subdivision. lIe
stated that if one or two Ì!OUses,-~ v.lere to be
built it would meet approval, but not tl1e six
tl1at were asl\:ed for in t11e reqllest. liTr. Rinn
stated that lot size was most of the opposition.
Dr. I-lager asked lIre Johnson if he vlOuld like to
amend l1is request on the zoning change to tr IF-
12 rather t11an the fJ TI?-9 ft. lie stated that 11e
would, if t11e subdivision could be granted. Dr.
Hager told Er. Johnson that 1'las the next case,
and this was only tIle zoning request. lIr. Jòbnson
ag-reed to a.mend the request to "IF-12 One Famil:)T

ca'tion from IIIF-9 to IF-12, and approve the zoning
request vTaS made by lIr. Rinn, seconded by Ì'¡cr-.
Stembridge. IIotion carried 3-0. Dr. flager stated that
since both cases had been reviewed by the Commission,
and the audience, he tfould lli\:e to point out that
r'r. Ballenger stipulated in his report to the Com-
Iri.ssion that lLr. Jolmson had not complied with the
àubdi vision requiremel1ts by furnishing his office
an acceptable preliminary plat and To-Po. 1'~.
Ballenger stated for the record that he had notified
r.:r. Jolmson of t11ese deficiencies, and l!r. Jolms6n
had still not complied, but 11ad chosen to trJr to come
before the Commission for subdivision with a surveyors
plat only. lifter consideration of the COmmission,

by lIr. R.inn on Case PS 71-12 for sUbdividing. Ì~lotion
carried 3-0. Property owners in the audience asked

we would do so at their request.
