OF THE CIVIL SERVICE COMMISSION

1. CALL TO ORDER Chairperson Sally Hackfeld called the meeting to order
at 7:00 p. m.
2. ROLL CALL Members Present:
Sally Hackfeld, Chairperson
Bill Biggers, Commissioner
Larry Bracke, Commissioner
Cliff Jaynes, Commissioner
Others Present:
Rex McEntire, City Attorney
Linda Cast, Human Resource Specialist
Greg Dickens, Director of Public Works
Larry Jones, Utility Superintendent
Robert Nelson, Utility Supervisor
3. OATH OF OFFICE Human Resource Specialist Linda Cast administered
the Oath of Office to Commissioners Sally Hackfeld, Bill
Biggers, Larry Bracke, and Cliff Jaynes.
4. APPROVAL OF MINUTES Commissioner Biggers made the motion to
FOR MAY 16, 1995 approve the minutes of the meeting held May 16,
1995, seconded by Chairperson Hackfeld.
Commissioner Jaynes abstained. Commissioners
Biggers, Bracke, and Hackfeld voted to approve.
Motion carried.
5. APPEAL 95-03, APPELLANT Appellant Robert Nelson, Utility Supervisor, appeared
ROBERT D. NELSON before the commission to appeal a 1 day suspension
for throwing a cup of coffee on a coworker.
Mr. Nelson invoked the rule, and witnesses were
excused from the meeting room.
Greg Dickens, Director of Public Works, was called as
the first witness by Mr. McEntire. Upon questioning,
Mr. Dickens stated that he knew of the one day
suspension of Mr. Nelson, and approved. Mr. Nelson
had no questions for Mr. Dickens.
Larry Jones, Utility Superintendent, was called by Mr.
McEntire as the next witness. Upon questioning, Mr.
Jones stated the suspension was based on an
investigation he conducted concerning an incident
between Mr. Nelson and Bob Mahon, another Utility
Supervisor. On July 18, 1995, Mr. Jones and Mr.
Mahon had words while on the parking lot of the service
center. During the exchange, Mr. Mahon used
profanity, and Mr. Nelson threw about a half cup of
coffee on Mr. Mahon. Mr. Jones stated that both
supervisors were in agreement with what happened.
Both supervisors received a written letter of reprimand,
and the remainder of the day off without pay as a result.
Mr. McEntire asked that the letter of reprimand be
placed into evidence.
Mr. Nelson had no questions of Mr. Jones.
There was general questioning by the commission of
Mr. Jones.
Mr. McEntire called Alan Knapp, Utility crewleader, as
his next witness. Mr. Knapp verified that he works for
Mr. Mahon, and that he witnessed the incident in the
parking lot. He was in his truck, along with Ed Cox,
another employee. Having read the appeal in the
interest of avoiding repeating the language in the
hearing, Mr. Knapp verified the language as presented
in the appeal to accurate.
Upon questioning by Mr. Nelson, Mr. Knapp confirmed
that Mr. Nelson did not act unprofessional prior to the
coffee-throwing incident, and after the coffee was
thrown, Mr. Nelson wanted Mr. Mahon to go to Mr.
Jones' office with him.
Mr. McEntire called Ed Cox, Utility MW II, as his next
witness. Mr. Cox verified that he works for Mr. Mahon,
and that he could hear the conversation in the parking
lot from the truck he was in with Mr. Knapp. He
confirmed the accuracy of the statements in the appeal,

and that he did not recall any threats being made.
Mr. Nelson presented his statement to the commission.
The commissioners followed with questions and
comments.
After deliberation, Commissioner Jaynes made the
motion that the appeal as introduced be upheld.
Commissioner Bracke seconded the motion. Motion
carried by unanimous vote.
6. ELECTION Commissioner Biggers made the nomination of
Chairperson Hackfeld to continue as Chairperson,
seconded by Commissioner Bracke. Motion carried by
unanimous vote.
Chairperson Hackfeld made the nomination of
Commission Bracke to be Vice-Chairperson, seconded
by Commissioner Biggers. Motion carried by
unanimous vote.
7. ADJOURNMENT Meeting adjourned at 8:12 p.m.
