CALL TO ORDER Chairman John Larriviere called the meeting to order September 8, 1987 at 7:00 P.M. 2. MINUTES OF THE REGULAR MEETING JULY 14, 1987 APPROVED Eric Hill moved, seconded by Michael Dean, to approve the minutes of the July 14, 1987 meeting. Motion carried 4-0. 4. BBA 87-6 REQUEST OF JEWEL COR INC. TO APPEAL THE UNIFORM PLUMBING CODE REQUIREMENT OF TOILET FACILITIES AT 4200 EDISON DRIVE. Acting Chairman Robert Skinner called forward the representatives of Jewelcor Inc. Gerald Hodges, President of Haws and Garrett, came forward and stated Mr. Walker of Jewelcor would not be able to attend the meeting. Mr. Walker asked Mr. Hodges to point out Appendix C makes no provisions for retail facility. Robert Skinner read the letter submitted by Jewelcor. He stated the Board would interpret the Uniform Plumbing Code as they feel is justified. Mr. Hodges stated he wanted a decision, he was willing to do whatever was decided. Orville Baker stated he did not understand what part of the Code to interpret from. Page 2. Mr. Hodges stated he understood from Mr. Walker, the restrooms were for the employees and not for the public. Jewelcor did not interpret this as being a facility that required public restrooms. Eric Hill asked the difference of Codes between Fort Worth and North Richland Hills. Danny Taylor stated he did not know what Building Code Fort Worth was using. Jimmy Beach stated there was no difference in the Codes. Fort Worth has different inspection departments. One person does not do a whole plan revue. Orville Baker stated the closest thing he could find for the requirement is in the category under restaurants, pubs, and lounges. Gerald Hodges stated the restrooms in this building were in the back in a storage type area and difficult for the public to get to. Robert Skinner asked if a person would have to walk through a storage area to get to the restrooms. He asked Jimmy Beach to explain how he determined the number of toilet facilities for this building. Jimmy Beach stated he went by the Uniform Building Code first and figured the occupant load of 333. He reduced the number to 300 to even it out. He then looked under Appendix C and split the number in half which allowed 150 for men and 150 for women. Under the table for Office Facilities he came up with: 6 toilets for the men 6 toilets for the women 6 lavatories for the men 6 lavatories for the women. He felt it was excessive, and gave the City 60% on the men's and women's toilets. He also gave 40% to the City on lavatories. He explained to Mr. Walker the restrooms were not just for the employees. Orville Baker moved, Eric Hill seconded, to deny the request of Jewelcor Inc. The motion carried 4-0. 5. REVIEW OF BBA 87-3 REQUEST OF JERRY P. BIRDWELL TO APPEAL THE ORDER OF DEMOLITION AT 3920 RUFE SNOW DRIVE. Robert Skinner called forward the representative of the appeal. Jerry P. Birdwell came forward and turned on his tape recorder. Robert Skinner stated the Fire and Building Inspectors were on Mr. Birdwell's premises the present day and did Mr. Birdwell recieve a copy of their report. Mr. Birdwell stated he had a copy. Page 3. Robert Skinner asked Steve Pence if he had written a new report or reviewed the report dated 7-16-87. Steve Pence stated he had reviewed the report of 7-16-87. Robert Skinner asked who was present at the building on the present day. Steve Pence stated Mrs. Birdwell, Ken Miller, and himself were present. Orville Baker asked if the listing from July 16, 1987 was the final list. Steve Pence stated yes. Mr. Birdwell stated he agreed to having a final list made and he would do his best to comply with the items. He stated the Code Enforcement Officer told him once he had completed the list then Mr. Birdwell would have the Code Enforcement to deal with. Ken Miller stated the items were already on the Inspection list under Item No.5. Robert Skinner stated on July 14, 1987, he made a motion that by July 16, 1987 Steve Pence would have met with Mr. Birdwell and do an inspection on Mr. Birdwell's building including Jerry's Cabintry. A final list was to be drawn up by the Building and Fire Department and were to be applied to both Jerry Birdwell and Jerry's Cabintry. Mr. Skinner asked if Item No. 1 on the list had been completed. Mr. Birdwell stated yes. Robert Skinner asked Steve Pence if Item No. 1 had been completed. Steve Pence stated no. Mr. Birdwell asked Steve Pence what had not been done. Steve Pence stated the exit door from Jerry's Cabintry had not been installed including the room across the hall. Mr. Birdwell asked if he was talking about Jerry's Cabintry's personal office doors. Steve Pence stated yes they were marked as exit doors. Mr. Birdwell asked what Ordinance the requirement was under. Mr. Skinner stated on the inspection of July 16, 1987, Mr. Birdwell asked that question and was told the reason for the requirement and shown the doors that would need the locks. Mr. Birdwell stated there were some things he was told to do that did not have to be done and he wanted to know according to the City Ordinance what he did indeed need to do. Page 4. Robert Skinner asked if Item No. 2 had been completed on the exit signs. Jerry Birdwell stated yes. Robert Skinner asked Steve Pence if Item No. 2 had been completed. Steve Pence stated yes. Robert Skinner asked Mr. Birdwell if Item No. 3 had been completed concerning the fire extinguishers. Mr. Birdwell stated two extinguishers were in the upstairs and two in the office area. Mr. Skinner asked Steve Pence if Item No.3 had been completed. Steve Pence stated no. Mr. Skinner asked Mr. Birdwell if Item No. 4 concerning smoke detectors had been completed. Mr. Birdwell stated some had been installed. Mr. Skinner asked Steve Pence if Item No. 4 had been completed. Steve Pence stated two smoke detectors in the upstairs storage area were complete. From the four detectors required downstairs, there was only one detector hanging with no power to it. Mr. Skinner asked Mr. Birdwell if Item No. 5 concerning General Housekeeping had been completed. Mr. Birdwell stated it could have been clean three days previous but to the present day it could be piled four feet deep. Mr. Skinner asked Steve Pence if Item No. 5 had been completed. Steve Pence stated all the materials should be arranged as to not constitute a fire hazard. The materials were not arranged. He was at Jerry's Cabintry at closing time the present day and there were wood shaving allover and no attempt to clean up was made. Robert Skinner acknowledged the arrival of John Larriviere to the meeting. Robert Skinner asked if Item No. 6 concerning radiant heaters in the cabinet shop were completed. Mr. Birdwell stated the heaters were to be moved out a month and a half ago. Mr. Skinner asked Steve Pence if the propane bottle was still there. Steve Pence stated yes but the heaters were no longer there. Page 5. Mr. Birdwell asked if the City had an answer as to where to put the bottle since he can not put it where he wants. Danny Taylor stated the propane bottle could be chained to the outside of the building with proper plumbing running to the inside of the building. No flammable material could be stored inside the building. Natural gas could not be hooked up with a rubber hose. Steve Pence stated the type of heater with the propane bottle is not allowed in a cabinet shop. Mr. Skinner asked if Item No. 7 concerning light fixtures had been completed. Mr. Birdwell stated he asked everyone that came to the building if he could not do something else besides sheetrocking the bottom of the joists and trapping the dust in between the first floor ceiling and the second floor. Mr.Skinner asked Steve Pence if Item No. 7 had been completed. Steve Pence stated no. Light fixtures were still hanging without all the panels in place. Mr. Skinner asked Mr. Birdwell if Item No. 8 concerning electric panels, outlets, and boxes was completed. Mr. Birdwelll stated he did not know. Mr. Birdwell asked Steve Pence if Item No. 8 was completed. Steve Pence stated it was completed in Mr. Birdwell's area but not in Jerry's Cabintry where he could not see that anything had been done. Mr. Skinner asked Mr. Birdwell if Item No. 9 concerning panels on heating units had been completed. Mr. Birdwell stated they were on the last time he saw them. Mr. Skinner asked Steve Pence if Item No. 9 had been completed. Steve Pence stated yes. Mr. Skinner asked Mr. Birdwell if Item No. 10 concerning flammable material under the stairway had been completed. Mr. Birdwell stated he removed the wooden cabinet which was under the stairway and has not installed a steel cabinet. Mr. Skinner asked Steve Pence if Item No. 10 had been completed. Steve Pence stated yes. Mr. Skinner asked Mr. Birdwell if Item No. 11 concerning fire rated doors had been completed. Page 6. Mr. Birdwell stated he asked about the doors and had not gotten an answer as to whether the glass door in the front of the building would be acceptable. Danny Taylor stated as long as there was no more than 100 square inches and had tempered glass. Mr. Skinner asked Steve Pence if Item No. 11 had been completed. Steve Pence stated the original requirement was a one hour fire rated door and the Fire Department dropped that to a 20 minute fire rating to save expense. The glass doors were accepted as a 20 minute rating. Mr. Skinner asked Mr. Birdwell if Item No. 12 concerning emergency lighting had been completed. Mr. Birdwell stated he put three lights in the front hall way and the work area upstairs. Steve Pence stated the lights were in place but when tested only one operated. Mr. Skinner asked Mr. Birdwell if Item No. 13 concerning obstruction of the exits had been completed. Mr. Birdwell stated the telephone booth had been moved. Mr. Birdwell asked if this requirement was in the code as to how far from the door. Steve Pence stated the width of the door determined the amount of space on the outside of the door. Mr. Birdwell asked how far through the door did space need to be clear. Steve Pence stated that was common sense. In answer to Mr. Birdwell's question of the Ordinance No. for Item No. 1 was 1984 NFP NO. 1 3-4.1. 5. Mr. Skinner asked Mr. Birdwell if Item No. 14 concerning the fire rated separation had been completed. Mr. Birdwell stated there had to be another way to do this without trapping the dust above the sheetrock. He wanted to see if there was another alternative to the Code. Steve Pence stated it had not been completed. This was a City Ordinance Section 19 which required this. Eric Hill asked if it was feasible to cut out the wall and become a one occupancy building. Steve Pence stated he did not know of anything that could be applied to give it a one hour rating. If Mr. Birdwell could show written documention on a tested product, it would be accepted. -- .- --""..-.~.,,,-~-,~>._~.~.-,,-~~-~..-~-...-,-._._,,,..,.-----.---- Page 8. Mr. Skinner asked Mr. Birdwell if Item No. 15 concerning designated aisles had been completed. Mr. Birdwell stated yes. Steve Pence stated it had been completed. Mr. Skinner asked Mr. Birdwell if Item No. 16 concerning exhaust fans had been completed. Mr. Birdwell stated 6 fans had been installed. Steve Pence stated he could not get up into the upstairs office to check but the rest of the rooms had them. Mr. Skinner asked Mr. Birdwell if Item No. 17 concerning the repair of sheetrock had been completed. Mr. Birdwell stated he did not know. Steve Pence stated it had not been completed. Mr. Skinner asked Mr. Birdwell if Item No. 18 concerning the ceiling truss had been completed. Mr. Birdwell stated only some pieces of trim were left. Steve Pence stated it had not been completed. Mr. Skinner asked Mr. Birdwell if Item No. 19 had been completed. Mr. Birdwell stated Jerry Eberly was responsible for that and he did not know if it had been completed. Steve Pence stated it had not been completed. Mr. Skinner asked Mr. Birdwell if Item No. 20 concerning report on ceiling floor truss had been completed. Mr. Birdwell stated a report had been submitted when the building was built. Steve Pence stated he had seen so such report. Mr. Skinner read letters submitted by Don Coleman, an engineering consultant, Jerry Birdwell and Commercial Inspector Joe Johnson concerning the truss assembly. Mr. Skinner asked Mr. Birdwell if Item No. 21 concerning the fire lanes had been completed. Mr. Birdwell stated yes. Steve Pence stated it had been completed. Mr. Skinner asked Mr. Birdwell if Item No. 22 concerning fire lane on the north side of the building had been completed. Page 9. Birdwell stated yes. Steve Pence stated it had been completed. Mr. Skinner asked Mr. Birdwell if Item No. 23 concerning extinguisher in the cabinet shop and been completed. Mr. Birdwell stated it had been place somewhere else. Steve Pence stated there was no extinguisher where he had requested. Mr. Skinner stated 8 of 23 items had been approved by the inspectors. Eric Hill asked if Item No. 4 was partially completed. Steve Pence stated yes. Mr. Birdwell stated he was responsible for the upstairs part of the building meeting the requirements and Jerry Eberly was responsible for the downstairs meeting requirements. Michael Dean asked if Mr. Eberly was Mr. Birdwell's tenant. Mr. Birdwell stated yes. Michael Dean asked if Mr. Birdwell was relying on Mr. Eberly to meet the requirements for Mr. Birdwell's building. Mr. Birdwell stated the only thing that was being done to the building was the fire rating between the two businesses. Mr. Skinner motioned, seconded by John Larriviere, to post the building as a dangerous building and the occupancy of the building is prohibited, and utility service would be stopped on the City's order. Motion carried 5-0. 6. DECISION OF APPENDIX C OF THE UNIFORM PLUMBING CODE FOR COMMERCIAL RETAIL BUILDINGS. Michael Dean motioned, seconded by Orville Baker, to go under the requirements for Restaurants, Pubs, and Lounges for toilet facilities in retail sale commercial buildings. Orville Baker asked the plumbing inspector to use his descrepancy with the occupant load. The motion carried 5-0. 7. DECISION OF FIRE DAMPER REQUIREMENTS IN COMMERCIAL BUSINESSES Orville Baker motioned, seconded by Michael Dean, to interpret the Code as decided in BBA 87-4. Page 10. 8.
