MINUTES OF THE PLANNING AND ZONING CO~~ISSION
JANUARY 20, 1.966

I.
MEMBERS PRESENT:
Clarence Pyron, Bill Marshall, Clarence Kinnaird, and
John Sprott. Mr. Marshall was selected as Acting Chairman.
II. CALL TO ORDER: 7:40 P.M.
III. CONSIDERATION OF MINUTES:
Motion was made by Mr. Sprott for approval of the minutes
of the previous meeting. Mr. Kinnaird seconded the motion.
Motion carried 4-0.
IV. ZONING CASES:
1. PZ 66-1.
Request of Richland Hills Church of Christ to
re-zone a 10.331 acre tract out of the W. W.
Wallace Survey, Abstract 1606, from the pre-
sent classification of Class "A" Residential
to a proposed classification of "Local Retail,
Local Business Districts."

Mr. Marshall read the legal description aloud
and designated the geographical location of the
property on the City Map.
Mr. Don McHam presented the case to the Board
and pleaded it's approval
Jerry Meyers represented the opposition and
asked for denial along with a signed petition.
Bruce Stewart asked when the church building
will be constructed. Mr. McHam stated not later
than 1967.
Mr. Kinnaird addressed the Board aloud and stated
he would recommend disapproval of the re-zoning for
the reason that if the property should be zoned
as requested that there is not any concrete assur-
ance that a church would be built, therefore, the
adjacent homeowners may suffer financial damages
due to some undesirable retail establishment allowed
to be built thus lowering their property valuation.
Mr. Kinnaird made the motion to disapprove.
Mr. Pyron seconded the motion. Zoning denied by
a vote of 4-0.
2 . PZ 66-2.
Request of A. E. Pettit to re-zone a tract of land
out of the E. S. Carder Survey, Abstract 308, from
the present classification of Class "A" Residential
to a proposed classification of "Local Retail,
Local Business Districts.

Mr. A. E. Pettit presented the case to the Board
after Mr. Marshall had read the legal description
aloud.

PZ 66-2 cont. Sheldon Anisman, Attorney at Law, addressed the
Board and asked them to deny Mr. Pettit's re-
quest. Mr. Anisman also presented a signed
petition to the Board.
Dr. Charles Hogger, E. K. McCathy, Jerry Faulkner
and Grover Ratliff also expressed opposition to
the case.
Mr. Sprott made the motion to deny. Mr. Pyron
seconded the motion. Zoning denied by a vote
of 4-0.
v. MOTION TO ADJOURN:
Motion to adjourn was made by Mr. Marshall and was seconded
by Mr. Kinnaird. Motion carried 3-0.
