II. CALL TO ORDER: 5:45 P.M.
III. CONSIDERATION OF l-iINUTES:
l'-lotion was made by li;fr. Crawford for approval of the minutes of the
previous meeting. Vlr. "'lalker seconded the motion. Motion carried
unanimously.
IV. ZONING CASES:
PZ 68-3 Request of :t-1r. Claude R. 1'1cClennahan and I-ir. Robert S. Folson to re-
zone 7.17 acres out of the E.S. Carder Survey from its present class-
ification of "Residential" to a proposed classification of "Local Retail".
The request was read b~r ~1r. Ray Porter. r·1r. Joe Geary came forward and
addressed the board members representing IvJr. :r~IcClennahan, and I-Ir. Folson.
I"lr. Geary explained that the entire tract should have been "local Retail"
at the time of application, since the Planning and Zoning Commission approved
Local Retail on November 22, 1965 and on October 20, 1966 the plat was
vacated and the streets were abandonded at that time. The property was
purchased at Local Retail proce, and it was found out later that it was
shown as residential on the Zoning ~·lap. 11r. Shutt asked ¥lr. Geary to re-
turn and discuss the plat and make formal application for re-zoning from
tfResidential" to "local-Retail". I··ir. Porter stated that he recalled the
night of the meeting of protest from the people living on Desiree, and
at that time the Planning & Zoning Commission approved "Local-Retail".
1/1lhen the case went to the Cit~r Council the tape did not reveal "Local-
RetailfT but the minutes did. This was stated by City 1·'Ianager, 1·1r. Shutt.
1~r. Porter asked if anyone in the audience wished to express their opinion.
There was no reply. Ì·1otion of approval was made by l-fr. Sprott and seconded
by Ì·Jr. P:yron. I"lotion carried unanimously.
PS 68-1 Request of l·Irs. Beulah Bailes Brown to vacate the Highland iiddition out
of the ~f. \1". vlallace 2606 Survey. 1·fr. Don Stegall represented I"!rs. Brown
in her request. He came forward and addressed the board members showing
the plat for vacating by removing streets and lots of said property. The
plat was filed in 1953 and has not been developed, the streets were dedicated
but are still unimproved streets and used only as pasture land. Iv1r. Porter
asked 1"1r. Stegall if there were any improvements on the property, and the
answer ~ms negative. The Planning & Zoning Commission reviewed the plat and
Zoning map. l~·Ir. Crawford asked if l;1rs. Brown. was sole ovmer of the property.
Ì·ír. Stegall stated that some had been sold, but it was under contract to
buy back the said property. It involves three o~rners and seven lots under
contract. 1·1r. Porter read from affidavit as I'Irs. Brown being sole owner,
and asked if this was valid as of April 23, 1968, as to vacate or re-zone
would require sole ownership. He stated that present property owners should

have presented their application along with t'æs. Brown. }œ. Porter questioned
1<Ir. Stegall about I\1rs. Bro\'ffi not being the sole Omler of the property and
contract of sales not complete. 1~1r. ~valker asked I¡Ir. Porter if vacating of
the property could be approved under these conditions. l1r. Porter requested
that present property owners send certified letters to the City of North Rich-
land Hills that they would sell their property back to }1rs. Brow:n. loTr. Porter
suggested that property OW'I1ers join with r-Irs. Brown in her request and that
said be stipulated as it is presented to the Council for their action. Motion
of approval 't"laS n1ade by lIr. Sprott with the stipulation that notices of other
ovmers to recommend vacating of the Plat, and seconded by 11r. t~laJj<:er. 1.fotion
carried unanimously.
PZ 68-5 Eequest of IJIrs. Beulah Bailes Brown to re-zone portion of the vI .vi. vlallace
Survey from its present classification of "1\.griculture" to a proposed class-
ification of "ColTIITlercial" was read by 1'11-. Ray Porter to the Planning & Zoning
Commission. This being the s&~e tract of land in part or portion of property
as wanting to be vacated. The plat ,~s discussed by the Commission for re-
zoning. IvIr. Stegall advised that IJIrs. Br01ffi owned a nine acre tract plus the
Highland Addition that she l1ad asked to be vacated. The amount of property
involved was explained by 1·ír. Porter to the Planning & Zoning Commission.
tIr. C.1J. l)larsh, prospective buyer of the property involved, was asked why
l1e asked for "Cormnercial" rather than "Local H,etail". 1-11'. IvIarsh stated that
l1e did not understand t11e zoning at the tirne he was discussing it with IJ1rs.
Brown. 1-1r. Porter stated that "Local-Retail" had more restrictions than
"Cormnercial" and to anlend the request to "Local-Retail" rather than nCorrnnercialu.
Various t:lpe businesses were read to llr. lIarsh that would apply to "Iocal-
Retail", and also t't ~~IGo~ercial". Ì-lr. IIarsh agreed to "Local-Retail". Request
to classify from n.coffimërci:r..1iïn to "Local-Retail" was voted on by the Planning
and Zoning Cornmission. Vote for "Local-Retaillt carried unanimously_ Ivlotion
was rnade OJ,!' J.Œr. Crawford and seconded by lŒr. P;yron. Illotion of approval of
lIrs. 13rown for "Local-Retail" was made by l·Ir. Crawford and seconded by J-Ir.
Pyron. 11otion carried una11ÌJnously.
Adopting an Ordinance amending l\rticle XXI, Accessory Building Regulations
of Zoning Ordinance /1179 was Tabled until the Ineeting of 1-Iay 15, 1968.
