The meeting of the Board of Adjustment
was called to order by Chairman, H.B.
Helton at 5:30 F.}:.

Reconsideration of variances granted B.W. Giles in Snrlth-
field Acres. City Attorney, l'Tr. Dennis 1,lorrow came forwaDd
and explained to the Board of Adjustment that the 1,100
square foot houses granted at the previous meeting was not
adequate on the lots in Block 1 thru 7. He explained to the
Board that this was an unusual case in as much as this area
was platted, accepted by the City, then zoned IF-9 and that
the lot sizes did not comply with IF-9 zoning. He told the
Board that it was his recommendation that a variance to 1,000
square feet be granted on Blo ck 1 thru 7, lIr . George Boring,
Attorney for 1·1r. Giles, stated this would be satisfactory to
his client, and thejT would agree to cornply with all other
provisions of the Building Code. After much discussion and
consideration by members of the Board, motion to grant a
variance to 1,000 square foot living area requirements on all
lots in Blocks 1 thru 7, Smithfield Acres. l/:otion was seconded
b:l 1,T. Trotter, motion carried unanimously .
Motion to adjourn ~ms made by Jay tJones, seconded by Leslie

Dear Mr. Russell:
For presentation to the Board of Adjustment, please be ~divsed that the law
suit styled B. W. Giles Builder, Inc. - Vs - city of North Richland Hills,
has been continued with agreement with the city Attorney as follows:
The Court will continue its injunction against said city on a day to
day basis until such time as your Board of Adjustment acts in regard
to Mr. Giles request to build in accordance with your IF-7 zoning
on the following described property: Lots 1, 2, 3, 4, 5, 6, 7, 8, 9,
10, 11, 12, 13, 14, 15,,16, 17, 18, 20, 21 and 22 in Block 1; Lots 1,
2, 3, 4, 5, 6, 7, 10, 11, 12, 13, 14, 15, and 16, in Block 2; Lots 1,
2, 3, 4, 5, 6, 9, 10, 11, 12, 13, 14, 15, and 16, in Block 3; Lots 2,
4,5,6, 7,8,9,10,11, 13, 14, and 15, in Block 4; Lots 1,2, 3,4,
5 and 7, in Block 5; Lots 1, 2, 3, 4, and 6, in Block 6; 'Lots 2, 3, 4,
5, 6, 7 and 8, in Block 7, all in Smithfie14 Acres, an Addition in the
City of North Richland Hills, Tarrant County, Texas.
When your Board of Adjustment has granted its approval, then I will enter a
request for dismissal in regard to the law suit.
Your shortpess of notice, due to a prior commitment on my part, precludes my
being present for the hearing this date. Should you or any member of your Board
of Adjustment need to discuss this matter with me during the course of this
meeting, feel free to contact me at Mayor J. Bruner's home - 282-4527.
I will appreciate you or the Chairman of the Board of Adjustment advising me in
wri as to the board's action.
