The meeting of the Board of Adjustment
was called to order by Chairman, Mr. H.B.
Helton at 7:30 P.M.

}totion of approval of the minutes of the previous meeting was made
by Mr. Jones ., seconded by Mr. Goodnight. Motion carried unanimously.
ITEMS ON AGENDA
FOR BOARD OF ADJUST-
MENT ÞŒETING p~ 70-24
~equest of Mr. B.W. Gile.s for an appeal ruling of
Director of Public Works, request to be allowed to
build in accordance with deed restrictions on all
undeveloped lots in Smithfield Acres. Building Permits
rejected due to house footage less than 1,200 square
feet as required under IF-9 zoning. This being an appeal.,
the Board asked Mr. Ballenger to present the facts re-
lative to his decision. Mr. Ballenger explained that
Building Permits had been withheld due to the square
footage requested and because the proposed exterior
construction and proposed parking would not meet the
requirements of the Building Code. He pointed out that
Smithfield,Acres was platted and approved in 1952 by
the City of Smithfield. This addition was annexed as
platte~with many of the lots having less width than
required under IF -9 zoning. IF -9 zoning was placed
on this Addition in 1967, and the requirements being
more restrictive would take precedence over the deed
restrictions. In order for Mr. Giles to meet the set
back requirements, Mr. Ballenger stated that he would
not strenuously object to the Board granting a vari-
ance giving Mr. Giles some consideration relative to
square footage. Mr. Ballenger stated that he would
strenuously object to granting any variance relative
to the Building Code. Mr. Giles was then asked to
come forward to present his case. Mr. Giles stated

that he had purchased this property some eighteen
months ago ~dth deed restrictions of 820 square feet
on these lots. In order to compl~l vrith FHA require-
ments, blocks 1 thru 7 remained at 820 square feet,
and blocks 8 thru 13 had been raised to 1,100 square
feet. The Addition had been approved by FHA with
these restrictions. f-fr. Giles e.xplained that due to
the narrow width of some of the lots, the qualifi-
cation of purchasers, and the available financing
led to the proposed type and size of houses he wished
to place on these lots. In order to hold the construc-
tion cost in line with the available rnarket, he wished
to comply 1~th his deed restrictions as to size and con-
struction. Dr. Hahn asked about the streets. l"Ir. Giles
stated that they 't'lere in, and 1~fr. Ballenger stated that
these streets had been accepted and vrould be sealed in
the spring. lIr. Trotter asked about utilities. }ír.
Ballenger stated that utilities were available for the
addi tion. 1·:.r. Goodnig11t asked to see copies of the
deed restrictions. tlr. Giles produced the deed restric-
tions on blocks 8 thru 13, and stated that he did not
have the deed restrictions covering blocks 1 thru 7
1V'Ïth him. lwfr. Trotter made the motion to recess,
seconded by lifr. Goodnight, to allow 1·1r. Giles to go to
his office and get them. lfotion carried unanimously.
III'. Helton called the meeting back to order and 1{r. Giles
presented tl1e deed restrictions covering blocks 1 thru 7.
After Imlch deliberation by the Board, Chairman Helton
advised f'lr. Giles that the Board would rule on his
appeal, and he would be notified of their ruling not
later than Friday next. lfr. Helton ca1.1ed for a short
recess. }1eeting was called back to order and members
of the Board further questioned Ì·Tr. Ballenger regarding
facts of this case. tTr. Goodnight made the motion to
deny loTI-. Giles appeal and uphold the decision of the
Director of Public '·¡orks, but to grant J:vír. Giles a
variance to allow 1,100 square foot houses to be built
on the remaining undeveloped lots in this Addition,
provided all applicable provisions of the Zoning and
Building Codes be met. 1·1r. Helton instructed I'Jr.
Ballenger to so advise f'lr. Giles.
