CALL TO ORDER ROLL CALL STAFF PRFßENT ITEMS ON AGENDA FOR SPECIAL CALLED PLANNING AND ZONING MEETING MINUTES OF THE SPECIAL CALLED MEETING OF THE PLANNING AND ZONING CœMISSION OF THE CITY OF HORTH RICHLAHD HILIß, 4101 MORGAN CmCLE, THURSDAY MARCH 9, 1972 - 7:30 P.M. The special called meeting of the PlanRing and Zoning Commission was called to order by Chairman, Dr. Charles Hager PRESENT Chairman Secretary Vice Chairman Dr. Charles Hager Mrs. J.W. Shaunty Louis E. RiJm D.R. Stembridge Gene Welborn ABSENT Mr. M.E. Riddle, Acting Cit,. Manager, Betty Terrell, City Clerk . PZ 72-8 Request of Mr. J.M. West to rezone 1.452 acres out of the Smithfield Estates from its present classitication of I1Agriculturett to a proposed classification ot tlConmercialll. Mrs. West came forward to present the case to the Commission. She stated that since her husband was a City employe., he had asked her to present the case. Mrs. West stated their property had just been annexed by the City of North Richland Hills, and they did not have &r17 objection, :yet it had left them in the position ot being forced to request permanent zoning to allow them to continue with the plans and purpose tor which they had purchased their place. She stated at the present time, &s shown on the plats submitted, they have & beauty shop, small reataurDat building, a large shop building, and a trailer house along With their home on the property. She stated they understood they could operate these business under nonconform- ing uses under the grandfather clause trom now on, but would be unable to expand. or improve their place. Mrs. West stated before they were taken in by the City, her husband had verbally arranged · · tor the necessary financing to accomplish expansion of the concrete bJ.ock building, and install several mini warehouses. When they were armexed~ the lending agency advised it wøul.d be necessary to establish permanent zoning before the deal could be completed. Mrs. West pointed out that at least 95% of all the property along Highway 1938, that is zoned at all, is zoned either I'Local-Retailtf or nConmereialn. Since sewage is not available at this time, she stated they teel that mini warehouses would require little or no septic system use, and this plan would be most beneficial to all concerned. Mrs. West stated they feJ.t this would be the highest and best use ot their property. Mr. J.}.!. Drake ot Timber Drive came for- ward in opposition of the zoning request. He stated this would destroy his property value as residential, and he did not like the type ot construction o£ the buildings. He stated this would cause a tratfic hazard. Mr. Jerry Shoemake of 8612 Timber Drive came forward in opposition ot the request. He stated he was opposed 1;8 the cate building and to the trailer. Mr. Gary Childers came forth in opposition, stating he wanted it to remain residential. Mr. Virgil Calvert of 8226 Timber Drive came forward in opposition. Mrs. Barbara Drake came forward in opposition. She stated this type of zoning would create too much noise, and she was not in favor of Conmercial zoning. Mr. Riddle stated that in the future the trent tor this area would be toward Local-Retail or Commercial zoning. He explained to the audiance that it zoning was granted, the City would then have the jurisdiction over all bui1ti-\Dg activity and it would have to meet with the City b11ilttlng codes and Ordinances. The City would also require a screeing fence to be placed around this property it Conmercial zoning was granted. Mr. West then stated he could not amend his application because of the tact of mini warehouses requiring Conmercial zoning. Atter much discussion of the members of the Conmission, motion of denial was made b7 Mr. stembridge, seconded by 1'æs. Shaunty. Motion carried 3-1, with ]tIre Rinn voting affirmative.
