ORDINANCE NO 2556
AN ORDINANCE OF THE CITY OF NORTH RICHLAND HILLS, TEXAS,
AMENDING THE ZONING ORDINANCE TO ESTABLISH A PLANNED
DEVELOPMENT DISTRICT; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the Planning and Zoning Commission has reviewed a rezoning request on
a tract of land identified in Case Number PZ 2001-08; and
WHEREAS, the developer has indicated an interest in establishing the proposed
development as a Planned Development District under the guidelines of the North
Richland Hills Zoning Regulations; and
WHEREAS, the City Council has determined that the development conditions of this
tract of land do not provide adequate opportunities for development under available
existing zoning district regulations; and
WHEREAS, after appropriate notice and public hearing, the City Council of the City of
North Richland Hills has approved an amendment of the Zoning Ordinance by
establishing a Planned Development District and by changing said Zoning Ordinance as
set forth herein; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:
1.
THAT, in Case Number PZ 2001-08, the following described property, attached as
Exhibit A, Location Map, shall be rezoned from PD Planned Development and R-1
Residential to establish a Planned Development District with specific development
regulations on 1.57 acres of land
2.
THAT, the purpose of this Planned Development District is to provide for a retail
pharmacy development. The permitted uses and development regulations for this
planned development district shall be as follows:

1. Permitted Uses: All uses permitted in the C-1 Commercial District.
2. ROW Dedication: A 12' dedication of ROW along Precinct Line Road.
3. Landscape Buffer: A 15' landscape setback allowed along Precinct Line Road with a
minimum of 6' of the irrigated landscaping in the Precinct Line Road ROW. This
landscaping to be maintained and replaced at owner's expense. Irrigation to cover
the curb along Precinct Line Road.
4. Access: An additional right inlright out access point along Precinct Line Road subject
to Public Works Department approval. The access point from Mid-Cities Boulevard
shall be a minimum 30' radius subject to Public Works Department approval. Both
access points to have landscaped islands according to the attached plan.
5. Fire Lane: The fire lane on the east-side of the building shall be extended to the
adjacent property to the north.
6. Siqns: All signs shall meet sign ordinance requirements.

THAT, the development regulations are hereby amended, and specifically, the C1
Commercial Zoning District regulations which are not in conflict with the terms of this
Planned Development District shall govern development on said property, except as
follows.
1. The request for PD zoning on 1.57 acres is permitted;
2. Building articulation shall reflect that as approved on the attached plan;
3. All construction shall consist of a minimum 95% masonry materials;
4. EFIS is permitted only in that area behind the CVS-Pharmacy wall sign on the
building façade. All other areas shall be of masonry construction.

THAT, all provisions of the Zoning Regulations of the City of North Richland Hills, as
amended, which are not in conflict with the terms of this Planned Development shall
remain applicable on said property, and the provisions of the C1 Zoning District shall
apply to this property to guide development, except where amended herein.
5.
THAT, the Zoning Map of the City of North Richland Hills be amended to reflect this
planned development district.
6.
SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City
Council that the section, paragraphs, sentences, clauses and phrases of this ordinance
are severable, and if any phrase, clause, sentence, paragraph or section of this
Ordinance 2556

ordinance shall be declared invalid or unconstitutional by the valid judgment or decree
of any court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such invalid or unconstitutional phrase, clause,
sentence, paragraph or section.
7.
SAVINGS CLAUSE. That the Comprehensive Zoning Ordinance of the City of North
Richland Hills, Texas, as amended, shall remain in full force and effect, save and except
as amended by this ordinance.
8.
EFFECTIVE DATE. This ordinanc~ shall be in full force from and after its passage.

CONTRACTOR SHALL SEED AND ESTABLISH GRASS IN ALL REMAINING NEW AND DISTURBED
AREAS NOT OTHERWISE PLANTED WITH TREES, SHRUBS AND GROUNDCOVER.
IF SITE IS TO BE SEEDED DURING A SEASON WHEN THE BERMUDAGRASS IS DORMANT
(APPROXIMATELY MID-SEPTEMBER TO LATE MARCH). CONTRACTOR SHALL SEED WITH
ANNUAL RYEGRASS AT NO ADDITIONAL EXPENSE TO THE OWNER. CONTRACTOR SHALL
RESEED WITH BERMUDAGRASS AND ESTABLISH GRASS PRIOR TO FINAL ACCEPTANCE OF
THE SITE.
DO NOT SUBSTITUTE PLANTS WITHOUT PRIOR AUTHORIZATION BY THE LANDSCAPE
ARCHITECT OR OWNER.
PLANTS SHALL CONFORM WITH THE STATE OF TEXAS REGULATIONS FOR NURSERY

GROUNDCOVER AREAS WITHIN THE PLANTING BEDS AS INDICATED ON THE DRAWINGS.
INSTALL STEEL EDGING PER MANUFRACTURER'S RECOMMENDATIONS.
ALL REQUIRED LANDSCAPING SHALL BE MAINTAINED IN A HEALTHY GROWING CONDITION AT
ALL TIMES.
CONTRACTOR SHALL MAINTAIN TURF AND LANDSCAPE AREAS IN A NEAT AND ORDERLY
MANNER UNTIL FINAL ACCEPTANCE BY THE OWNER. MAINTENANCE SHALL CONSIST OF
WEEDING, WATERING" MOWING AND EDGING, SPRAYING, FERTILIZING, GARBAGE AND DEBRIS
REMOVAL, TEMPORARY EROSION CONTROL AND EROSION REPAIR AT A MINIMUM.
SITE SHALL BE IRRIGATED WITH A PERMANENT AUTOMATIC IN-GROUND IRRIGATION SYSTEM
WITH AN ANTI-FREEZE DEVICE. SET AT 38·F. THE IRRIGATION SYSTEM SHALL BE INSTALLED
BY A LICENSED IRRIGATOR OR MASTER PLUMBER.
STAKE ALL TREE LOCATIONS PRIOR TO INSTALLATION FOR OWNER'S APPROVAL. ALLOW A
MINIMUM OF 48 HOURS NOTICE TO THE OWNER.
CONTRACTOR SHALL GUARANTEE PLANTS FOR A PERIOD OF ONE YEAR AFTER INSPECTION
AND ACCEPTANCE. CONTRACTOR SHALL PROVIDE ONE YEAR MAINTENANCE ON PLANT
MATERIALS.
REQUIRED LANDSCAPING MUST BE PERMANENTLY MAINTAINED IN A HEALTHY GROWING
CONDITION AT ALL TIMES. THE PROPERTY OWNER IS RESPONSIBLE FOR THE REGULAR
WEEDING, MOWING. EDGING, PRUNING, FERTILIZING, IRRIGATING, AND OTHER MAINTENANCE
OF ALL PLANTS AS NEEDED.
PLANT MATERIALS WHICH DIES SHALL BE REPLACED BY THE OWNER WITHIN A SIX-MONTH
PERIOD WITH PlANT MATERIAL OF SIMILAR SIZE AND VARIETY.
NO TREES SHALL BE PLANTED WITHIN TEN (10) FEET OF A FIRE HYDRANT AND SURFACE
UTILITIES SUCH AS PAD MOUNTED TRANSFORMERS AND GAS METERS.
SHRUBS SHALL BE PLANTED A MINIMUM OF TWO (2) FEET OFF THE BACK OF CURBS.
NO TREES SHALL BE PLANTED IN THE VISIBILITY TRIANGLE AS DEFINED IN THE ZONING
ORDINANCE. ARTICLE 6.
ALL EXISTING TREES ON SITE SHALL BE REMOVED. SEE TREE MITIGATION TABLE, THIS
SHEEr.
