1. CALL TO ORDER
Chairperson Sally Hackfeld called the meeting to order
at 3:OOpm.
2. ROLL CALL
Members Present:
Sally Hackfeld, Dennis York, Tom Peterson, Bill Baker,
Bill Fenimore
Others Present:
Melani Fragge, Human Resources Director
Sheri Campbell- Husband, H.R. Analyst
Terry Boone, City Attorney
Smitty Clevenger, Alternate Commissioner
Bob Marks, Alternate Commissioner
Tom Shockley, Police Chief
Richard Carter, Appellant's attorney
Ann Shelton, Appellant
3. ELECTION OF OFFICERS
Commissioner Peterson nominated Sally Hackfeld to
continue as Chairperson. Commissioner Fenimore
seconded and the motion passed unanimously.
4. APPROVAL OF MINUTES
Commissioner York moved approval of the minutes of
FOR JULY 21, 1999.
the July 21 meeting. Commissioner Peterson
seconded the motion and it passed unanimously.
5. HEARING OF APPEALS
Terry Boone made the opening statement for the City.
He then called Ann Shelton to give testimony. The
Commissioners then questioned Officer Shelton.
Terry Boone called Investigator Larry Irving as a
witness. Mr. Carter and the Commission also
questioned Irving; then he was released.
6. RECESS
A ten - minute recess was called from 4:50 — 5:OOpm.
7. RECONVENED
At 5:OOpm Terry Boone called Andy Wallace as a
witness. Mr. Carter and the Commission questioned
him and he was released at 5:25pm.
Terry Boone called Officer Greg Crane as a witness.
Mr. Carter and the Commission questioned Crane and
he was released.
8. RECESS A ten - minute recess was called from 5:50 — 6:OOp_m
9. RECONVENED Terry Boone called Joe Walley as a witness. Mr.
Carter and the Committion questioned Walley and he
was released.
Terry Boone called Officer Todd Espy. Mr. Carter and
the Commission questioned him and he was released.
10. RECESS Recess was called at 6:30 until 7:15pm for a dinner
break.
11. RECONVENED Called back to order at 7:20pm.
Terry Boone called Sid Johnson as a witness. Mr.
Carter and the Commission questioned him. Carter
was released at 8:10pm.
Terry Boone called Chief Tom Shockley. He was
questioned by Mr. Carter and the Commission as well
and was released at 8:55pm.
The City rested its case at 9:04pm.
Richard Carter made the opening statement for the
appellant. He also agreed to release Lisa Rowland,
Andy Kancel, Brian Gentry, Greg Trickey, Tom
Cleveland, and Pat Murphy as witnesses.
Mr. Carter called Joe Slinkard as a witness. Mr. Boone
and the Commission questioned Slinkard and he was
released.
Mr. Carter released Richard Kitchen as a witness and
called Greg Stilley to testify. Mr. Stilley was questioned
by both attorneys and the Commission, then released.
Mr. Carter recalled Officer Ann Shelton. Mr. Boone
and the Commission also questioned Shelton.
The remainder of the witnesses on the appellant's list
were released.
Mr. Carter rested the appellant's case at 10:06pm.
Both sides made closing statements.
12. RECESS TO DELIBERATE Called at 10:31pm.
13. RECONVENED At 10:50pm.
Sally Hackfeld, Commission Chair moved that on
Appeal number 99 -08 the discipline be set aside and
lost wages should be restored and that on Appeal
number 99 -07, the disciplinary action should be upheld.
Commissioner York seconded and the motion passed
unanimously.
The Commission Chair also asked to read a statement
into the record expressing the Commission's
disappointment regarding this incident and the
members' hope that their decision helps bring healing
and closure for the Police Department.
14. ADJOURNMENT 10:52pm.
