OF THE CIVIL SERVICE COMMISSION

1. CALL TO ORDER Chairperson Sally Hackfeld called the meeting to order
at 7:00 p.m.
2. ROLL CALL Members Present:
Sally Hackfeld, Chairperson
Bill Biggers, Commissioner

3. APPROVAL OF MINUTES Commissioner Biggers made the motion to
FOR AUGUST 23, 1995 approve the minutes of the meeting held August 23,
1995, seconded by Commissioner Jaynes. Motion
carried by unanimous vote.
4. COST-OF-LIVING The Commission reviewed the Southwest Statistical
RECOMMENDATION Summary of the Consumer Price Index dated February,
1996. After discussion, Commissioner Bracke made
the motion to recommend 2.5% cost-of-living increase
to Council, seconded by Commissioner Biggers. Motion
carried by unanimous vote.
5. PROPOSED REVISION The Commission reviewed the current and proposed
9.13e FMLA revision of Section 9.13 of the Civil Service Rules and
Regulations, as follows:
Current:
e. Exhaustion Paid Leave
An employee who takes FMLA leave must exhaust
accrued vacation leave for leave provided under
Subsection (b) (1), (b) (2), or (b) (3), as part of the 12-
week entitlement period, before beginning leave without
pay status. An employee who takes FMLA leave must
substitute and exhaust accrued sick leave provided
under Subsection (b) (4), as part of the 12-week
entitlement period, before beginning leave without pay
status.
Proposed:
e. Exhaustion Paid Leave

Subsection (b) (1) or (b) (2). An employee who takes
FMLA leave provided under Subsection (b) (3), must
first exhaust sick leave and secondly accrued vacation
leave as part of the 12-week entitlement period, before
beginning leave without pay status. An employee who
takes FMLA leave provided under Subsection (b) (4)
must substitute and exhaust accrued sick leave as part
of the 12-week entitlement period, before beginning
leave without pay status. The requirement to exhaust
paid leave does not apply for absences due to an on-
the-job injury which results in a serious health condition,
as defined by this Act.
Commissioner Biggers made the motion to approve the
revision as proposed, seconded by Commissioner
Jaynes. Motion passed by unanimous vote.
6. PROPOSED REVISION The Commission reviewed the current and proposed
10.01 a CAUSE FOR revision of Section 10.01 a of the Civil Service Rules
DISCIPLINARY ACTION and Regulations, as follows:
Current:
10.01 Cause for Disciplinary Action
Any action which reflects discredit upon the municipal
service or is a direct hindrance to the effective
performance of the municipal government functions
shall be considered good cause for disciplinary action
against any employee in the classified service.
Circumstances constituting cause for disciplinary action
are listed below, although charges may be based upon
cause or complaints other than those listed:
a. Habitual use of alcoholic beverages to excess,
public drunkenness, or the illegal use of
narcotics.

Proposed:
a. Habitual use of alcoholic beverages to excess,
public drunkenness, or the illegal use of
narcotics. The City's zero tolerance policy
toward use of alcohol or drugs and administered
through the drug testing program adopted by
City management will be considered grounds for
permanent suspension based upon a positive
test.
Commissioner Biggers made the motion to approve the
revision as proposed, seconded by Commissioner
Jaynes. Motion passed by unanimous vote.
7. PROPOSED REVISION The Commission reviewed the current and proposed
11.01 APPEALS revision of Section 11.01 of the Civil Service
Rules and Regulations, as follows:
Current:
11.01 General Provisions
A regular employee in the classified service has the
right to appeal to the Civil Service Commission any
adverse action taken against the employee. Adverse
actions are defined as actions that would result in loss
of pay, reduction in pay, pass over for promotion,
reduction or loss of an employee benefit, or the alleged
denial of fair and equal consideration regarding all
aspects of employment including the alleged denial of
reasonable accommodation or access to public facilities
by handicapped employees.
Proposed:
A regular employee in the classified service has the
right to appeal to the Civil Service Commission any
adverse action taken against the employee. Adverse
action is defined as action by a department head which
directly results in loss of pay which includes permanent
suspension, suspension without pay for any period,
reduction in grade (arising from disciplinary action) and
an actual pass-over for promotion. Adverse action will

also include denial of reasonable accommodation to
public facilities if the employee is disabled. Adverse
action does not include reprimands and ~ating
procedures which "could" indirectly result in loss of pay.
Police Association representative Andy Wallace made
comments to the Commission.
Commissioner Biggers made a motion, seconded by
Commissioner Bracke, to table this item and to
reschedule a meeting to discuss the issue when the
attorneys for the Police Association and the City could
be present. Motion passed by unanimous vote.
8. ADJOURNMENT Meeting adjourned at 7:30 p.m.
