approved 5-0.

Appian Way Apartments - Sprinkler Requirments
Chairman Robert Skinner called forward the representatives
of Appian Way Apartments.
Mr. Scott Frost came forward and stated he was the attorney
representing ADDian Way Apartments. He said January 7,
1988 a fire broke out in one of the buildings as a result of
arson. Two units of the eight in that building were damaged
as a result. A building permit was obtained to do the
repairs and it was found that Ord. No. 1377 was requiring
a sprinkler system be installed throughout the building. The
o~dinance was unclear as how far the extense of the damage
had to be for a sprinkler system to be installed. There was no
provision for existing buildings. Major renovations will have
to be done for the system to be installed. The cost of the
system would be between $17,000 and $19,000. Appian Way was
requesting the Board of Appeals declare them exempt from Ord.
No. 1377 Section 17.
Mr. Robert Skinner asked if Appian Way had settled with the
insurance company.
Mr. Frost stated yes.
Mr. Skinner asked if the six units that were undamaged were
rented.
Mr. Frost stated has not been rented because of the two
damage units. The other six units had some water damage
but would require small repairs.

Mr. Skinner stated the Ordinance
system for any repairs, remodeling,
required the sprinkler
or reconstruction.
Mr. Frost stated Section No. 17 did not state that.
Mr. Skinner agreed, but the Ordinance did stated it was
up to the authority having jurisdiction. He asked if
they would rent any of the six units.
Tish Trimble, the apartment manager stated the units would
have to be cleaned and painted before they were leased. The
sheetrock could be cleaned instead of having to be
torn out.
Mr. Skinner stated the fire occured in January. He
asked Danny Taylor what was the date the building permit
was obtained to restore.
Danny Taylor stated June 14, 1988.
Mr. Robert Skinner stated the demolition order was still in
effect should the permit expire and nothing is done on the
building. He asked if bids had been turned in on the
building.
Ms. Trimble stated yes, but the banks were involved and were
going over the bids.
Mr. Skinner asked what was the time projection for completion
of the building.
Ms. Trimble stated they had ninety days in the contract.
Mr. Skinner asked who the contractor was and were they
aware a sprinkler system has to be installed.
Ms. Trimble stated Penco Construction was the contractor
and they were aware the sprinkler system had to be
installed.
Danny Taylor asked the total square footage of the building.
Ms. Trimble stated about 8,500 square feet. She said the
sprinkler system would have to be monitored and that
would be ext~a expense.
Mr. Taylor stated a residential system does not have to
be monitored.
Ms. Trimble asked where in the Codes it stated that in the
event of repairs, the building would have to be brought up
to Code.

Mr. Taylor stated that both the Building and Fire Code
left it to the authority having jurisdiction to set the
policy.
Mr. Joe Crane made the motion to deny the appeal of Appian
Way Apartments.
Mr. Michael Dean seconded and the motion car red 5-0.
