BA 72-4 . ~ MINUTES OF THE MEETING OF THE BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, HELD AT THE CITY HALL, 4101 MORGAN CIRCLE, TUESDAY JUNE 20, 1972 - 7:35 P.M. The meeting of the Board of Adjustment was called to order by Chairman, H.B. Helton at 7:35 P.M. PRESENT: Chairman: Vice-Chairman: Secretary: Mr. H.B. Helton Mr. Leslie A. Trotter Dr. E.K. Hahn Mr. Charles Palachek, Jr. CITY STAFF PRESENT: Director of Public Works: Allen Bronstad City Clerk: Betty Terrell ABSENT: Jay Jones Mr. Trotter moved, seconded by Mr. Charles Palachek, that the minutes of the previous meeting be approved as written. The motion carried by a vote of 4-0. Request of Mr. Robert Lewis for a variance from the City of North Richland Hills Zoning Ordinance No. 179, to place a mobile home on a 35 acre tract out of the Stephen Richardson Survey, Abstract 1266, Tract A, on a temporary basis. This property is East of Davis Blvd.. and North of Timber Drive. ROBERT LEWIS - FOR Mr. Lewis came forward to present the case to the members of the board. He stated that Mr. Withers lived on the property at the present time, and traveling out of town so much he wanted someone to li ve on the property, and take care of his livestock. Mr. Lewis stated he nor Mr. Withers owned the property. It is owned by Mrs. Kay Shivers. He stated that Mr.. Shivers lived on the property, and being elderly, needed the rent check. Dr. Hahn asked Mr. Bronstad about the septic system if the application was approved. He stated to the members that it would have to be approved by the County Health Department. Mr. Lewis asked the Commission for a ten months variance for the mobile home. m. LEON GEORGE - AGAINST Mr. George presented the members wit~ a petition signed by the surrounding property owners. He ~tated that Mr. Lewis should move into the mobile home park that had been established for this purpose. . ~. J .E. J;IIDGETT - AGAINST Mr. }tidgett came forward in protest of the request. He stated that the mobile homes now existing were there before the area was annexed to the City, but he did not want any more in the area. This would devaluate the property of the homeowners in the area. 11R. ROY W. ~ICVICKER - AGAINST ~1r. l1cVicker came forward in opposition of the request. He stated to the members of the board that his property was in front of the property that the mobile home would be placed, and did oppose having one placed there. 11R. JOHN SHIVERS - AGAINST Mr. Shivers came forward in opposition of the request. He stated that he had 70 acres adjoining this property for sale, and with a mobile home placed there would devaluate his property. He stated the mobile home on the property at the present time was placed there before the property was annexed by the City, but did not want another one placed there. . 11R. C.C. GILBREATH - AGAINST Mr. Gilbreath stated he was opposed to the request made by Mr. Lewis. Mr. Helton called for a recess at 8:10 to study the request. City Attorney, ¥œ. Tim Truman was called regarding the request made by 1-11-. Lewis, with his being the lessee, and not the property owner. The ruling was that the lessee could file, but the property owner must have a letter in writing to whom it may concern, City Secretary, or to a member of the Board authorizing this request. Mr. Helton called the meeting back to order at 8:45 P.M. After much discussion, Dr. Hahn moved, seconded by Mr. Palachek to deny this request. Motion carried by a vote of 4-0.
