The meeting of the Board of Adjustment
was called to order by Chairman, Mr.
H.B. Helton at 7:30 P.M.

Motion of approval of the minutes of the previous meeting was
made by Mr. Trotter, seconded by Dr. Hahn. Motion carried 5-0

Request of ~frs. Gustavo Azamar for a variance from
the City of North Richland Hills Zoning Ordinance
Number 179 on Lot 7, Block 27, Nor'East Addition
being 7601 Nor'East Drive to allow fence to re-
main in the required set back area. 11r. Aza:m.ar
came forward to present the case to the members
of the board. He stated that when they purchased
their home the stakes to their property were not
in the proper place. Not knowing this had happened,
they planted grass in the area that was found not
to be their property. lvfrs. Aza:m.ar showed their plat
to the members of the board. He stated that they had
checked to find there was no ordinance regarding fences,
as stated to them by two of the Councilmen, but now
had found that this was in error. Several neighbors
that '~;have property joining their's came forward
stating they had no objection to the fence as it
was erected at the present time. They stated it did
not obstruct view from any direction. 111-. Ballenger
stated £'.011 the record that the fence was red tagged
by the City. ~1r. Ballenger read the basis as to how
the decision was made from Ordinance No. 179, Para-
graph 1, and 13 of "Definationsu. This being the
defination of structure. The square footage area of
the yard was checked by the members. l{rs. Azamar
stated they waited one year from the time they came
for their permit due to a death in the family. ~Vhen

they started the construction of the fence, they
had to leave the stakes in the yard for some time
due to the fact that Sears did not have the fence
in stock. They stated that by being informed they
could let the fence extend out tò 9! feet behind
the curb from two of the Councilmen, they thought
they were correct in the installation. Recess was
called by Chairman, l-fr. H.B. Helton, to allow the
members to review and discuss the case. After much
discussion motion of approval was made by Mr. Trotter,
seconded by Dr. Hahn, with the stipulation that if
in the future Topper Drive becomes a thoroughfare,
or sidewalks be required, the fence must be removed
to comply with City Ordinance of the City of North
Richland Hills. l\lotion carried unanimously. The board
upheld Mr. Ba.11engers interpretation of the ordinance,
but granted the variance on the basis of information
submitted.

by Hr. Jay Jones. Motion carried unanimously. Meeting
adjourned 10:00 P.M., October 19, 1971.
