HomeMy WebLinkAboutOrdinance 2555 ORDINANCE NO. 2555 AN ORDINANCE BY THE CITY OF NORTH RICHlAND HillS, TEXAS AMENDING THE ZONING ORDINANCE, TO AUTHORIZE A SPECIAL USE PERMIT TO AllOW A CONVENIENCE STORE WITH GAS SALES AND EXTERIOR MATERIALS OTHER THAN MASONRY IN A C-1 COMMERCIAL ZONING DISTRICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE.. -, WHEREAS, after appropriate notice and public hearing, the Planning and Zoning Commission of the City of North Richland Hills, Texas, has forwarded a recommendation to the City Council for amendment of the Zoning Ordinance as set forth herein; now therefore, BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF NORTH RICHlAND HillS" .tEXAS: 1. THAT, in case number PZ 2001-04, a Special Use Permit be hereby authorized to allow a telecommunications tower on property known as Lot 1, Block 1, Culp Addition located at 6700A Davis Boulevard in a 1-2 Medium Industrial District subject to the following conditions: 1. A minimum 6' simulated wood or masonry screen surrounding the site. 2. The planting of 6 trees that meet the Landscape ordinance along the site periphery and the removal and replacement of any dead trees within 60 days. 2. THAT, development of this property shall be consistent with the site plan attached as Exhibit "A." 3. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. Ordinance No. 2555 Page 1 of 2 4. SAVINGS CLAUSE. That the Zoning Ordinance of the City of North Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this Ordinance. 5. EFFECTIVE DATE.
