Chairman Joe Crane called the meeting to order and asked any representatives of the B.I.S.D. to come forward. Mr. Bill Cypert, Director of Building and Grounds for the B.I.S.D., came forward. He stated they were asking for the va~iance for several reasons, the main one being cost. He said the proposed Carrie Thomas School was going to be basically the same as the Northridge Elementary that was jast bui:t. Y!ary Norwood asked why a new school was being built. B~ll Cypert stated the building was unsafe structurally, ~here was foundation movement, ceilings and windows were breaking. Howard Vestal of Vestal, Loftis, and Kalista Architects came forward. He stated he was representing the 3irdville Independent School District. He showed the Board several drawings of the site plan of the school. He stated the classrooms have 2 ways to get out of the building and all rooms have operable windows. The parking area will have fire lanes as well as parking and emergency vehicle turnarounds. Orvi:le Baker motioned to approve the request of the Birdville Indepedent School District. Motioned was seconded by Harold Schubert and approved 3-2 with Mary Norwood and John Larriviere against. BBA 90-2 Request of R.J. Hart to appeal Demolition Order of the house located at 8201 Main Street. Chairman ~oe Crane asked if there was any representatives wishing to speak. Charlavan Hart, 1:07 Driftwood, Euless, Texas 76039 came forward. She stated her husband and she had bought the property several years ago with the intentions of putting in an antique store. She said they have had trouble with the house being vandalized and at one point were going to sell the house to a man who was going to remodel the house for the downpayment. Some improvements were made but the deal fell through. The Harts then contacted the City to find out if there were any codes or requirements they needed to finish the house and were informed the City had posted a Notice and Order for demolition because of abandonment. The notice was sent to Mrs. Hart!s son and was returned unclaimed. She and her husband were never notified. Mrs. Hart stated a member of the Beautification Committee approached her about giving the house to the City as a historical monument. The HartIs agreed to this but never heard anymore about it. Because of the condition of the house and its abandonment, the City is requesting the house be brought to code or demolished. Bringing the house into current compliance is not feasible. Chairman Joe Crane asked Bob Williams the date of the notification sent to the Harts. 30b Williams stated January 23, 1990. YIr. Crane asked for the date of the notification sent prior to this one. 30b Williams stated there were several notifications sent. Hart stated they were waiting to see if they had to bring it up to code. Chairman ~oe Crane asked 2r thev were willing to bring it up to City code. YIrs. Ha~t stated they could not bring a house that old up to code. They wanted to bring it up to a a safe standard. Chairman Crane stated the house was in such a delapidateà condition that other than bringing the house to code, it could not be made livable. Harold Schubert asked the City Staff what it would take to bring the house to code. ~r. 30b Williams stated it would take disassembling, new fouDdatioTI¡ removal of decayed wood and replaced with approved materials. He stated as far as the communication with the Harts from the City, Ken YIille~ would be the one to explain the content. Ken Miller stated he talked with Mr. Hart the first time concerning an abandoned automobile at the house. Mr. Hart had asked if he could get a renter in the house and bring it up to a livable condition would Mr. Miller be satisfied. Ken said he could go along with that at the time because the~e was no hole in the floor. The property was then cleaned up. This was about two years ago. Mrs. Hart stated there was no way to bring the house to code. They would just like to b~ing it to a livable condition. The only problems the City had with the house was the abandoned vehicle and high grass and weeds. Chairman Joe Crane asked Mr. Williams if this was the only problem the City had with the property. Mr. Williams stated the City received calls from time to time for high gras~, dumping, unpleasant ?remises and the abandoned vehicle. Mrs. Hart stated that was a result of no one ~lv2ng ~~ere. ~ost or the damage to the house was done recently. The hole in the floor was a direct result of the walls being torn down by the contractor. Mrs. ~art stated she was concerned with the safety of the building. Chairman ~oe Crane said the Board could not give permission for the Hart's to repair the house to what they thought was livable. He stated if the Harts obtained a building permit within the nex~ sixty days, they would then have six months to bring it up to code. Mary Norwood asked Mrs. Hart if she had approached the City Council about donating the building to the City. Mrs. Hart stated no, they had only spoke with ~aCk Roseberry and Virginia YIoody who approached the Harts. Mary Norwood motioned the Board give the Harts sixty days to decide what to do with the building. At the end of sixty days if nothing has been done the Notice and Order would go in effect. The building would have to be demolished within thirty days from April 13, 1990. The building would have to be demolished by May 13, 1990. John Larriviere seconded and the motion carried 5-0.
