CALL TO ORDER The regular meeting of the Planning and Zoning Commission was called to order by Vice Chairman, Clarence Pyron ROLL CALL PRESENT: Vice Chairman Clarence Pyron John Crawford James ~lalker STAFF PRESENT: Director of Public vlorl{s, C.R. Ballenger, City Clerk, Betty Terrell ABSENT : Ray E. Porter John Sprott Jr. . ITnm ON AGENDA FOR REGULAR PLANNING AND ZONING ~Ĺ’ETING PZ 69-3 Request of ~~. L.O. Welty to rezone 2.98 acres out of the J.H. Barlough Survey from its present classi- fication of IF-9 "One Family Dwelling" to a proposed classification of nLocal-Retail". l-tJr. Welty came for- ward to present his case to the members of the board. Mr. Welty stated that when he asked for Commercial zoning previously, he did not understand the type zoning at that time. He stated he wanted to put in a Hardware and Plumbing supply store, as there was no business of this type in the neighborhood. He stated this would be the best type business for the location of his property. The Zoning Commission reviewed the plat. l1otion of approval was made by Mr. Crawford, seconded by lJfr. Walker. Motion carried unanimously. PZ 69-4 Request of Mr. J.C. Hukill to rezone 12.712 acres out of the F. Wood and J.M. Crockett Surveys from its present classification of UAgriculture" to a proposed classification of "Industrial". Mr. John Hay came forward to represent 1-~. Hukill in this zoning request. He stated the reason for the zoning request was for a warehouse complex. This property is bounded by In- dustrial on the South, and about 200 feet on the East could be used for Railroad siding. Mr. Hukill ownes the property to the North of the property to be re- zoned and Davis Blvd. on the ~'lest would be a buffer zone. ~æ. Hay stated the type of business would not degrade the property in a.I\Y' way, and would be good for all concerned. Mr. Pyron asked if anyone in the audiance wished to voice their opinion. No one came forward. After review of the plat by the Commission, motion . . . ~ of approval was made by Mr. Walker, seconded by Mr. Crawford. Motion carried unanimously. PZ 69-5 Request of Hr. Alan W. Hamm Trustee to rezone 4.846 acres out of the E.S. Carder Survey from its present classification of "Multiple Family Dw"elling" to a proposed classification of n Commercial". Mr. Hamm came forward to present his case to the COmmission. He stated his reason for rezoning was the best and highest use of the property, and would be much better than Apartment type zoning as now classified. Mr. Hamm stated his reason for asking for Commercial zoning was that it would allow multiple story building, and in Local-Retail it would allow only two story building. The purpose of the request was to erect a business and professional building of high quality. ~~. Pyron asked the distance from the property to the lines of the homes to the South. Mr. Hamm stated approximately 230 feet. There would be approximately 50 or 60 feet across the street and about 213 feet to the South from the mall. Mr. Gordon Whitman came forward representing approximately 28 property owners in Woodcrest Addition in protest of the zoning change. He asked the members why this property was zoned .Hultiple Family about two months ago, and now asking another zoning change. He could not understand the fast request for change in zoning. ~;~. Sam Lawson came forward asking how often change in zoning could be brought before the Zoning Commission. At the request of the Zoning Board ~æ. Ballenger stated that by State Law if the case was denied, it would have to wait six months for a request for the same type zoning by the same owner, or an immediately request for a different zoning classification than that denied could be submitted, or if the land changed hands the new owner would have the right to apply for a zoning change immediately. Mr. Hazmn stated he was not one of the people that had asked for the previous zoning change. l"Ir. Lawson stated that if the zoning was approved, then possibly aD. five property owners in this area would want various zoning~ and the home owners were against the request. }~. Pyron asked Ì{~. Hanm if there was a street on the East side of the property. l~fr. Hazmn stated no. lIe replied that next to l-ir. Engleman r s property he had provided for putting in a street and installing it at his expense, or at a split cost. He stated the property fronts the Highway and has an access road now, and the State Highway Dept. would allow a curb cut. After consideration motion was made for approval by ~~. Walker, seconded by }~. Craw- ford. }fotion carried unanimously. PZ 69-6 Request of Lincoln-Fort Worth Limited to rezone 22.286 acres out of the W.W. Wallace Survey from its present classification of "Commercial" to a proposed classi- . ADJOURNI\1ENT : . SecretartJ, John Sprott Jr. . ~ 1'ication of "Local-Retail". Hr. Bob Dickson came for- ward to present his case to the members of the board. He stated this property was bounded by "Local-Retail" and "Commercial". The need for a single type zoning for this land was cited as the reason for this request. With various employment centers around, and major thoroughfare surrounding it was the most suitable type zoning. Part of the property was already zoned "Iocal- Retail" and this would be a more restrictive type zon- ing. t1ïth the amount of acreage involved this would. allow better planning, such as a community club, tennis courts, play grounds, and various other facilities that are needed to DUÙ{e a better neighborhood and more facilities available for children and all concerned. The members of the commission reviewed the plat, and after consideration motion of approval was made by J1r. Crawford, seconded by Mr. vlalker. Motion carried unanimously.
